Non-resident transport of handgun through New York State

Hello, first post...

I'm going on a motorcycle trip from Florida to Niagara Falls this summer and I want to take my carry weapon with me. I have a CCW in Florida and I know that I can carry under that permit through almost every state that I will be traveling through. The exceptions are Maryland and New York. My plan is to unload the gun and put it in a locked box while I travel through those states, but I'm not sure that is even legal. I'm hoping someone here may know, or be able to direct me to a good website that I can trust.

I understand you're going to Niagra Falls. Where will you stay? You may transport a handgun THROUGH NYS provided the gun is unloaded, locked, you have your home state license or FOID and your trip THROUGH the state is uninterrupted. You cannot stay in NYS while in possession of your handgun.

The only exemption in NYS law (S265.20 of the penal law) allows someone to remain in NYS with a handgun for the purposes of exhibition or training, provided you have a copy of your home state license or FOID, a copy of registration / confirmation documents for the event, training or competition and transfer it unloaded and unlocked. You may enter and leave within 48 hours of such event.
 
like BC1 said you are allowed to pass through any state you are not allowed to carry in as long as you are only passing through with no over night stays (stops for food and gas are allowed). you must have your home state permit and id with you, and the gun cant be loaded and nothing immediately accessible. you can look up FOPA (firearm owners protection act) and find more information.
 
If any cop in NY see's your gun, you will be arrested first, you can try & prove your case second.
They don't mess around up there, they do not honor any states CCW, and they don't care what the law says.
run an internet search...Ryan Jerome & Meredith Graves are a few better know instances of travelers being screwed for no good reason.
best advice..do not bring a handgun to NY
 
The best solution to this whole scenario is to never, never, never go to that God forsaken place. If you have relatives there....tell them to visit you.
 
I thought it was common knowledge that our 2nd amendment rights stop at the borders of New York and Maryland.
You think you have rights?

You've already lost many constitutional freedoms. And recent federal decisions found that the second amendment does not include the right to carry a gun anywhere.

The best advice is to stay the hell out of New York period!

I live in PA and have the PA LTCF (license to carry firearm) and the UT concealed firearms permit. This gives me reciprocity with 37 states nationwide. However, 3 of the states that I do not have reciprocity in are MD, NY, and NJ... they all border PA. If you are traveling THROUGH MD or NY, then you must empty your magazines, have both the ammo and the gun locked up but separately and you must NOT stop in the state. In other words, this is how you transport through the state. You may not stay over.

I would look up the state laws for more specificity so that you are playing by their rules. Also, do you have lockable bags on your motorcycle that are bolted onto the bike? If not, you are going to have a tough time locking your hardware.

I would also carry a copy of federal law Title 18-Part 1-Chapter 44 926A, which explains Interstate travel and gives you the right to do so as long as the place you came from you are legal to carry and the place you are going you are legal to carry. Most cops are unaware of this law, especially in anti-gun states. A flaw in your plans might be that your destination is Niagara Falls which is a place you are not able to legally carry, therefore, the federal law would not even protect you on this trip.
