4 On Your Side investigates traffic stop nightmare | KOB.com

This 4 On Your Side investigation looks into the actions of police officers and doctors in Southern New Mexico.
=
A review of medical records, police reports and a federal lawsuit show deputies with the Hidalgo County Sheriff's Office, police officers with the City of Deming and medical professionals at the Gila Regional Medical Center made some questionable decisions.
=
The incident began January 2, 2013 after David Eckert finished shopping at the Wal-Mart in Deming. According to a federal lawsuit, Eckert didn't make a complete stop at a stop sign coming out of the parking lot and was immediately stopped by law enforcement.
=
Eckert's attorney, Shannon Kennedy, said in an interview with KOB that after law enforcement asked him to step out of the vehicle, he appeared to be clenching his buttocks. Law enforcement thought that was probable cause to suspect that Eckert was hiding narcotics in his anal cavity. While officers detained Eckert, they secured a search warrant from a judge that allowed for an anal cavity search.

I've always heard that holding back a bowel movement was not healthy, but this is just ridiculous. I always thought they were referring to medically not constitutionally. I bet this guy has gotten over his propensity against public restrooms.
~
Now the question arises about who is going to pay for all the medical procedures the guy didn't agree to have preformed even though he gets the benefit from knowing the results. If they found something wrong they will say if they hadn't done this he would have been at risk and they saved his life, RIIIIGHT.

Eckert’s history with drugs had been revealed by his attorneys, Joseph and Shannon Kennedy, but there was no mention of any previous attempts to transport drugs in his anal cavity. Still, though court records confirm Eckert’s history of drug-related offenses, we found no information confirming police’s claim that he once was caught with drugs in his anal cavity.

That's your Obamacare at work right there.

So wrong, so really, really wrong what happened. I hope the case is won and several cops, docs and lawyers go on the dole.

Wow. Everyone who clicks in this thread should read the whole piece that dogshawred linked to. It's like state-sponsored gang-bang rape, and for anyone who's ever had a colonoscopy, how ironic is it that three hours after the warrant (to repeatedly search his ass) expired, they shot him full of a cocktail of Valium or Demerol mixed with other Class III or IV drugs in pursuance of the ongoing nationwide drug war!

This was over a traffic stop for not coming to a complete stop. I am literally sick to my stomach after reading that, but thanks nonetheless dog, for posting it. Everyone should know about this.

Bend over Hidalgo County, NM, it's your turn now.

And now I have a few points to share that crossed my mind as I was reading about the repeated anal rape of this gentleman.

First point, the stop sign was in the Wal-Mart shopping center not part of the public street system. Did the cops have the right to even stop him?
Second, why oh why oh why did this man let this situation get to the point where he stepped out of his vehicle for a stop sign violation?
Third, why oh why oh why did this man not state that he would like his lawyer to read the warrant first?
Fourth, LEARN FROM THIS ALL YE WHO READ THIS LINK.

Geesh almighty, I nearly vomited reading what this poor guy went through. I hope for every American's sake, these cops, that judge, and those medical personnel all get their A$$es handed to them. Yes the pun was intended.

Just finished reading ...my sympathies go out to that poor man. Okay everyone there is some sick police officers and doctors in Southern New Mexico. If you live there you may wish to move immediately or if you plan on visiting you may want to go somewhere else. Laughing out loud those doctors and policemen are perverted :p

Did I miss something related to your first point?
According to a federal lawsuit, Eckert didn't make a complete stop at a stop sign coming out of the parking lot and was immediately stopped by law enforcement.
That sounds like the stop sign at the at the public street, that one would be legit. Not the crosswalk signs they have within the lot.
Your points 2 and 3 - spot on!

I was merely questioning since the picture of the stop sign clearly shows it in the Wal-Mart lot.

I guess it wasn't an isolated incident either. The following is part of an article from misguidedchildren.com

"Like Eckert, Timothy Young was also stopped by police officers after a piddling traffic infraction. THE SAME K-9 drug dog, Leo, was called in. He sniffed the seat, and informed the officers that there were drugs on his seat. I bet you can guess what happened next.

Once the warrant was obtained, the officers grinned at each other, as banjo music softly twanged over their squad car stereo.

Young, like Eckert, was taken to Gila Regional Medical Center where a team of physicians were waiting with bated breath.

Once again, the pleas of mercy fell on deaf ears; and once again, the hunt for treasure yielded no results. Mr. Young was sent home with a costly bill and a jar of petroleum jelly.

Now, at this point, you might be thinking that these police officers are either ex-high school gym teachers or they have a group of friends that also consist of a construction worker, a cowboy, a biker and a big gay Indian. I’m sorry, I meant to say ‘Native American.’

Well, it turns out that our friend Leo the K-9 drug sniffing dog had his drug sniffing license expire in 2011, and it was not re-certified. In New Mexico, this certification is to be renewed every year."

The article says Gila Regional Medical Center made some questionable decisions. To top it off they sent David Eckert the bill for the medical procedures. I was going to say something but I better keep my mouth shut.

That sh!t ever happens in my neck of the woods, I'll give the police an anal probe of my own....with my .45 caliber....... Repeatedly!

Sent from behind Enemy Lines.

Can you JUST imagine his situation if he was actually a licensed gun carrier at the time of his stop. OMG how deep would they have gone to make sure he didn't have a back up weapon or extra mags.

And now it appears that men are not the only targets. It's getting worse and worse and I'd think with the publicity they're getting over it, there would be some firings. Maybe if we're lucky at least some sensitivity training?

New Mexico Cops Give Woman Vaginal Search Without a Warrant ? The Free Patriot
Does anyone know what they are teaching LEO in New Mexico? Whatever it is, it isn't working. They should send them back to the classroom or hire better personnel.

Eckert’s attorney, Shannon Kennedy, told TheBlaze allegations that her client has previously been caught with drugs in his anal cavity are “completely baseless” and “false.”

.

“There’s no record, there’s no evidence,” she added. “We did a public records request and investigated that claim thoroughly and found nothing.”

But Kennedy also told TheBlaze that even if the false “rumor” was true, police still went way too far in their effort to find drugs in her client’s body.

“It’s absurd, its outrageous,” she said, adding that a person’s constitutional rights don’t cease to exist because of criminal history.

How about we all read what is actually being alleged by Mr. Eckert, and stop looking to past drug history or past arrests and/or traffic stops, eh?

Here's the actual complaint. The "being known for hiding drugs" in his ass meme is addressed almost right off the bat. It says it's false. Period.

If this were still America, everyone from the cops to the judge to the doctors and nurses would already know first-hand what Mr. Eckert went through.

Blues

ETA: Anyone who has sat passively by not so much as making a peep about the decades-long "War on Drugs," or worse yet, supporting it, Mr. Eckert's blood and excrement is on your hands. This is a direct result of the War on Drugs, which in reality, is nothing more than an excuse to wage war on the American People. When will the badge-fluffers and establishment myrmidons realize that? Probably not until you have a government-mandated sadist probing your asses with all manner of "medical" procedures and implements. This country has well-earned its decline.

Blue the whole reason I even brought this up is because of the way Massad Ayoob has portrayed this article in support of the police departments treatment of Eckert.

It seems that since the officers had an opinion about Mr. Eckert's prior actions it didn't matter that the opinion was false, it was their opinion and they were going to act on it and act on it NOW. This also falls under the militarization of LEO, the public is now the enemy and have not rights.
