Need Help from Erie County NY Forum Members ASAP

Sheriff Howard is going to be the guest speaker at a meeting I am going to.
I will be asking him about the excessive wait for background checks.
I am looking of help with the Towns and Villages.
If you have had experience with getting your license recently please reply by telling me which Police Dept does the background for which town and how long it took you. See below

I got my permit in 2008 when I lived in Orchard Park. It too about 15 months to get it. My friend in Cheektowaga applied for his at the same time and his took even longer - around 18 months I think.
 
I literally just got my permit in Cheektowaga. Took only 6 months and 1 week, and the the background check was done by mail
 
City of Buffalo.

Submitted all paperwork in January 2011.

Received phone call background check from BPD Lieutenant. After asking me the same questions that were on the application, she told me that my references would be contacted "shortly". This happened in September 2011.

References received telephone interviews in October 2011.

Received my permit letter in December 2011.

Time it took to be contacted: 8 months.
Time it took references to be contacted: 9 months.
Total processing time: 10 months and 14 days.

Nothing was done via mail.
 
Lancaster county. Walked in walked out. Got to the car. Concealed. My friend came with me. He was was armed with 2. 15 minutes process. The hardest part was looking for parking.
 
The timing issue has to take into consideration the time it takes the permit office to send out the file to the investigative agency. You have to know when the investigative PD received the file and when the return it to the permit office. Just knowing how long it took overall isn't enough to determine how long it took the local PD to complete the investigation.

Well we already know that the PPO gets the files out to the appropriate PD in about the first 30 days.
After that it is up to the PD's to complete and return to the PPO.
The PPO then will finish in about another 30 days.
City of Buffalo and Erie Co Sheriff are the worst of the PDs
So for example Orchard Park took 4 months total from Permit Drop Off until License received. OP PD completed their part of the process in 60 days.

Now that I re read the thread I understand the point he was making.

No Problem Erie Pa or Erie Co Buffalo we can both swim in Lake Erie.
 
There has been a lot of work done with the PPO the County Clerks Office.
They have done an excellent job of streamlining everything on their end.
The only remaining link in the chain that is causing the slow down is the Police Background Check portion of the process.
That is why it should be made into an election issue for all the Town and Village offices.
We (gun owners) are citizens also.
Start electing people that will start treating us fairly.
 
village of hamburg, sheriffs dept- 5months 1 day turn around june 1st 2011 dropped off permit nov. 2nd 2011 registered 1963 ruger mk1
 
City of buffalo (south buff) submitted app 9/12 fingerprints same day, references contacted by mail first week of march, phone interview with buffalo detective 3/27, ppo said it was dropped off next day, currently awaiting judge if that helps at all
 
Here is a chance to ask the Sheriff directly.

But as they say, money talks and bull____ walks.

The sheriff is an elected protector of the constitution. He is accountable to the people.
Like most politicians however, you have to pay to play.

Questions to ask your sheriff.

My question would be, Sheriff in NY 400 of the penal law the phrase without delay is used 6 times.
One of which is the investigation of the application must be completed and returned to the PP Office without delay.

"Upon completion of this investigation, the police authority shall report the*results*to*the*licensing*officer without unnecessary delay. "

Who in the sheriffs department has authorized violating this law by creating a system that takes your officers 6 to 12 months. (which any reasonable man would consider unreasonable delay)

The statute also states that the application is approved by the Superintendent of the State Police.
No where does it say that local jurisdictions can add requirement to the application. If fact the statute is quite clear in saying that the investigation must be made to determine if all statements made on the application were answered truthfully.
"No license shall be issued or renewed pursuant to this*section*except*by*the*licensing*officer, varies by County but normally is a Judge and*then*only*after*investigation and finding that all statements in*a*proper*application*for a license are true. "

Bottom line there is no reason that Erie County Sheriff Dept should be dragging their feet. Other Departments have demonstrated that they can complete the process in less than 60 days.

We need to make this a campaign issue for Sheriff and all the little towns and village mayors to fix in the whole county.
