LUMBERTON - A Lumberton man traded gunfire with three men who forced their way into his home, robbed the family, tried to rape his granddaughter and stole his car Monday, Robeson County authorities said.

One of the men, identified as Jamie Faison, 20, was shot and found dead in the stolen Cadillac parked at his home on the 600 block of Singletary Church Road, Sheriff Kenneth Sealey said in a news release.

The two other men turned up at area hospitals with gunshot wounds.

The homeowner, Kenneth Byrd, 67, was shot multiple times, the release said.

I'm really not a fan of the Felony Murder Rule that says that participants in a crime where a death occurs as a direct result of the crime, can be charged with murder. In this case, the two survivors would go down for the murder of their dead accomplice. Like I said, I'm not a fan of it, I think only the person committing the crime should be accountable for the specific crime(s) they themselves commit, but if NC has such a rule, it seems the two survivors would qualify. The only reason I mention it is because the link JCliff gave listed the charges already filed, and felony murder wasn't among them. Anyone know if it's available to prosecutors in NC, and if it is, why they might not charge it in this case?

Thanks for the link JCliff. Still a pretty hefty bill of charges.

From the article-
The family told them that a man came to the door and said he was having problems with his vehicle and needed water. Two men wearing black clothing, ski masks and gloves forced their way into the home and demanded money, Sealey said.

All three of the men had guns.

The Byrds were pushed to the back of their home and instructed to open a safe.

When the men tried to rape the couple's granddaughter, Byrd grabbed a gun and exchanged shots with the assailants, Sealey said.

Lessons learned-

  • Don't open the door to strangers.
  • Keep a firearm close by or on your person even while at home.
  • Always be ready to FIGHT!

It's a shame the other two weren't stopped permanently too.

I live in a rural area of the county, anytime day or night, I am either carrying or within reach of a weapon. I run timers on my lights even when I am home just in case I have to leave the house and don't get back before night fall. I can exit my house at 4 different points that give me advantage over anyone at my front door, but cameras give me a better advantage as long as I have power. Being in control is a good thing and always having the advantage will help keep you alive.
