moving, and curious about laws

Like the title say, I am curious about how the laws will apply to my wife and I when we move to South Carolina.

My wife is in the military and soon (A few months from now) we will be stationed down in South Carolina. I was just curious how the laws see us. Are we considered residents? Is only my wife considered a resident? Are we able to purchase handguns? Is there anything preventing us from moving guns we currently own in NY down to SC? What about concealed carry laws?

I have a basic idea of the SC laws but I would like a better explanation before I start dreaming about which guns I can finally buy, thanks.

The Brady Bill prevents anyone from purchasing a HANDgun outside of their state of residency, unless it is shipped to an FFL of your state of residency. Are you going to make SC your state of residency? If so, you may purchase handguns in SC. Another issue comes up. If you are not a resident of SC, you must show proof that you own land in SC to get a non-resident CCP. I've known guys who have joined up and purchased a small tract of land so they can get SC's permit. If you do become a resident of SC, and you don't own land, you may get a resident CCP.

Hope that helps.

Also, use the reciprocity maps on this site to see what states you may travel through while legally carrying when you get to SC.

Your wife will be considered a resident. You will not be unless you turn in your New York State drivers license and get a South Carolina one. If you decide to keep your New York State drivers license but own real property in South Carolina and pay property tax you can get a non-resident Concealed Weapons Permit. It will allow you to carry concealed here but not to purchase hand guns or some long guns. You may bring whatever weapons you own to South Carolina. We have no registration here.

Good response.
From my experience with military moves (20 years), the military member does not have to get a drivers license from the state in which they reside, however, family members do need a local drivers license. You will become a resident once you establish a permanent residence and obtain a drivers license. I'm not sure how a sale would go through for your wife if she doesn't obtain a DL.
Not sure of the tax situation on either state, but my guess would be that being a SC resident would be better than that of NY.

We will be there for just about 3 years so we both fully planned on just getting South Carolina licenses. That would make us both residents? I also am not against buying a small tract of land as it would be a small price to pay for guns I could never own where I currently live.

Also, with the Brady Bill, I get the impression that that means that I would have to buy guns with the NY restrictions? That seems like a huge hassle.

I've lived in South Carolina for almost 20 years. Having a SC drivers license is all you need to be considered a resident. With the exception of full auto stuff, a SC resident can buy most weapons and as many as you want and walk out of the store the same day. If you have a SC CC permit they probably won't even run a background check.

The best place to find out the infomration you need is on the SC Law Enforcement Division web site:

In addition to general gun regulations and requirements you can find out how the CWP process works and the requirements.
