A 90-year-old California man who was shot during an alleged burglary has reportedly been sued by the ...addict who allegedly shot him.

...Samuel Cutrufelli, 31, claims Jay Leone “negligently shot” him during a January confrontation inside Leone’s home....Cutrufelli entered the home and put a gun to Leone’s head before binding the elderly man with a belt and rummaging through the residence for valuables.

Leone said he was able to wriggle his hands loose... then grabbed one of the five handguns from his bedroom ... Cutrufelli, in turn, allegedly fired his gun, striking Leone in the jaw. Leone then fired back....

It should be a crime to sue your victim like that.
 
And for every frivolous lawsuit someone wants to file, there is a money-hungry lawyer who is eager to take the case.
 
We need a law that states if you lose your civil rights during the commission of a crime. Plain and simple. If you get hurt, lose something of value during or as a result of a crime, whatever... you have waived your rights to sue, your family cannot sue, nor can anyone sue on your behalf.

This is why everyone should fight for Castle Doctrine. The protection against bogus lawsuits is priceless.
 
Not everyone. Some of us already have it. But castle doctrine doesn't always protect against negligence, which the plaintiff alleges in this case. By the way, welcome to the forum.
 
The U.S. is the only 1st world country that has rejected the idea that the plaintiffs in these frivolous lawsuits and their attorneys should bear the cost of these court proceedings when they lose. Maybe if that were the law of the land, these ambulance chasing lawyers wouldn't take these unjust cases. As it is, they will take any ridiculous case for a chance at a 1/3 of their clients winnings should they win and nothing to lose but a little time if it's thrown out of court.
 
There's an easy solution to this problem. Any lawyer who files one of these frivolous lawsuits and loses gets disbarred. The lawsuits would stop overnight.
 
I bet his prison AODA counsellor told him that it was the drugs fault and not his and to sue the old man before his kids inherit his money.
