Master Sgt. Arrested for Legal Guns Speaks Out

Master Sergeant C.J. Grisham, prominent military blogger and founder of A Soldier’s Perspective, is currently embroiled in a battle to defend his second amendment rights. On March 16, 2013, C.J. was arrested in his hometown of Temple, Texas, for “rudely displaying” a hunting rifle while on a hike with his 15-year-old son. C.J., who is stationed at nearby Fort Hood, holds a permit for the weapon he was openly carrying that day, which is legal in the right-to-carry state of Texas as long as it does not cause alarm. Since the story broke, many Americans have been stunned by the video footage of the arrest, which was filmed by both C.J. and his son.

In order to defend his second amendment rights, C.J. launched an online fundraiser in late March 2013, which has already amassed more than $31,000 in donations. “No one should have to fear being illegally disarmed without warrant, especially someone who has never committed a crime in his life,” C.J. writes. “There is an overt attempt to disarm Americans, and especially veterans, in this country.”

I have a big problem with these laws being passed that say you can do something unless it "causes alarm". That is extremely inconsistent from person to person. There was another video of a marine open carrying while walking down the road and the cops told him they could detain him and take his gun because people had called in concerned about a guy walking down the road with a gun. His reply was, "so if I get alarmed by green shirts, I can call the police on every person I see wearing a green shirt and you'll come and detain them and take their shirt?"
 
If we had justice in this country, C.J. would walk out of court owning everything except the clothes those officers are wearing. Everything else they ever owned would belong to C.J.
Plus they would be unemployed.
 
I hope I'm wrong, but when people finally wake up, I might be too late. As a Veteran, I know what it took that made this country great, but I'm afraid many are trying to bring us down. Things like this should never happen. The silent majority is sitting back in the weeds and I think they'll react when the time comes.
 
Texas has a law against displaying a firearm at all outside your own property unless you're hunting... Correct me if I'm wrong but a boy scout hike is not hunting...
 
Since my arrest for just someone accusing me of pointing a weapon at him, without any other witness. I can sure understand about people running into anti-citizen owning firearms cops. Trust me if your ever in Tulsa Oklahoma and you run into Tulsa Police Officer Ms Kristy Maxwell Allen, you had better understand she is 100% anti-citizen having a CCW permit and even owning a firearm. If she can arrest you as she did me she will surly do it. After a year of going through the Oklahoma Un-Justice system and having to spend over $3,000 for my Attorney. A jury found me innocent in just 32 minuets. Also the jury asked to shake my hand, proudest day in my life I wish to tell everyone. Point I am trying to make there are a lot of cops who hate citizen firearm owners, and if they get any small chance to arrest one they will surly do it.

I had a similar thing happen a few years back with a hot head that had just gotten back from Iraq (not trying to bash any military...he was just one of those few that let's it go to his head). Lucky for me and unlucky for him, my boss who also has been family friends with my parents since I was born happened to be the primary funder of our solicitors campaign. So I went to court the next morning but everything was dropped and expunged after that, and he lost his job that day. And what was even funnier was my judge was my fiance's (girlfriend at the time) dad's best friend. When he started looking at his statement he chewed him up and spit him out!

I agree. Law should be specific and never subjective.
 
Many times when a cop encounters someone with a fire arm even one legally carried, they will make up some law they feel will give them the right to make an arrest. Then it's up to you to get out of jail and take care of any prosecution that happens to get filed. Getting the cops to admit a mistake has been made by one of their own,just won't happen. Trying to make a law suit against a cop or the city will most time get you no where, just cost you a bunch of money.
 
Many times when a cop encounters someone with a fire arm even one legally carried, they will make up some law they feel will give them the right to make an arrest. Then it's up to you to get out of jail and take care of any prosecution that happens to get filed. Getting the cops to admit a mistake has been made by one of their own,just won't happen. Trying to make a law suit against a cop or the city will most time get you no where, just cost you a bunch of money.
That's why it's good to have friends in high places ;)
