The lawsuit alleges that “Individuals cannot be required to demonstrate that carrying a handgun is ‘necessary as a reasonable precaution against apprehended danger’ as a prerequisite for exercising their Second Amendment rights.” Plaintiffs are seeking a permanent injunction against enforcement of the Maryland provision that requires permit applicants to “demonstrate cause” for the issuance of a carry permit.

“Laws that empower bureaucrats to deny the exercise of a fundamental civil right because they cannot show good cause to exercise that right can’t possibly stand up under constitutional scrutiny,” said SAF Executive Vice President Alan M. Gottlieb. “We are supporting Mr. Woollard in this action because constitutional rights trump bureaucratic whims.”

SAF Wins Suit in Maryland: Carry Permit Law Unconstitutional

A federal court ruling in Maryland, that the Second Amendment right to bear arms extends beyond the home and that citizens may not be required to offer a "good and substantial reason" for obtaining a concealed carry permit, is a huge victory, the Second Amendment Foundation said today.
Will this have any effect on NY Law? Probably not. The Second Amendment will continue to stop at NY State Lines.
 
Nothing will happen in NY. The judges will just ignore it. Judges like William Boller (Erie County) who denies CC permits for personal defence on a regular basis and issues hunting/target permits with trigger lock requirements at all times. By the way, in NYS, a Judge like William Boller is CELEBRATED as a Pro-second amendment judge! I'm not making this up!

Perhaps someone can forward this court case to the Honorable William Boller? Maybe one of the Safari club members who hang out with him? Or maybe SCOPE?
 
What makes New York so difficult?

Why does the SAF stop at NY state line? what makes NY so insurmountable? Is it the citizenry? I will certainly do what it takes to get something going here. What is the SAF afraid of? Come on, SAF, we're part of this country , too. We should have the same rights as our brothers in the southern states. Help us out here! Grow some!
 
Well, it gives someone who wants to challenge the NYS permit law some ammunition. If a federal district court disagrees (most likely doing so because bound to follow the 2nd Circuit's rulings on the issue) then it can be appealed to the 2nd and on to the SCOTUS if the 2nd circuit sticks to its guns.

If this decision gets upheld by the 4th circuit it will create the type of conflict that is often needed to get the SCOTUS to hear the case.
 
I suggest starting with a case challenging Judge William Boller in Erie County. Judge Boller has been rejecting CC permits for years by saying 'personal protection' is not a valid reason. Maybe S.C.O.P.E. and the Safari club can join us in challenging Judge Boller? Will the Safari club or S.C.O.P.E. join a legal challenge against Judge Boller? Fat chance as they are pals with the judge. For those of you following this story from other states, a judge in NYS who REJECTS concealed carry permits for the reason of 'personal protection' is honored for his pro-second amendment stance. THE TRUTH HURTS!

Why does the SAF stop at NY state line? SAF does not stop at State Line, SAF is suing Westchester County.
The Second Amendment Stops at the State Line as does the NRA.

what makes NY so insurmountable? Is it the citizenry? in a word, YES! New York City is so large that the representation in Albany is skewed toward NYC and it's surrounding areas. The ruling class of the citizenry in that part of the state view themselves as "sophisticates" and the rest of us as rubes. They believe that they know what is best for us in spite of ourselves.
They also for some reason will do just about anything their Mayor wants. It is almost feudal like and we (out side the castle walls) are the surfs.

We should have the same rights as our brothers in the southern states. Yeah we should but we don't. Chalk it up toa high concentration of Jewish Americans who will vote D no matter who is running and corruption going all the way back to 1911 with Tammany Hall and Tim Sullivan. The people let it happen then and we continue to let it happen today. No one to blame but ourselves.

Help us out here! Who are you asking for help from? It all starts with you the individual. Just as they did in England, the Anti Gun Progressives divide and sub-divide US,(gun owners) into sub groups. We are everything from bible holding gun toting rednecks, to crazy xenophobic homophobes. Once a New Yorker goes through the long and arduous process of obtaining a permit, they are exhausted. They then take the attitude of "Well I got my permit for Life now, I guess the laws aren't so bad" in other words, I got mine so the hell with you.
Yes there are a few that are still passionate about the cause SCOPE and NYSRPA but their member ship is aging and recruiting the younger generation who have been indoctrinated by our public education system is proving to be a greater challenge than anyone could have imagined. Children start hearing (not form parents) from the beginning "Guns Bad!" "Sex Good" ; "Shooting Bad", "dancing good"

Grow some! Currently the silent majority has started to grow some, but they have been beaten back by the people in power.
November 2010 was an example. I am afraid though that they too are now tired of being called names and grouped into a leper colony so the status quo of Progressive Liberalism will win in the end.

MHO is we have 3 choices;

Stop believing that the constitution means anything, start studying Marx, stop going to church, turn in your guns to be melted down, become accepted into the herd of progressive liberalism and allow the elite sophisticates to be your Shepard.

Tuck your tail between your legs and move out of NY.

Stand and fight.

Thank you for your reply. I think I will choose the latter and stand. My application for a permit has been submitted, now all I have to do is wait for the 8-12 months it takes for the background check. Wish me luck. Steuben Co. isn't as bad as some of the neighboring counties, it's just they are incredibly backlogged due to the increase in gun applications and sales since Obama became Pres.
 
Way to go @golocx4...they are handling the case in Westchester, NY, and a similar case to MD in NJ along with the ANJRPC (free to the six law abiding citizens involved). The NRA abandoned NY, NJ, IL, CA. They don't go were the fight should be brought, unless they're guranteed a win! Go to the NRA site that announced the MD case...the frauds tagged a news report that doesn't mention the SAF at all! Makes it look like the NRA actually had something to do with it...just like they tried the with MacDonald in IL<<<it was the SAF not NRA Second Amendment Foundation Online
