Marine faces 15 years behind bars for unknowingly violating NY gun law

This why you must research the laws of each state while traveling with your firearms. I think this guy is getting a bad rap and I hope people in NY will come to his aid and find him NG when it goes to court. I hate NY, NJ and most of New England for their BS anti-gun laws and I think this area along with California breeds most of the fascist left anti-gun group.

I hate living here. This is the worst state in the country. I have a NYS pistol permit yet i cant go to nyc. I hope this state burns to the ground.

That could be arranged. Just start a drought, add high winds, and flip a cigarette out the window (Gasoline soaked tied to a rag).

That being said, it is so easy to find out what areas are prohibited, and, even with states that have carry permits, or allow carry without a permit, it is easy to obtain information right on this website. Luke needs to publicise the website to as many instructors as possible, and even state legislators, to mention this site and encourage students of the mandatory training required by so many states to go to Concealed Carry, Concealed Carry Reciprocity Maps, Concealed Weapons Permit Info and familiarize themselves with the carry info maps. That's two stories this week about a person not from NY getting busted for breaking the laws on the books.

We feel for you there brother, the whole state is held hostage by the loons on Long Island and Manhattan.

What can we do about these laws?

Yes, we all need to research the laws before we go someplace new. But this marine and the woman who went to the 911 memorial with a gun are not criminals. Somehow we need to support these people, many people in trouble even if they know the law: the guy taking a gun to a NYC airport thinking he was protected by the federal interstate transportation law. The guy from PA connecting through Newark, and then his flight was cancelled and he was arrested. Somehow we need to pressure the police/legislators/city councils/governors. When they see the backing the firearms owners have, maybe they will stop harassing us and change the laws.

My wife and I live in Ohio. We never visit ANY state or city that will not allow us to protect ourselves and carry. We even boycott restaurants here in Columbus that post "no gun" signs. In November, we emailed a Honda dealership to let them know that we honored there "no gun" sign and bought a new car at a different Honda dealership!

If gun control works, why is it that cities that have the strongest gun laws have the highest crime!!

I do not agree with the gun laws, but they are laws, and anyone who owns a gun needs to spend a few minutes looking at the laws before carrying their gun.

This guy sounds like a good guy to me, but being a good person isn't an excuse to break the law. If I robbed somebody and then asked a cop if my actions were okay or not, I would get arrested. If I then pleaded that I didn't know it was illegal and that's why I asked, I would not expect a get out of jail free card. Not the best example but Im sure you get the point. Know the law and follow it, or accept the punishment for breaking the law that you failed to research. Gun owning and carrying has a lot of responsibilities in society these days.

What is in NYC worth seeing at the risk of being imprisoned over being an American? I have no plans to ever visit NYC, just like I will never visit Chicago or Compton...what's the drive to go there?

Absolutely true! There MUST be some distinction for people who mess up on carry protocol vs. people who intend to do harm. I sincerely hope the people of New York take that into consideration

It's a dog and pony show to convince the public and politicians they're doing their job. "OOH, we got a real baddy here!" Mean while the career baddies get a pass. The punishment in both cases is extreme for the stories we've heard. Hopefully the prosecutors will have some common sense. But I think they'll use these instances as examples and to boost their conviction records. I wonder what on line site gave him the wrong info? It also occured to me that maybe in both these cases, they thought that since HR822 passed in the house, it was okay to carry in n.y., not knowing the bill hasn't completed the process yet.

If the state of New York, and "the people" of NYC believe that these tourists and travelers ensnared in the evil web of laws created to keep the population under control, are a threat to the people of New York, then they are either despots, deranged, or irretrievably stupid.

We need tight gun control laws here. You may want to shoot yourself when the tax bill comes for the privilege I living in this state....

Seriously though, I know we are talking about gun laws here but this is the way NY governs. The government doesn't trust the judiciary as the judges were soft on crime liberals some time ago, so everything has a mandatory minimum sentence without plea possibilities so that judges have no choice. Our forefathers would be sick if they could see what happens here.

No, I can't move but thanks or the suggestion. I hadn't thought of it before.

You can see what it's all about, a war on decent gun owning Americans.

But speaking to someone with a badge, deliberately drawing attention to yourself, asking what you should do, is very likely to have terrible consequences and extremely unlikely to bring good results.

Painful lesson for the poor guy. Apparently, he's been living in the distant past, thinking he's a free man or something. Welcome to the Police State.

Last time I went to NY I did not carry. Was not a happy camper and vowed never to return to that cesspool.

This past week I took a firearms safety class so that I can get a CCW. The instructor said that if the marine would have said firearm instead of gun he might not have been arrested.

For sure. I'm paying nearly $1,000 per month in property tax. And I'm not that bad off compared to many homeowners.

Councilman demands DA drop charges against marine.
Several high profile cases are just what is needed. If the press keeps the heat on, NYC may change. Tourism dollars are very important to the city, and when you alienate a growing large percentage of the population, they might see revenues drop. I don't know who said it first, but publicity or sunshine is the antiseptic for that festering sore that is NYC's gun laws.

ps.
If I robbed somebody and then asked a cop if my actions were okay or not, I would get arrested.
You're comparing apples to oranges. Robbing someone isn't legal anywhere, whereas, CCW is legal. Instead, you should've said, "If one makes a right turn at an intersection while the light is red, and then ask a traffic cop if it's okay, would one get arrested?"

I don't buy that rationalization at all. Of course know the law and protect yourself, but that is not the problem. The problem is differing State and local gun laws that say one thing and are implemented another way. There is absolutely no reason why every State and locality should have their own set of laws. Doing so restricts inter-State travel and the Second Amendment. It is just plain ******** IMHO.
