SHANDAKEN - A 25-year-old man was shot in the groin when he struggled with another man inside a home, police said.

Kyle Manny was being treated at Kingston Hospital for his injury, according to state police at Ulster.

Police said Manny was struck in the groin by one bullet fired from a 9mm semiautomatic handgun.

Police said that Manny had gotten into a fight with another person inside the residence at state Route 214 in Phoenicia.

During the altercation, the owner of the home, John S. Rymer, 68, armed himself with the handgun, police said. The handgun is legally registered, police said.

“. . .In the course of the ensuing altercation one round was discharged and struck the alleged assailant (Manny) in the groin,” the press release said.

Police said the investigation led to the arrest of Richard Manny, 27, who had been staying at the residence with Kyle Manny.

The older Manny was charged with criminal mischief and endangering the welfare of a child, misdemeanors.

The suspect was arraigned in Town of Kingston Court. He was released without bail.

The investigation surrounding the firing of the weapon by Rymer and the actions of Kyle Manny is continuing, police said.

Now the question remains, Was it self defense? A proper and just use of a fire arm to defend oneself or an illogical irresponsible use of a tool in an emotional situation?
Hopefully the investigation will resolve the questions.
