Man Charged with Showing Handgun During Argument

Hey firefighter: Tow truck operator in the Bluffton shooting was onsite when the confrontation began. He went back to his truck and retrieved his firearm and began to fire at the brandisher, claiming that the brandisher had removed the brandished firearm from his waistband and had pointed it at him. It is unclear, due to poor initial testimony by the brandisher's family, who were the only other people there and seemed to change their story making their testimony somewhat biased and a bit conflicting, whether the brandisher actually had taken his firearm out and pointed it at the tow operator, since the firearm was eventually recovered not in the brandisher's waistband but on the ground. Who knows what the truth really is? My point is that if you want to believe the tow guy, you can believe he felt that he was in imminent danger--why he did not cell phone police at his tow truck instead of just retrieving his firearm--who knows--Bottom line and why I mention it is the fact that brandishing can very well cause your death,

You are correct, the driver never left the scene per say...but also didn't take the opportunity to leave the scene either when he had the opportunity to get in his truck. I agree, there is no universal truth when it comes to what brandishing will accomplish...maybe it will stop the threat, maybe it will land you in a lawsuit, maybe it will land you 6 feet under. The tow truck driver story just does not sit well with me. Some things are better left alone I suppose...

His last shot in the head or back to a down and obviously non-imminent danger opponent will put him away for 30 years. The prosecutor brought him up on manslaughter charges to the chagrin of many but the unreliable testimony of the relatives leaves only a they said, he said on the self-defense argument his attorney will bring forth. Really a sad, sad case of what brandishing can do.
It is easy to talk the talk on this forum and not have to walk the walk. I can only hope that 1. I never have to face such decisions on presenting a firearm 2. I will do everything in my power, including SA, to avoid any confrontation and will know "imminent danger", which is the only, only, only reason to be presenting a firearm as a second away from using same to defend myself.

Is this one of those "brandishing" stories?

I agree that there's not enough infomation to determine guilt, but according to the story, he was picked up and not the 8 that were trespassing on his property. Something fishy about this one.

How I read this cop come in asked the guy this question do you have a firearm? answer is yes cop says where is your firearm? guy answers right here in my holster.
Cops needs to hear nothing more, cop arrests the guy.
Now it's up to the District Attorney if guy is going to be charged. Question will he file charges with just the guy having a firearm on him and someone else saying he pointed it at them. Answer is hell yes.
The cop could care less about the eight other people being in the guys home, the guy had a firearm so it's a slam dunk to just arrest him.
