Man Charged with Showing Handgun During Argument

I think that's a big no-no, a display of arms with intent for bodily harm or something like that. As a permit holder you're supposed to use more intelligence and walk away before anything escalates into something you'll regret later
 
The question remains, ladies and gentleman of the jury, did he actually do it or not. He says, "No, but was afraid for his wife and child." Another witness (outside of the group?) says he never saw a gun drawn. - Now they (the trespassers) know he had it, so it leads me to believe something happened. Did I miss something? This was on his property? 8 people on his property? Trespassing.
Now, Clarksville is tamed down and citified. But there are a lot of places in TN I wouldn't get out of my car for any reason for fear of not ever being found again. Too many sink holes!

I am not in any way saying he was right. I'm just saying that there may be more to the story. He never should have let on that he had a gun unless he was going to use it.

I don't want to convict a guy based on what the newspaper says. When is the last time they actually got the facts right and didn't twist the story?
 
WTF - in Tenn you can't display your firearms on your own property? I could understand if he was waving the thing around and threatening people, but the story says he displayed the gun.
 
Agree with Treo, not enough information....

But if i were to make a judgment with the information provided, 8 vs 1 on his property, I'd say he was in the right for now.
 
I hope everyone remembers me posting about this man Steven Jay Sockey just seeing my handgun at the Gym as I was changing, this after he was mad that my wife had walked to slow in cross walk in front of the gym.
He knew he could not confront a woman so he followed me into the gyms locker room.
I had not seen his face did not know who he was, as he walked up to me and asked if I had just come into the gym.
He noticed my handgun in my gym bag where I had just placed it.
He never said another word, just went out to where the gyms manager was in his office and said I had threatened him and pointed my handgun at him.
Police were called and Tulsa Police Officer Kristy Maxwell Allen, after just asking me if I did have a handgun in gym and where was it at.
She went and spoke to the gyms manager and Steven Jay Sockey, then came back took me to the locker room got my handgun and placed me under arrest.
With nothing but this guys saying I did and me having my handgun with me, she just took his word as fact arrested me.
as many might remember after around a year of going to the Tulsa County Court House each Month my case went to trial and the jury found me not guilty.
I just wish to point out that just someone seeing your handgun and them having a beef with you, you could end up in jail and in court.
I am now in the process of suing Steven Jay Sockey for what he did and the trouble he caused myself and my wife.
I may not get a dime and it is costing around $2,000 for my Attorney, but it is forcing him to also get and Attorney and pay him, so I bet he will understand that what he did was now causing him and his wife some problems.

I'm sorry to hear about this. This is a perfect example of one of the many reasons why I feel that open carry is a bad idea. Someone just seeing a gun can end badly even if you're carrying concealed. I also don't put any NRA stickers or etc on my vehicles. The last thing I need is some punk who I "almost ran off the road" calling the cops and tellling them I pulled a gun on him.

Eight people trespassing on my property? Sounds a whole lot like disparity of force to me. Now, eight adults come on my property and don't leave when asked, I'm going to get a wee bit nervous. Hand on my gun? If that is all it takes I will be grateful.

It takes about a second and a half for the average person to draw, aim, and fire. In that time the average person can run about seven yards. At 21 feet that gives you a tie with eight people. Not the kind of odds that would get me on the next plane to Vegas. Having your hand on the gun will reduce the time of the draw considerably.

Can placing your hand on the gun escalate the situation, certainly. In this case it would seem that the situation was deescalated. Do we have enough information to make a judgement here, no but I am going to anyway. :) My guess is that he used the least amount of force necessary to get the criminals off his property. Criminals? Yep, I don't know the laws in all States but here trespassing is a crime.

If I am being threatened by eight people on a city street disparity of force would excuse me the use of a gun, even to the point of killing someone should it come to that. This guy was on his own property. Here we do not have a duty to retreat. If I could I certainly would in a public area. On my own property I am far less likely to back down.

There is a continuity of force, verbal (asking them to leave), placing the hand on the gun, drawing the gun, aiming the gun, and pulling the trigger. These are all distinct levels of engagement. Now you may go from the A to Z here in under two seconds or you may stop at any point along the chain. Were I on this mans jury you would have to show me some very serious mistakes before I voted guilty.

Reading stuff into the story that is not there I am going to guess that the gentleman made one serious mistake, he did not call 911. Had he been the first to call and file a complaint we might have seen a different outcome. I see the police having the option to arrest nine people and making nine bad choices.

I was very very young when my parents started telling me that a man's home was his castle. Chill ladies, this was back when Betty Crocker was still young. This has an effect on my attitude to this day. I will always lean in favor of the homeowner. I know that outside the structure is somehow considered different by many jurisdictions. But on or off your own property I do believe that most jurisdictions do let you defend your self against greater force. Okay, well, do you mind if I grab a bar of soap out of this box?
 
If he brandished a firearm he is lucky all he got was arrested. Last xmas eve in Bluffton SC, a man brandished a firearm at a tow truck operator who had booted his car. The brandisher is now dead and the tow truck operator is on trial for manslaughter not so much for killing the brandisher in potential self defense but for going back to the brandisher, now down on the ground with 4 or 5 bullet wounds and not a threat, and putting a final bullet in him and telling his latino family, who are now outside with the man, "feliz navidad". Personally and certainly without all the info that will come out at trial, up until the last shot, self defense can be argued.

Definitely not enough information, but... Seems he was on his own property at the time? Eight people vs. a pea shooting .380? He would have done more damage with flatulence and bad breath :biggrin:

Having a cell phone in one hand and your other ready to draw while telling the dispatcher "There are trespassers on my property, and I am afraid for my life. I do not want to have to shoot anyone, but I am armed" will go a longs way to both clearing your property, and saving your butt if you should have to shoot.

This story still confused me. How can it be self defense if he left the scene, came back, and shot even one bullet?

Good point. It seems most of the cases involving the victim getting in terrible the victim didn't call 911. Lessons to be learned.
