Man Brandishes Gun to Reporter

The worlds filled with ignorant people. Unfortunately, it reinforces why we should have a screening process and I really hate to say that. Had that boy been high, no telling how bad that could of turned out.
 
He did not point the handgun but I don't know what Arkansas firearm laws state about showing one in a threatening manner, no matter it's going to cause this guy a bunch of problems and a lot of money defending it in court.

Those of you who think brandishing isn't wrong, do you support this guy? The sight of his gun is clearly preventing a crime from happening (sarcasm).

You do realize you are relating this story to people who feel it's ok to draw a weapon but not having to fire it in a true life endangering self defense situation (aka the majority of SD situations involving FA)...this is like asking if we gun owners support a mass murder in his killings if he used a firearm.

There are times when brandishing is appropriate, this is not one of those times. The problem with brandishing laws in some States is that if someone can tell that you have a gun under your clothing you can be prosecuted for brandishing. Had he been confronted by gang bangers then his actions might have been appropriate. Since he did not actually point the gun at anyone it is quite possible that the charges will be reduced. Also, this guy was not charged with brandishing, he was charged with assault. What this guy did was inappropriate, totally uncalled for, and probably criminal (12 good people and true will make that determination). I do not find this video a vindication of the way brandishing laws are being interpreted in some areas of the country.
 
Idiot. It's people like this that causes all of us to have such a hard time defending our rights. 1 bad gun toting idiot and all gun owners get grouped with this idiot. He was okay until he grabbed gun. MORON!!

Both situations are brandishing and are illegal (unless the police, prosecution, or jury see it as justified). If this guy did that in Colorado, he would get charged with a felony and would never own a gun.
 
Simple way to stop brandashing is to have constitutitioal 2nd amendment open carry.

I agree soon it will be law in Oklahoma if it had been law on July 16 2010 the guy who just saw my handgun while changing in the gyms locker room, could not have said I pointed it at him. He got me arrested because cop said I was a CCW permit holder and she said I should have never allowed my handgun to be seen. With open carry she could not have used this to arrest me.

I did not find a brandishing law in Arkansas during my brief search but its covered in their assault laws.

5-13-207. Assault in the third degree.

(a) A person commits assault in the third degree if he or she purposely creates apprehension of imminent physical injury in another person.




Apprehension: anticipation of adversity or misfortune; suspicion or fear of future trouble or evil.
 
It would have been great if the reporter or the camera man were carrying legally and the news station allowed them to carry while on the job. The out come could have been much different.
 
My guess is he is not a CC permit holder so his actions would not be the actions of 99% of us that read this site. He is an idiot who just showed that he is not responcible enough to carry.

In Washington the guy clearly violated RCW 9.41.270:

(1) It shall be unlawful for any person to carry, exhibit, display, or draw any firearm, dagger, sword, knife or other cutting or stabbing instrument, club, or any other weapon apparently capable of producing bodily harm, in a manner, under circumstances, and at a time and place that either manifests an intent to intimidate another or that warrants alarm for the safety of other persons.

(2) Any person violating the provisions of subsection (1) above shall be guilty of a gross misdemeanor. If any person is convicted of a violation of subsection (1) of this section, the person shall lose his or her concealed pistol license, if any. The court shall send notice of the revocation to the department of licensing, and the city, town, or county which issued the license.

And that retard should be in jail, however, brandishing in its proper time and place, is a very effective and legitimate tactic. We have been saying for years that the law should punish the guilty, not prevent the innocent from acting in self defense. That retard and ones like him make it hard for the rest of us to keep sheeple law off of us.

I'll admit that one of the reasons I carry is to protect myself from nuts like Mr. Crazy. But I'm not looking forward to a gun battle.

So a guy holds a firearm in the manner that this idiot did and you'd do nothing? You're putting your life in his hands. I suppose if there was a way to retreat then maybe, but image if he'd of pointed the gun instead of brandishing it.
