Man arrested after discharging gun inside Walmart

That's f'ed up, man! No playing with the firearm. I wish AZ needs to change back to old bill law for Arizonians must have license to carry concealed instead of "concealed carry without license". I assumed many young men are bragging to have open carry firearm like this. They could be discharged like him. :fie:

EL MIRAGE, AZ -- A west Valley Wal-Mart customer was arrested Thursday after accidentally firing a round while playing with his pistol inside the store.

El Mirage Police Department spokesman Robert Peoples said officers were dispatched to the store near Thunderbird and Dysart roads after a call came in that shots had been fired.

While officers were en route, they discovered no one had been injured and that the store manager was standing with the suspect.

Peoples said the suspect was identified as 30-year-old David Walters, of Surprise.

During the officer's investigation, witnesses said Walters entered the store carrying a semi automatic pistol in a holster.

According to witnesses, Walters continually "messed" with the gun while it was in the holster. He would reportedly holster and un-holster the gun, which made the other customers and employees nervous.

As Walters stood at the electronics counter talking to the clerk, he pulled the gun out of the holster and thumbed through some nearby magazines, Peoples said.

The clerk said she was afraid that she was about to be robbed. She notified the store manager of the situation after Walters left the counter.

Walters reportedly approached the checkout lane and while standing at the end of the counter, he pulled the gun out of his holster again.

Upon pulling the gun out of the holster, a magazine dislodged and fell on the floor.

Peoples said Walters picked up the magazine, placed it back into the gun, manipulating the gun as if loading the weapon.

While he was doing this the gun discharged and sent shots into the ceiling.

Walters was arrested and booked on six counts of endangerment, disorderly conduct and discharging a weapon within the city limits.

IF the story is true, and I have no reason to doubt it...

He should be arrested and booked ... He should be made and example and true gun owners should support his prosecution..
Just like we want Muslims to stand up and denounce terrorism, Responsible gun owners should denounce people who use their self protection tools in such a careless/reckless way..
IF it is seen that gun owners support the prosecution of bad gun owners, it is less likely that legislation will be proposed to take away everyone's rights.. It creates dialog where responsible gun ownership and use can be expressed and gain support in the public eye that gun owners are not all NUTS..

Just my 2 cents.. I'm sure there will be several that disagree..
 
I don't disagree, Hoot. The man may have started with the RKBA, but, as far as I'm concerned, proved himself to be a fool (if the story is true), and fools lose that right. IMO, you have the right until you prove you can't handle it...and he proved that.
 
i buy a lot of my ammo at Wal Mart because it is cheep and some of them are better than others. However I will say that in some of them the clientele can be pretty weird. The thought of some of them carrying a gun is scary. In others, and I can think of one in particular most of the people in there are hoods and gang bangers so it is not some place that you want to go very often and never unarmed.

So just how many rounds did this yahoo shoot off? I never play with my gun or take it out when out in public. This yahoo is just what the Brady nuts and other antis need to feed the fire of disarming America.

It doesn't appear that the man arrested was the infamous "Lee Paige". Could have been his training buddy or something. :biggrin:

I'm glad that the @$$hat got arrested. He's lucky that nobody got hurt. This jerk has done a huge disservice to gun owners. I hope he gets punished to the fullest extent of the law if the news account was accurate.

Unbelievable! CCW should be a right in every state without a doubt but this numb nuts is going to make it difficult for all. Would I be shocked if he turns out to be a Brady supporter and wanted to show the what if. Probably not!
 
It's amazing what the anti-gunners will do to get their point across. I'll bet this guy is a member of the Brady Center against Gun Violence.

If I remember correctly, AZ is an open carry allowed state. Concealed carry with permit.

Most of the "incidents" nationwide involving lawful firearm carry are open carry.

Typically, open carry requires zero training.

Mr Walters needs a few months in jail, and a serious fine. In addition I would hope Mr Walters is never issued a permit to carry concealed, and his right to possess any firearm be suspended for ten years or more.

It is morons like him who are making the sheep skiddish.
 
Az is an open carry state. Obviously someone who just came from a non carry state.

Not sure what's going to happen with the no permit CCW. I'm afraid we'll have a few incidents like this til the novelty wears off.

I recommend to everyone I know to take the CCW class even if they don't want a permit.
 
Here is the current law in the state of AZ

Under Arizona law it is generally legal to carry a firearm openly as long as you are 18 years of age and not prohibited from possessing a firearm. However, if the firearm becomes covered, say with a coat, or if you are a woman and prefer to carry your firearm in your purse, you need to possess a concealed carry permit. The intent of this legislation is to give people the greatest possible freedom to choose the best method of carry for them. SB 1108 would generally allow law-abiding persons to carry a firearm for self-defense without a permit.

Arizona's constitution, Article 2, Section 26 clearly states that "The right of the individual citizen to bear arms in defense of himself or the state shall not be impaired." The intention of this language could not be clearer.

yes i do agree with this. i also agree that there should be some kind of mandatory weapons training before buying a hand gun. and this guy proves that.

This is a statement I can disagree with. They have a Constitutional right to be idiots just like they have a Constitutional right to free speach. Both of those rights end where someone else's rights begin. You can't scream "FIRE!" in a crowded theatre and you can't allow your stupidity to endanger others. When you do you have a "right" and an obligation to suffer the consequences.

I believe that the Founding Fathers wrote the Second Amendment to ensure our "God given right" to defend ourselves. I also believe that had they been able to forsee that this country would turn into a nation of babbling idiots they would have included some sort of competency requirement in the Second Amendment.

I never have and never will believe that every citizen of this once fine country should be allowed to carry a lethal weapon. I've served with trained soldiers who shouldn't have been allowed to use a lethal weapon. For God's sake, we all know people that shouldn't be allowed to use pointed scissors. Maybe the pendulum, as it always does, is beginning to swing too far the other direction?

It is treading dangerous ground, IMO, to assume what the Founding Fathers "would have done, if they had only known...". We can certainly look to what they did and why but basing our legislative action on "what they would have done" is a bit presumptive to me. Is this argument not the basis for the "living Constitution" invective offered up by the antis and other assorted socialists?

For the sake of argument, why not let the "natural system", if you will, handle problems as they occur much like happened in this case? Guy acted like an idiot and he'll probably pay the price in loss of his 2A rights for a good while, at a minimum. Other rational human beings see this and modify their behavior accordingly.

Eventually, the social system reaches equilibrium and the intelligent, trained, and armed citizen walks freely and easily anywhere he/she pleases because the ne'er-do-wells, misfits, and other BGs are all "weeded out" as necessary and appropriate. Life is good; the Constitution is intact; our rights are secure.

My fantasy, anyway.
