Legal to give firearms to friends or family across state lines?

Hello there,

This is my first post and I've been a concealed carrier for about a year now.

My question is a legal one which not many people claim to know. I'm looking for sure answers from someone that knows the truth.

I'd like to give a handgun to my brother for all the help he's given me recently. my problem is, he's in one state, I'm in an ajoining state less than 100 miles apart from eachother. Both of us carry or have guns in the car, and I'd like to know if I can give him a gun legally without their being legal rammifications if he actually had to use the firearm, or if it was stolen from him and used illegally. I don't know if this is somthing that's a serious deal, or if it's all open to interpritation by law enforcement. What do I do?

Yes. Perfectly legal to give your brother a handgun as a gift. The only legal way to do it is for you to take or ship the handgun to an FFL in your brother's state of residence and the FFL will transfer the hangun to your brother.

18 USC 922 (a)(3), (a)(5) and (b)(3) are the Federal laws that require you to take or ship the handgun to an FFL in your brother's state of residence for transfer to him.
