Legal Question: non-resident NV ccw going into ID question

Hello,
let me start by saying... sorry if I posted this in the wrong area.

Anyway, if you have one semi-auto firearm on your non-resident NV ccw and you go into the neighbor state of ID do you have to carry that specific firearm that is listed on you NV ccw or can you carry any firearm?

Seems like a odd question but if you are in a town in NV that is 10 miles from ID and you go there to shop... you can legally have your loaded firearm in the car in plain sight in NV. When you cross the border just conceal it.

Just trying to figure out if this is a legal thing to do. And if it is... is it a 100% legal thing to do or is it one of those 'grey-areas' of the law (I don't like to go into the grey...)?

Kind of disappointing that my first question on this web-site and the only answer is a joke. Not what I asked at all! I DO NOT believe in 'open carry' in the 'big city.' You are simply asking for trouble. This is why people concealed carry in the first place. The only time open carry is ok is when you are in the middle of nowhere... IMHO

Truly would appreciate it if someone could please provide me with a answer.

This is definitely not any kind of official answer--just my gut feeling.

Your permit from NV is recognized in ID (I'm assuming). It seems to me that states that recognize the NV permit, acknowledge whatever training or classes you participated in as adequate for their state.

Also--along with that, I think they have to rely on the judgement of whatever jurisdiction issued your license. And if that jurisdiction (in Nevada) lists the specific weapons for which the license is valid, then I have to believe that Idaho (or any other state that recognizes the NV permit) would accept that permit with whatever stipulations/limitations that NV intended...i.e. valid for specific weapon(s).

Again, this is only my guess. I would hesitate to rely on a phone call to Idaho because it sounds like such a judgement call and likely an infrequent occurrence, you'd probably get 2 (or more :wacko different answers depending on who you talked to.

Possibly the place to go would be Nevada -- I'm sure they've had this question before since it's their licensing stipulation.

thanks for the post! I was kind of thinking along your lines. All in all, when in doubt error on the side of safe... so I probably just stick with the gun on my permit. I will try to make some calls in the next week or so.... and I will post any info on it.

When you are carrying a firearm in another state, you are subject to that state's laws. In Idaho you would be subject to Idaho's firearms laws. Idaho does not restrict their licenses to any particular gun by serial number or any particular type of gun (revolver, semi-auto, etc.). They simply have one license covers all.

Idaho statute says this:

(12) The requirement to secure a license to carry a concealed weapon under this section shall not apply to the following persons:
(g) Any person who has a valid permit from a state or local law enforcement agency or court authorizing him to carry a concealed weapon. A permit issued in another state will only be considered valid if the permit is in the licensee's physical possession.

You have a valid permit to carry a concealed weapon. That's it. "a concealed weapon"

Since you have a permit to carry A concealed weapon issued by Nevada, you can conceal any weapon in Idaho that Idaho law allows you to conceal - any pistol or revolver. Paragraph (7) below does not apply to you, because you are licensed to carry A concealed weapon in by Nevada.

(7) Except in the person's place of abode or fixed place of business, or on property in which the person has any ownership or leasehold interest, a person shall not carry a concealed weapon without a license to carry a concealed weapon. For the purposes of this section, a concealed weapon means any dirk, dirk knife, bowie knife, dagger, pistol, revolver or any other deadly or dangerous weapon. The provisions of this section shall not apply to any lawfully possessed shotgun or rifle.

The Navy is going to promote NavyLT to O-4 some time this summer. At said point in time three things will happen,

1- He will get a pay raise
2- Which he agreed to use to buy more guns :biggrin:
3- His user name will be changed to refect his new rank.

This year, I was #8 in seniority that got selected for O-4. #6 just got authorized for promotion April 1. I hope #7 gets authorized for May 1 and myself on June 1.

1. I will get a raise!
2. I have to pay $3,250 per month alimony to an ex-wife for the next 3 years :angry: because I had a worthless lawyer . So, new firearms are a little ways off. First, maybe I will get to move in with my new wife that I will have been married to for 1 year in June, but haven't been able to afford to move in together because of the alimony... :cray:
