Why, what a broad definition of assault you have!

The legal definition of assault is 'an act that causes a victim to apprehend violence.' No physical contact, no assault. By your definition of assault, if a hair were to fall on the tray while the waiter was walking across the dining room with it, that would constitute assault because you could just assume the waiter put it there.

Your broad definition of assault leads me to question the role of broad interpretations while leaving (or not leaving) tips. What exactly is an "EARNED" tip? Is there just your definiton of it, or does everyone have their own definition? To me, bring the food while it's warm, don't swear around my kids, and leave the bill is all i require. My wife couldn't be driven to put even $1 down with a gun to her head. Surely you don't think we all see everything in the same light? This is why many places are adding the 15-20% to the bill.

You talk about your career in the past tense. If you haven't noticed, the hippie generation threw the honor code out the window and now we are stuck in a decaying society and each subsequent generation is worse than the last. You have to fight for what is yours. I don't blame you for your misinterpretation of today's realities. My father is just like you.

....C) if injury results the charge elevates to agravated
So -- You spit on a burger and serve it - an assault has occured -- if the person bites the burger before your spit is discovered - battery -- if the person becomes ill - agravated.

BOARD OF HEALTH -- To fail to consider the health codes existing in all 50 (57 for some of us) states, not to mention local codes, invites one to question the intelectual prowess of anyone guilty of such an offense let alone one who would brag about it on a public forum.
CRIMINAL CHARGES -- Differ from state to state and range from tampering with food to various degrees of assault.
FEDERAL ANTI TAMPERING ACT -- Provides for up to 20 years in prison.
CIVIL REMEDIES -- Monetary awards have been levied against restaurants and INDIVIDUAL SERVERS.

Your attempt to equate an errant hair finding its way onto a plate of food with a wad of spit that could only be intentionaly deposited there is a vacuous comparison at best.

I will not dispute your assertion of societal decay. I will, however, submit that your character deficit and challenged ethics are not attributable to societal decay. Rather, societal decay is a result of your attitude and actions. I know many people younger than I who possess qualities of honor, integrity and character that make their fathers proud. I feel sorry for those fathers who cannot claim that source of pride.
