LE Encounter Genessee Sheriff

Over a month ago I got entrapped in a Sting for Solicitation. The decoy girl asked me if I had any money. I told her that all I had was $5. Well for that amount I could touch her breasts. Stupid me trying to help her out, I got ambushed by LE (Genessee Sheriff). I gave notice that I had a CPL and had a gun locked in a box under the passengers seat. It cost me $900 to get my car back right there. They took my CPL and Ruger LCP and informed me that they would hold it until they looked to see what the State Statute would allow them to not return them to me. To date I have not been charged (may not get charged). My lawyer sent the Sheriff a letter requesting that they return my weapon and CPL two weeks ago. Have not heard back from them yet.

I legally can't carry my other weapon without my CPL. Nor can I purchase a replacement gun. I went to my county (Oakland) to see if I can get a replacement CPL and they informed me that the only way is to file a lost or stolen report with LE. They would replace it for $10.

So the question is - Do I file a stolen CPL, stating that Genessee Sherrif stole my CPL and refuse to return it? Any suggestions? My lawyer states that we shouldn't push too hard, which may force the Genessee County Prosecuter to file charges on the Solicitation. Honestly, that may the the best, so I can let them know how I got into this mess in the first place. Oh, by the way, my lawyer is on retainer. Charging me $750 to date and saying it may cost me up to $2,500. All with a guy that really had $5 in his pocket.
 
If it was me I would file a lost stolen complaint, bassed on the information I have she asked if you had change and not to touch her. I do not have a law degree and am just saying I how I would handle it if I was put in the situation
 
Do not file a lost or stolen report - your permit was not lost or stolen. it might have been improperly confiscated but it was not lost or stolen. Filing such a report will just dig a deeper hole.

The correct answer is to hire an attorney to seek return of your permit and weapon, but as your existing attorney said, such an action might have a negative consequence on the pending criminal case.


Next time you what to help out a lady offering such a thing say "I'll give you $5 if you'l you drop to your knees and ask forgiveness from Jesus right now."
 
There has to be more to this story that your not including, like why were you in the area in the first place? Most people from Flint, Michigan know where the Streetwalkers work, and that is where the Police set up sting operations such as the one you were caught in. I feel you may have brought your own dilema upon yourself. A very expensive leason, please learn from it.
 
I'd like to know what earth-shattering problem the cops were trying to solve by arresting a guy for copping a consentual feel on an under cover cop?!? What's next, arrest a guy for touching his wifes breasts in public?!?

It's called entrapment, in the case of soliciting sexual favors, the "John" always loses. Oh! and by the way! G50AE... Most Men don't fondle their spouses in public! :yu:

How would I go about replacing my CPL? The County says I need to file a lost or stolen report. Since I haven't been charged what can I do? This simple offer of $5 already cost me $900 for the car and $750 for the lawyer (more if he goes to court for me). I just want to legally carry.

I grew up in flint. interesting to hear that they are doing some kinds of stings. I couldn't wait to leave that place.

Unfortunately I think your only remedy is to bing an article 78 to recover your permit and weapon. You can't carry without it. you can't file lost or stolen. the law gives you a remedy, albeit an expensive one.
 
Ed Hamberger: I've seen The comment you used many times on Cop programs on TV. Every time my GPS sends me to an unknown location I think about that sorry a** comment from the Police. I've been lost many times in my car in strange city's. I always carry a compass in my pocket and have used it many times to find my way out of a city in the US and Overseas. Today there is a boat compass on the dash of my car along with a GPS. In the 70's I fished offshore and trusted my life to my knowledge and use of a compass, and today it can save you a lot of gas if your lost.
 
Still waiting..

Still haven't heard back from Genessee County Sheriff on the return of my CPL. My lawyer sent them a letter requesting it's return. He says, just to wait. Still wondering if I should contact Michigan State Police and see what they say on Genessee County Sheriff holding my CPL hostage. Anyone have some suggestions???

Amen. I lived in Davison while going to high school...the DAY I graduated I smoked a hot trail back to Arizona.

I still come to MI to visit the grandparents and the mom unit...but I am SO glad to be a desert rat born and true.
 
OK is there more to this story or are you just that young and naive?

Hooker walks up I roll up the windows as I see them approach, there are times I must travel through areas they may and do frequent, if they persist I tell them I have nothing for them and command them to leave, and get out of dodge ASAP.

BTY they are very bold and have approached the vehicle with the wife in the passenger seat.... No lot lizards allowed here....:triniti:
 
So if you touch your wife's breasts in the presence of an undercover whore/cop are you going to get a ticket?!?

One hand on the wheel, other at the ready on the HK (hookers have been known to pull knifes and rob people) sorry no hands left to get naughty with.....
 
Bad Situation

Having worked for a year at a small business right off of Dort Hwy in Flint, I can tell you that it was (at that time) an area with alot of prostitution. Ironically since the area is shared between two PD jurisdictions (both Flint and Burton) there was little that was done regarding any apprehension of the ladies that were involved in that particular business. Having said that, I did observe a lot of men that would solicit these women. These individuals obviously knew where to find them, and would pull up and park in vacant parking lots and wait to be approached. The women who engaged in the activity knew who worked (legitimately) in the area and steered clear from us. If this situation happened as you say it did, you must of not been familiar with the area, and really looked like you were there to pay for something illegal (I am not saying that was your intention) but you were definately in the wrong place at the wrong time. As far as SD keeping your CPL I don't think that you would be able to apply for another since you may have charges pending? How did this work out for you?

Nothing yet. My lawyer said to still wait and see if it will go away. I did stop in to see if they would give it back. I got a call saying there may be a warrent out for me. Wouldn't they send me something in the mail or contact my lawyer?
 
Since you have paid him have your lawyer call the prosecutor and see if he/she is going to charge you if not file a stolen cpl report. Theft is theft it does not matter if the thief has a badge.
