In her column, Katie Pavlich made the allegation that the ATF has already banned green tip ammo, that the public comment period was just for show. While she provided a link to the 2005 copy of the ATF regs, she failed to provide one for the most current copy of the regs.

So I dug it up.

Here are screen captures from the appropriate pages; the first one if from the previous 2005 copy of the regs, the second one is from the 2014 - FINALIZED/PUBLISHED - copy of the regs:

As you can see, the exemption for the green tip ammo is gone.

As Katie said, the public comment period was just for show. The ATF had already submitted their updated regs to the OMB for approval and as of January, 2015, already had them published - minus the green tip ammo exemption.

Following are the links to the 2005 and 2014 copies of the regs:

http://www.atf.gov/files/publications/download/p/atf-p-5300-4.pdf (2005, page 166)
http://www.atf.gov/sites/default/fi..._regulations_reference_guide_2014-edition.pdf (2014, page 190)

It would appear that she may be right….

Much of the ammo in M855 that came in from Europe never had a green tip. So if BATFE went by that, they're off on their description. :) And their listing for 2014 is in error as they said in the notice that the M2AP in .30-06 is still exempt.

Also, we have not received a copy of the 2014 rules as of yet at the shop.

Sounds like typical government. Make a decision then jump through the hoops to make things appear legal. The public doesn't know the difference.

BREAKING: ATF issues notice of publishing error….

Now that the omission of the exemption has become public, the ATF has released the following:

Notice of Publishing Error

On Feb. 13, 2015, ATF released for public comment a proposed framework, including legal and technical analysis, to guide its determination on what ammunition is "primarily intended for sporting purposes" for purposes of granting exemptions to the Gun Control Act’s prohibition on Armor Piecing

Ammunition. This proposed framework is posted for public comment only; no final decisions have been made as to its adoption.

Media reports have noted that the 2014 ATF Regulation Guide published online does not contain a listing of the exemptions for Armor Piercing Ammunition, and concluding that the absence of this listing indicates these exemptions have been rescinded.

Please be advised that ATF has not rescinded any Armor Piercing Ammunition exemption, and the fact they are not listed in the 2014 online edition of the regulations, was an error, which has no legal impact on the validity of the exemptions. The existing exemptions for armor piercing ammunition, which apply to 5.56 mm (.223) SS 109 and M855 projectiles (identified by a green coating on the projectile tip), and the U.S .30-06 M2AP projectile (identified by a black coating on the projectile tip), remain in effect.

The listing of Armor Piercing Ammunition exemptions can be found in the 2005 ATF Regulation Guide on page 166, which is posted here.

The 2014 Regulation Guide will be corrected in PDF format to include the listing of Armor Piercing Ammunition exemptions and posted shortly. The e-book/iBook version of the Regulation Guide will be corrected in the near future. ATF apologizes for any confusion caused by this publishing error.

Oh, they got caught, so they do a tap dance to cover it.

Yeah, just an oversight, just a publishing error.

Yeah, right.

238 reps in the US House - more than half - have signed on to a letter to the ATF opposing the ban on M855/ SS 109 ammo. No such letter has been issued by the senate, yet.

My question is why can't the ammo manufacturers just make the same caliber ammo with a different material. Why not go from lead to copper or ceramic.

just five minutes ago she laid into a liberal head shaker on Fox who used the words "automatic rifle" and "bullet." Katie whipped her ass.
