It’s official: Obama traded five terrorists for a deserter

What would you expect? He trades 5 known terrorists for a soldier that deserted but did nothing to get a soldier that served honorably back from Mexico.

On Jan 27 the Army denied a decision had been made.

“(Reuters) - The U.S. Army on Tuesday denied that a decision had been made to bring desertion charges against Sergeant Bowe Bergdahl, who was released last year in a controversial prisoner swap after disappearing from his base in Afghanistan in 2009.

NBC News said earlier on Tuesday that Bergdahl would be charged with desertion, citing senior defense officials.”

Your right I wonder who got to Maj. Gen. Ronald F. Lewis so quickly for him to run out to say "No decision's been made", all the news reports including one by NBC News is "patently false."?

In this position he is responsible for all communication issues involving the United States Army including the professional development of military and civilian Public Affairs personnel.

At one time I believed the Army was our last surviving hope as a Government run agency, but now after all of Obama’s manipulation, “I Wonder”.

I'm particularly impressed that there seems to be a lack of understanding on the criteria for proving desertion. It's much easier to prove AWOL or missing movement. Desertion requires the demonstration of the intent to never return to proper jurisdiction. If the JAG moves too quickly and cannot prove their case, it leaves them with a lot egg on their face.

WRONG. But you are correct that you don't understand the criteria for proving desertion.

Article 85 of UCMJ:
Uniform Code of Military Justice (UJMJ) - ART. 85. DESERTION

(a) Any member of the armed forces who--

(1) without authority goes or remains absent from his unit, organization, or place of duty with intent to remain away therefrom permanently;

(2) quits his unit, organization, or place of duty with intent to avoid hazardous duty or to shirk important service; or

(3) without being regularly separated from one of the armed forces enlists or accepts an appointment in the same or another on of the armed forces without fully disclosing the fact that he has not been regularly separated, or enters any foreign armed service except when authorized by the United States;

is guilty of desertion.

(1), (2), or (3) must be proven above, and (2) has no length of time associated with it.

Elements.

(2) Desertion with intent to avoid hazardous duty or to shirk important service.

(a) That the accused quit his or her unit, organization, or other place of duty;

(b) That the accused did so with the intent to avoid a certain duty or shirk a certain service;

(c) That the duty to be performed was hazardous or the service important;

(d) That the accused knew that he or she would be required for such duty or service; and

(e) That the accused remained absent until the date alleged.
 
Intent to avoid hazardous duty, is easy to prove if he walked away to a civilian area he could blend in with. Iraq and Afghanistan does not house such a civilian area. He still presents a problem to JAG when it comes proving intent. This is not charge that any lawyer wants to bungle. They are going to build a case a strong as possible. That takes time. If they can't, they will nail him for any of several other possible charges.
 
They can put him away for a long time for being AWOL, plus a DD. A slam dunk case of desertion,
he would surely have to stand up & totally incriminate himself & offer no defense. Not going to
happen.
In my day AWOL for that length of time would get you 5 years at hard labor in Leavenworth, forfeiture
of all rank & pay, plus a Dishonorable Discharge.
