When stupidity takes someone's life, should they be held accountable? I think they should be.

BOISE -- Gregory Shain, charged with involuntary manslaughter for shooting and killing Gary Arlen Jr. back in March, was back in court Thursday.
It was a preliminary hearing to determine if a crime was committed, and if Shain should be bound over for trial.
All sides agree on March 19th, 22-year-old Gregory Shain was hanging out with 23-year-old Gary Arlen Junior in his basement looking at Arlen's guns.
Detectives say there was drinking, and according to the Coroner's report, Arlen had been using drugs.
The prosecution says that Shain recklessly put a loaded gun in Arlen's mouth, and pulled the trigger.
"He knew the weapon was reloaded at some time by the decedent," said Ada County Deputy Prosecuting Attorney Whitney Faulkner. "The fact that he pointed that gun in the decedent's direction, the fact that he pointed that gun in the decedent's face, the fact that he fired that weapon into the decedent's mouth is incredibly reckless."
The defense claims the two would regularly dry-fire the guns at each other (pull the trigger without ammo) and had done it that night.
Shain's attorney says Shain didn't know a handgun was reloaded by Arlen, when he pointed it at Arlen. He claims Arlen put his mouth around the barrel, and told Shain to, "Do it."
"Mr. Arlen loaded the weapon that Mr. Shain himself had unloaded and made safe, and deliberately chose not to tell Mr. Shain that he had loaded the weapon," said Mark Manweiler.
Judge Roy Holloway agreed with the prosecution, that there was enough evidence to bind Shain over for trial.
After that, the defense made a motion to remove Shain's GPS monitor for economic reasons. Then, Gary Arlen Junior's mother talked about why she thinks that monitor should stay, and the moment when Shain came out of the basement to tell her, her son had been shot.
"I said, 'Greg, you killed my baby, I knew it,'" said Barb Arlen. "I'm afraid that he's going to come do to me, what he did to my son."
The judge ordered that GPS monitor to stay, and also issued a no-contact order to Shain for Arlen's sister. He already had a no-contact order in place for Arlen's parents.
Shain did not have any comment at this time.
His next court appearance is scheduled for June 29th, where he will enter a plea of guilty or not guilty.
Shain's charge of involuntary manslaughter has a weapon enhancement with it. If found guilty, he faces up to 25 years in prison.
 
wow stupidity is right .......more than stupidity!
who the hell in their right mind would put a gun in their friends mouth loaded or not and pull the trigger??????????and who in their right mind would allow someone to do that in the first place
if folks are going to drink or use drugs they should at least put all firearms far away from their reach what a stupid 'game' or perhaps the deceased had a death wish?? who knows but dang just dang and yes he should definitely be held accountable imo.....if you're going to drink or drug do it responsibly ..if you're going to handle a firearm do that responsibly as well evidently they failed on both counts
 
Judging solely by what little info is here it would seem that one fool has been removed from the gene pool. The survivor will probably go to jail. I am unsure that this is necessary. People do stupid stuff. Some people pay the ultimate price. Football players get injured or killed every year. This is predictable yet we do not jail the opposing team or the coach. Sky divers and bungee jumpers die because of poor equipment or execution and we let that settle in the civil courts. I was never dumb enough to point a gun at another person but I was lucky to live through other mistakes.

While I regret the loss of a seemingly innocent life and pain of his family, I ask myself, where were his parents when this kid was learning about guns. I pointed toy guns at my friends. My parents taught me the difference between toy and real guns by the age of five. As is so often the case, there seems to be enough blame to go around. When this mother tries to direct all the blame onto her sons best friend I feel less for her than I might. Why did she allow this to occur repeatedly in her basement? Yes, he was an adult but "my house, my rules" was an oft heard phrase when I was younger.

While I care little what happens to this young man, I believe that as a society that we might be a little less in a rush to blame the survivor. In this case a young man dies while playing dangerous games with his own gun. Is he not more to blame?

If a carload of teens gets drunk and gets in an accident killing someone we prosecute the driver. Isn't everyone in the car equally responsible? If one bank robber kills a teller all the robbers are charged with murder. It seems that we have a somewhat inconsistent legal system.

This is a very interesting and complex case, thank you for the post.
 
How is this any different than an azz-hat getting liquored up and getting behind the wheel of car? Chances are he drives and doesn't kill anyone, but what if he does? Bam, involuntary manslaughter. He didn't have the intent to kill anyone, but because of his stupid actions, he took a life.

In my opinion, if Shain did exactly what this report says he did, he should be convicted to the full extent of the law.

A firearms instructor made this analogy to us one time: Sitting on top of every bullet is a little lawyer waiting for you to screw up. Don't screw up.
 
The guy that pulled the trigger deserves to go to jail, but a 25 year sentence won't make him any less stupid. Unfortunately, you can't cure that particular human condition.
 
I'm amazed time and again when I read stuff like this. I just can't fathom how someone could be so reckless.
