This brings us back to the point of WHY DO PEOPLE LIVE THERE? It's like NYC. People live there, it is VERY expensive compared to everywhere, and people live there happily living under the fascist regime. In Ohio, the State is unfriendly to everything that any gun owner would love dear. The best part is, that they have CCW permits and pretend to be gun friendly... except its all a shell game of sorts. I hope that since he is homeless he can now feel free to move about the nation, maybe to someplace that is free.
That a cheap and easy shot to take and it seems to be a standard comment around here. Kansas is not a utopia, nor is it nirvana. I'm sure I can find several reasons not to live in Kansas as well as any state in the Union.
We are working to change the laws in Iowa. I write to my Senator and Representative weekly. I will make sure they are aware of what can happen to a person due to current law and I will continue to ask their support to change the laws.
There are lessons to be learned from his situation. Number 1 is know the law of the state you are carrying a weapon in. If he was aware of the law, he would have known he had a DUTY to retreat. Number 2, he could have NOT raced the other moron down the street and then turned into him, thus causing the accident. That was just plain stupid. The guy used to be a cop according to the story. There is no excuse, he should have known better! I would speculate that he has arrested people for the exact same thing! Number 3, he could see there were five people in the other vehicle versus just him. Why would one person with any common sense want to get into an aggressive situation with 5 other potential attackers unless that person knew they had a gun in their pocket and perhaps had an attitude of I'm a bada$$? I don't know the answer, but I know doing it seems stupid to me. If for no other reason than there was a potential for one gun to be up against five guns. Number 4, don't be an aggressor when you have a permit and a weapon. At any point he could have pulled over, turned onto another street, or called the cops sooner. He should have also stayed in his locked car until police arrived. Yet he made the tactical error of exposing himself by getting out. Not very bright for an ex cop.
I'm not going to say much about the fact that he moved his residence to Iowa in 2010 yet the report indicates he was still using a Kansas permit to carry 2 years later because I'm not going to put any effort into researching the law, but it seems to me he should have had an Iowa resident permit. Another item that seems stupid for a ex cop. I also wonder why he didn't reach out to his family in Kansas to help him with bail or at least travel to his apartment and get his stuff as soon as he figured out he was going to be sitting in jail until his trial. Are there no telephones in Kansas? Another dumb way to handle his situation.
I think he got lucky that he had a lawyer with the skill to seat a jury that considered the facts at the time of the shooting only, not everything both parties did that got them to that point.
Do I feel sorry for the guy? A little. Only because I do not like the way current Iowa laws are written. Do I think this guy has no responsibility at all for the situation he found himself in? Hell no! He made to many stupid mistakes and did little to help himself after he did. I also think that his throwing the race card out in the report is an insult to actual victims of racism. He should have thrown the "stupid" card as that is what got him in the legal mess he went through.
