Illinois Ban on Concealed Carry is coming to an end!

I attended the June 8th, Hearing in Chicago, Shepard/Moore v Madigan. The 7th District Federal Appeals Court heard oral arguments from both sides. The 3 Judges on the Panel were really hard on the State of Illinois Attorney. There were actually two points in the Hearing where we laughed, with the Judges, as the events unfolded. You can hear this audio at illinoiscarry.com or on the website for the Court. I left the Courthouse with my 14 year old Son, feeling like things are finally going to change.
 
I hope that you are correct in your feelings! It will be great to be able to carry in the state, and not just when in St Louis.
 
I would be nice but don't hold your breath. The Supreme Court has a long history of allowing states to make their own determinations on how/where/if firearms can be carried outside of private property.
 
Hope you are right and it does happen. It would be a great step forward towards the restoration of rights.
 
It would be great If the citizens of Illinois could defend themselves. I hope You get your second amendments rights back, And don't ever allow anyone to take them away again.
 
Thats the way i feel too after listening to the hearing. I think its pretty clear that IL really dosent have a leg to stand on anymore with some of the lame points the state was trying to make. How does one defend themselfs when they live in a apartment and can only carry inside the appartment and not in the hallway, elevator or parking garage. Its pretty hard to argue with the results that all the other states have had and no blood isnt running in the streets. JMO
 
I can only hope to see IL get their carry ban lifted, and soon. Even a favorable decision by the Court does not mean "instant carry".

1. The state can/may/will appeal the decision.
2. The state legislature can REALLY drag their feet on passing implementing law, perhaps across multiple legislative sessions.
3. The Governor may exercise power of Veto.
4. Issueing Agency can (likely will) have initial problems getting their system for permit issue up and running.

No time like the present to "git 'er done"!
 
The Heller Case has cleared the way for this Case to be a Slam Dunk. The way to really make it happen would be to allow Chicago to License separably from the rest of Illinois. In Illinois, Chicago can License Plumbers with a Chicago Plumbing License due to the fact that they are a Municipality with a population over 500K. If we said that Chicago could have stricter Laws than the rest of the State, it would happen really fast. The Laws would have to still be within Constitutionality. Tough Town, may need more controls to control some people from ruining it for all of us!
 
B2Tall, Having had the opportunity to witness the Hearing in person, I was informed of a hidden message in the Heller Decision, that escapes those of us unfamiliar to Legal Verbiage. It turns out that in the Decision of the Heller Case, there is mention of being able to prohibit the carrying of a weapon onto School Grounds or a Government Building. The Judges of the Shepard/Moore Case mentioned this several times in the hearing. They said to the States Attorney "can you still say that, after Heller? " The States Attorney was in the position of saying that the Second Amendment does not protect the Right to carry a Handgun outside of a Home. So my conclusion is that Heller cleared they way for this case to be a Slam Dunk.

I'm glad you feel that way. No offense but your "conclusion" doesn't mean anything. Nor does mine. I'm just going by decades of history and precedent by SCOTUS.

Ask yourself this: If D.C. vs Heller is such a "slam dunk", why is concealed carry still not allowed in D.C. 4 years after the case??
 
While I how concealed carry comes to Illinois soon, even if they pass it they could go the route of may issue. If this is the case most would still not be able to get a license. This would allow Illinois to be a concealed carry state meeting a court decision while effectively not changing at all. I hope this is not the case but entirely possible.
 
B2Tall, C'Mon, I never said Heller was a Slam Dunk... The Reason it was not is because D.C. is not a State, but rather a Government District, hence the name District of Columbia, So it is the equivalent of a Military Base, also not protected by the Constitution. I realize you are "The stirrer of the Pot" , but we need to work towards unity for the cause. Judge Posner was great in his metaphorical example of the Pioneers of 1887 and their need to Bear Arms, outside of their Homes and pretty much anywhere they went. Illinois is a good State with a bad State Government, controlled by Chicago. These Judges are Federal Appeals Court Justices. That means they have a shot at being Appointed to the U.S. Supreme Court. They could care less about Chicago Politics, these are Big Game Players and they will make a name for themselves with this Landmark Case. Judge Posner is guy who imagined himself as a Pioneer in Ohio, 1887... with a gun strapped to his horse. Judge Williams said that it is when a stalker victim is away from her house, that she is most vulnerable, because the attacker would know she at best, has an unloaded gun, the third Judge was just disgusted with the Attorney from the State of Illinois. We will get a great Decision, from this Court of the people,by the people and for the people.

Just move to Wisconsin. We've got concealed carry (finally) and our Governor can beat up your Governor!

You've said it twice.

Other than wishful thinking, what makes you believe SCOTUS is going to do something for Chicago and/or Illinois that they've never done in any other city or state - i.e. overrule a state or local government and force them to accept CC/OC?? And believe me - the city/state isn't going to let this stop at a district court....they'll fight it all the way to the top. SCOTUS has ruled in favor of firearm ownership as well as keeping firearms on private property but they've always allowed local and state governments autonomy when it comes to carrying guns in public, hence all the varied laws from state to state. SCOTUS will be the final word and their history has long been to back the individual state on CC/OC, like it or not.

How do you explain those - all the differing carry laws from state to state??

The only way the city of Chicago or the state of Illinois will get CC or OC is if those citizens choose to elect a pro-gun governor and legislature.
 
Hey Dan, that is a fair point. Funny too as I am a plumber in Chicago and I also just when through the handgun ownership course to be able to have a handgun in my home. Funny thing though is that I mostly feel like it would be better served carrying it with me. It takes 4k hours and testing to become a plumber in Chicago and it takes 4 hours and a verbal test, along with backround checks to own a handgun. If the city put more of a substantial training on those who wanted to carry we would have no issue with it what so ever. The rest is not directed at you Dan but more of a general statement about some comments on this site and the U.S in general. I think people have gone too far with the divide that has been outwardly and self imposed. I personally don't follow the left or right or think everybody south of Chicago is a "redneck", but the way politics these days are going is almost forces a divide. It's obvious when you see the voting map during an election. They almost want that divide like it's a football game against the next county over and the coach is bad mouthing the other team in the locker room. I am proud to be from this country but I think a real patriot still questions the big shots that run the show, and doesn't just vote for the guy who isn't black. I didn't vote because I don't believe in what either side is offering. Fact of the matter is that they ALL are corrupt to one degree or another. It's practically become the American way of doing business, which is what our Gov't is at this point.... My apologies for the rant on your post, I'm sure I'll hear about it.
 
sonofcops, I hear you, there is an obvious divide between Cook County and the rest of the State. That's because Cook County has pushed its views down the throats of the rest of the State for many, many years. I believe in our System, while it is not perfect, it is the best I have ever heard of. I walked out of the 7th District Federal Appeals Courthouse and was very proud to be an American. A place where, if the State of Illinois is Violating your Constitutional Rights, you can force them to appear in Court to answer to a Panel of Judges. I brought my 14 year old Son, James to witness the event. You and B2Tall can believe what you want and not participate in the issue, and not Vote. But for me and my Family, we will not dishonor those who gave all, so I could live in the Land of the Free. I will be a part of the fight, I will cast my ballot and I will set an example for my children to be an active participant, not just somebody who watches and waits for somebody else to do something. I will have faith in my fellow Citizens that are presiding as Judges and I will have faith in our Laws, it is what makes us Americans.
