KPRC reports the homeowner is actually living in the U.S. illegally and actually owns a gun — both of which are against the laws of the United States of America. Police have not released any names. The illegal alien and his roommate were both brought in for questioning about the deadly incident. The ongoing investigation will now be handed over to Immigration and Customs Enforcement (ICE). The District Attorney’s Office will consider whether or not charges will be filed in this case.

Oh here we go with the stolen land crap.....According to the Treaty of Guadalupe Hidalgo, we acquired California along with , Nevada , Utah , and Arizona, as well as the whole of, depending upon interpretation, the entire state of Texas that then included part of Kansas , Colorado , Wyoming , Oklahoma , and New Mexico ..... Bought and paid for ......15 million dollars (equivalent to $400 million today), in annual installments of 3 million dollars.

In SC, the law uses the words "forcible entry" and "occupied car" when discussing the ability to shoot someone presuming, as a reasonable person, that your life is in danger. Based on these words just breaking into a car is a simple property issue and, as you say, not a "personal life in danger" situation. In SC, we also have a law on the books that has met case law which basically says that AT NIGHT if you see someone in an act that you presume is a felony (like breaking into your empty car on the street or in your driveway), you can effect a citizen's arrest and if the BG tries to evade your arrest, you can prevent his evasion BY ANY MEANS INCLUDING DEATH. You come to SC to rob cars we can shoot you in the back--period/end of story. Make sure you have life insurance made out to your momma who will tell the newspapers what a "good boy" you were.

The man has already proven himself to have no respect for our laws. Why he or anyone who does the same would expect further "laws of the land" to protect him as he goes about his "daily" business of living is beyond me. Logic fail.

Funny how we quickly cite treaties we like...and after all, a government executing a treaty would never have an ulterior motive and screw the people (e.g., line their own pockets and make their citizens illegals on their own lands).

Yes but as per current laws, he is a felon in possession and should be treated as such. I'm not saying I am not glad he shot a criminal, just saying that he has been found in violation of multiple laws and should face consequences just like everyone else. Why some seem to think that being an illegal alien makes it ok to excuse any other laws they break is beyond me.

Can you just shoot or, like in SC, it is part of an old law still on the books that requires citizen's arrest. If I know Texas, I would make a strong guess that you can just shoot. Personally, I can only wish that if you "mess with my junk" I can kill you and it is not just an imminent danger to person thing.

Yep the Mexicans have absolute right to be in Texas and anywhere else, they have been here longer than me, shall we ask the Inca, Mayan and Meso Americans if the Spanish had a right to take their land, they were there before Spain. Based on your on point above the Mexicans/Spanish should be forced to leave Mexico.

I am not reciting the treaty because "I LIKE IT" necessarily, more for the fact that to say we stole the land is inaccurate. It seems that the "WE STOLE THIS LAND" argument is the default when it comes to illegal alien issues. It simply is not the case. Actually Articles VIII and IX of the treaty ensured safety of existing property rights of Mexican citizens living in the transferred territories at that time. Since then modifications to the treaty made them illegal aliens.....They also were given the choice to become American citizens when this all took place. As for the Govt. having ulterior motives.......When doesn't the Govt. have ulterior motives?

I believe illegal aliens have the right to own firearms while in this country, but we should not allow them to enter and deport them immediately when we find them.

A well regulated militia being necessary to the security of a free state, the right of the people to keep and bear arms shall not be infringed.

Since other amendments protect non citizens in this country. I don't see anything in the 2nd amendment that would prevent illegal aliens from owning guns. The same with felons. If there crime is bad enough, they get life in prison or execution. Otherwise when they get out of prison, they should be able to own firearms as well. Especially in a age where more an more crimes are being made felonies instead of misdemeanors. The police used to had you your gun back when you got out of prison in this country.

You also used to have the ability to defend life, liberty, and property with lethal force. Now, we are lucky if we are allowed to defend life.

P.S. I am not in favor of giving murderers back their guns. I am in favor of them swinging from trees.
