reason for not accepting my request. (Upstate NY Saratoga county). What should I write to him so he may reconsider my request. someone told me I should report him to the NRA. I think its bullshit its my 2nd amend. right. Any help on this will be much appreciated.

Ask for the reason. If you appealed via an article 78 the Appellate Division would slap him upside the head for not giving reasons they can review.

Did you apply for full CC or for restricted?

Presently the 2nd amendment does not apply to New York State. Even after McDonald is decided it probably still will only apply to home defense, at least until some other case establishes otherwise.

So don't be confrontational - you truly are begging for the permit at this point.

But he has to give a reason and it can't be arbitrary or capricious.

As noted, NY is not a "shall issue" state, so no justication is required for denial.

I would, however, write a business-like letter inquiring if there was some specifics regarding the denial.

I was asking for full. I did not know about the 2nd amendment and ny. These are the reasons I claimed for wanting my CWP.

-Carrying a concealed gun means that you are committed to being an active participant in society. It means this because you have to know the law, be involved in the law, and take steps to fulfill the law.

-growing need to protect oneself and family.

-By regularly carrying concealed, and handling firearms, your knowledge about firearms will increase

I think your first statement probably nixed your chances - it leaves the impression you want a cc so you can involve yourself in law enforcement.

I suggest you write the judge and ask for a permit for hone defense, target practice, and hunting. Then after a few years, make another application for a cc permit on the self-defense basis alone. Leave out the other extraneous stuff.

also, join a conservation club or shooting club and get involved in their activities so you can build a record of experience with handling your weapons.

Saratoga County only issues permits for target/hunting. Full carry licenses are few and far between there. I would write the judge asking for a reason for the denial. Did you take the required training course? I would also ask for a target/hunting permit. Contacting the NRA won't help. The reason is NYS is a may issue state. You can be denied a permit for any reason.

He did waive my pistol course because of my military experience. Thank you guys for your insight on the matter.

I agree with nogods. While reading your first statement I thought "he (the judge) probably didn't like this."

I frequently have to carry $10,000 or more cash with me, and therefore feel I need a means to protect myself. Good luck with it. We are a "shall issue " state, and I think that's the way it should be everywhere. Good idea would be to move to another state.
