I want to transfer my son's 21st Birthday Present to him in Virginia. Beach Va. what are the regulations to complete the transfer? He is 21 on the 19thb of April. He is currently stationed at little creek. Navy yard, but lives off base. Thanks for any help.
 

why is an FFL necessary? My son lives in TX, if I want to xfer the gun to him why can't he fly to FLA and take possession of it?

Because it violates Federal law:

(a) It shall be unlawful—

(3) for any person, other than a licensed importer, licensed manufacturer, licensed dealer, or licensed collector to transport into or receive in the State where he resides (or if the person is a corporation or other business entity, the State where it maintains a place of business) any firearm purchased or otherwise obtained by such person outside that State,

(5) for any person (other than a licensed importer, licensed manufacturer, licensed dealer, or licensed collector) to transfer, sell, trade, give, transport, or deliver any firearm to any person (other than a licensed importer, licensed manufacturer, licensed dealer, or licensed collector) who the transferor knows or has reasonable cause to believe does not reside in (or if the person is a corporation or other business entity, does not maintain a place of business in) the State in which the transferor resides;

You violate 18 USC 922 (a)(5) when you transfer the gun to your son who is not a resident of the same state you are, and your son violates 18 USC 922 (a)(3) when he returns to his home state with the gun that you illegally transferred to him.
 
Ship the gun through an FFL. You'll need the receipt to remove the gun from your permit after he has it. There's really no other way to do this.

here in free america unlike the socialist/fascist NE states guns are not registered and are not connected to the permission to carry concealed slip.

You might want to pick a horse to ride that is not quite so high. In your "free America", you violate Federal law and risk going to jail if you don't obtain the government's permission first before transferring a gun to your own son just because he lives across a state line.
 
Can I directly ship it to an FFL in Virginia myself, or do I have to use an FFL Dealer in Buffalo area?

I think what he was talking about is that If I drove from my non-fascist home state and presented a gun to a relative in another state, the Federal government wouldn't be any the wiser and would have no recourse; because I don't need a license to purchase a firearm, and once purchased it is not associated with any license or permit. Because the OP is in NY and has the gun in question REGISTERED to him this can't happen. This is the beginning of the argument as to why gun registration is bad, and doesn't even venture near the confiscation part of the argument. Interstate commerce should not apply to the individual presenting a gift to a relative. I am pretty sure the original intent of the law was to ensure the feds got their piece of the taxes on the transfer, or to prevent you from introducing a scary weapon into CA or CT.
 
I know of no other way to get it off your NYS pistol license. FFL to FFL is the only way to comply with both NYS and US law.

to xfer to someone else you seem to be correct, however when I left NY for good I just took my weapons with me to NJ, no big deal

One you for sure got right is weather right, wrong, or no difference, around here its always the beginning of a argument
