How do I carry gun in truck if state doesn't recognize ur permit

States where a permit from a home state is not recognized.

I live in Texas and my permit is recognized in most states I might drive in. But my home town is in West Virginia which doesn't recognize it. I google but can't find the reason it's not recognized. In general, since a specific state is not easy for anyone here, unless they are from WV, what are the general thoughts on having my hand gun in my vehicle.

Disassemble it or not if it's something like a Western Marshall?

Put it in the trunk, what about a vehicle without a trunk like a Corvette?

Do you think it's required to tell the officer the gun is in the car if stopped for speeding or some other traffic stop?

Finally, does anyone know where to search to find the actual laws or regulations which tell you what is required to have a hand gun in the vehicle?

Maybe u should du sum reserch and c if the state ur going 2 allowz u to carry ur gun in a the truk w/out a permit.

If not u should get on the webz and ask a bunch of people u don't know and who won't be there when the Po-Po R slappin the cuffz on u what they think you should do.

Or you could google FOPA

Notification requirement depends entirely upon state law, although mostly, notification is only required if you are carrying on your person.

18 USC 926A:

§ 926A. Interstate transportation of firearms

Notwithstanding any other provision of any law or any rule or regulation of a State or any political subdivision thereof, any person who is not otherwise prohibited by this chapter from transporting, shipping, or receiving a firearm shall be entitled to transport a firearm for any lawful purpose from any place where he may lawfully possess and carry such firearm to any other place where he may lawfully possess and carry such firearm if, during such transportation the firearm is unloaded, and neither the firearm nor any ammunition being transported is readily accessible or is directly accessible from the passenger compartment of such transporting vehicle: Provided, That in the case of a vehicle without a compartment separate from the driver’s compartment the firearm or ammunition shall be contained in a locked container other than the glove compartment or console.

Thanks Navy.

I actually called the WV State Police and asked them what was required since I was going to visit family. The only thing I got from him was a bunch of "Why are you bringing a gun here"? I never did get an answer.

Never ask LEO for advice on the law. They don't know. Try this board or handgunlaw.us to start. Then, look up the statutes yourself.

Any given percentage of the LEO's that do know will not want to give you a straight answer due to the "I am a cop and you are not" elitist mentality some suffer.

Call the state's Department of Safety. On our trip to Yuma we passed through Texas and New Mexico. I called both states and they have the same rules, you are allowed to have the pistol in the car, loaded, as long as it is concealed.

Ammo separate is NOT a requirement of FOPA. The guns and ammo must be separated from the occupants of the vehicle, not from each other.

No it's not. But common sence when travelling thru anti states. As some of them DO have that rule.

Thanks. I was asking for common sense advice like you give and what Navy gave. I appreciate it.

If you are going to abide by the conditions of state law, then why bother with FOPA at all? Depending on how you separate the ammo from the gun, you might violate the conditions of FOPA by doing so. For example... unloaded gun in the trunk and ammo in an ammo can in the backseat of the car - now you have violated FOPA and thus no longer fall under it's protection. Just abide by what FOPA requires, unload the gun, lock the gun and ammo up in the trunk, or in a locked case if the vehicle doesn't have a trunk and be done with it.

"No, officer, I will not unlock the case/trunk for you." Practice it in front of the mirror if you have to.

I like the mirror part. :)

Thanks

Each state has different laws. A great app that I use is Legal Heat along with this forum however they are just tools and in order to be 100% sure, it's best to read up on the state laws which are posted on the internet or call.

The legal heat app also has links to each states laws.

Never, ever volunteer to a cop that you have a gun, and hope he doesn't ask you unless you are legal where you are pulled over. That being said, I've had a gun in my car in every state I've ever been in, most all legal, but not all of them. Where not legal to have in car, I've concealed on my body and driven VERY CAREFULLY till out of the state. I have not been pulled over for over 15 years, primarily because I always try to drive within the limits of the law. Even the few times I have been stopped, over 15 years ago, I have never been asked to exit the car. I don't fit any of the profiles that the cops would use to be suspicious of me, so I feel relatively safe traveling through these gun-unfriendly states. I try to get out of that state as quickly as I can. My daughter lives in one of those gun-unfriendly states and I'll be visiting her later this summer for about a month, and I'll definitely either be carrying or very close to my gun. This may create a stink, but that's just the way it is.

West Virginia has full reciprocity with Texas, according to the West Virginia page under the Concealed Carry Permit info link, above. So you should be able to carry your weapon there if you're licensed to carry in Texas.

Go to the bottom of the USA Carry forum and you will see all the states regulations, also as mentioned by someone else HANDGUNLAW.US is another great source.
