HOUSTON -- A woman was accidentally shot at a Kingwood restaurant on Thursday.

Houston police said a man was dining at Raffa's restaurant in the 1600 block of West Lake Houston Parkway at about 9 p.m.

Investigators said a gun fell out of his coat pocket. When the gun hit the ground, it fired and a bullet wounded a 78-year-old woman in the buttocks.

The woman was taken to Ben Taub Hospital and is expected to recover.

Police said the man has a concealed handgun license, but the restaurant has signs that prohibit guns inside.
 
First, it sounds like it must have been unholsted and in a jacket pocket. Bad idea not to have it secured at all time. You have to think about what will happen to my gun if I take this jacket off. He will most likely loose his permit.
 
He should loose his permit. It is completely irresponsible to have a gun upholstered. Those of you that conceal carry and don't use a holster should take note.
 
I had not seen where the restaurant had a no gun policy. Bet it wasn't a 30.06 sign. I've seen very few in Houston.
 
He made several mistakes as noted above. The news report said the man has not been charged but most likely he will be hit with some form of a reckless endangerment charge. He should lose his permit to carry for failing to secure his weapon which resulted in a negligent discharge. He is very lucky the victim was not seriously injured.
 
I won't go that far and say you should always holster you gun. But I will say that if you are going to carry a gun without a holster to keep it secure it better be a gun that can be dropped without firing a round. Most guns today are made so you can drop it from 3 feet and it will not fire a round.My Glock is said to be able to fall without it firing a round but I am to attached to it to do a drop test on it and damage its good looks for it is not that good looking to began with. :sarcastic:
 
only one thing he did wrong based on the information was not using a holster. carrying a gun without some form of solid holster or trigger guard is irresponsible as far as im concerned.

since the report says he was not charged with anything, i am assuming it was not a 30.06 sign in which case he would have been arrested on scene. he did nothing wrong if it was a "no guns allowed" sign.

most modern guns are equipped with drop safeties and firing pin blocks. a suggestion made on another forum was he could have tried to grab the gun as it fell and he hit the trigger (IF YOU DROP A GUN, LET IT HIT THE FLOOR). i know the ruger SR series was recalled before they fit it with the safe action trigger becuase they were discharging when dropped. so this could have been a dated firearm without safeties (i wouldnt carry such a weapon personally, but that doesnt make it a crime), a defective weapon design (manufacturer could be held liable), or he tried to catch it as it fell. impossible to say from the information provided
