How long before she can buy a gun?

I have a friend from San Francisco that was considering to switch places with me. She is a legal resident with a AZ permit and a CA ID. She does not want to buy a gun in CA due to the 10 round magazine limitations. If she comes to AZ, is she allowed to buy a gun since she has a AZ permit, or does she have to wait a certain amount of time?

It isn't a question of having a permit or not, it's a question of where she resides.

To buy a handgun and walk out the door with it in ANY state, you must be a resident. You can buy a gun from a dealer in a state that you are not a resident of BUT you MUST transfer the gun through a FFL dealer in your state of residence to take possession of it. To buy a gun in AZ and take possession of it in AZ, she would have to establish residency in AZ. What exactly that requires varies from state to state and you'd probably be best served by posting that question in an AZ state specifice forum.

Like the other poster said, you can only take possession of a handgun in your state of residence. She can go to AZ to buy a gun, but if she is a CA resident she will need to have the gun shipped to a FFL in CA (unless it is pre-1898) and pick up the gun there. However, she will run into some problems. Many gun stores won't send a firearm to CA, and if the gun is not on the CA DOJ's approved list, the CA FFL will not transfer the firearm to that person.

Even if she becomes an AZ resident (AZ address, driver's license, register to vote, etc.), the high capacity magazines cannot go to CA if she visits or moves back.

Unless your friend wants to move away from CA for good, she might as well as buy the gun in CA. It will be a lot easier for her.

The minute that she steps foot in Arizona with the intention of making a home in Arizona, for the purposes of firearms transactions, she is an AZ resident. The problem is providing proof. She can keep her CA driver's license, and can use a second, government issued document to prove her residency in AZ. Many FFLs will not accept such proof of residency, although it is allowed by Federal law.

Also, as long as she can convince a private seller that she is an AZ resident, she can buy a handgun from another AZ resident without going through an FFL.

Your friend would not be wise to bring high cap mags back to CA. Even if she uses the gun in a justifiable self defence situation, having an illegal gun makes it that much easier to be exposed to prosicution and civil suit. 10 rounds is enough to stop a threat (althgough 15 would be better) to protect herself from both physical harm and legal trouble at the same time practice more and stay out of trouble

From a legal standpoint she is much better off buying a gun in CA. First any gun would need to be transferred via an CA FFL anyway. You might as well give the CA FFL your business as it must be tough for anyone to be an FFL in CA. Second California has a list of handguns that an FFL may transfer to you. It is very possible your freind could buy a handgun not on the approved list and be the proud owner of a gun she cannot take posession of in California.
