BOULDER, Colo. – A suspected female intruder was shot by a homeowner on the 400 block of College Avenue in Boulder early Wednesday morning, according to police.

The home belongs to a married couple who told investigators they were awakened by a noise, which they initially thought was a raccoon, in the middle of the night.

“When the female homeowner realized that the noise was not a raccoon, but someone who had opened the door and entered the bedroom, both she and her husband shouted for the intruder to get out,” said Boulder Police spokeswoman Kim Kobel. “The male homeowner shouted that he had a gun and would use it if the intruder did not leave immediately.”

The couple told police the intruder, who was carrying a light, ignored their demands and continued walking through the bedroom.

“At that point, the husband fired one shot toward the light, and heard what sounded like something falling onto floor,” said Kobel.

When the husband turned on the light, they saw the intruder on the floor with a gunshot wound to her hip. The couple then called 911 at about 3:26 a.m.

Kobel said the intruder was taken to a local hospital with non-life threatening injuries.

“Apparently (the) young woman, possibly a student, said she was lost, according to the detective,” says Tom Kellogg, who lives on the same block.

Boulder police say the incident may fall under the state’s “Make My Day” law, but that decision ultimately, would be made by the Boulder District Attorney’s Office.

No names have been released.

And why have a flashlight? If your lost, don't you turn on the lights when you enter and say to yourself, "Huh, not my home." Seems a lot of unanswered questions in this story..

yup alot of unanswered questions thus far it's a holey story ..lolz..she could have been deaf or drugged up or both?? for all we know
inquiring minds want to know

Deserteagle's post was my first thought. She might have been drunk and lost. Sad if that's the case but hard to blame the couple protecting their home and family. Hopefully the young lady survives and lessons are learned on both ends. Better safe than sorry on the homeowner's end and I really hope things work out for the best in the entirety

The state’s “Make My Day” law?

I'd love to know if the police spokesperson actually used that ridiculous phrase, or if KDVR is sprinkling some not-so-subtle liberal bias into their report.

Cheers,
Dr. Detroit

I find it irritating and ridiculous when someone labels firearm defense laws and right to carry with these Hollywood piles of garbage like "Make My Day". This is not what this is all about and this is not what this case was all about.

UPDATE:

I was right...

BOULDER, Colo. – No charges will be filed against a Boulder man who shot a female intruder who wandered into his home in the 400 block of College Ave. early Wednesday, the Boulder District Attorney announced Thursday.

The intruder was identified as Zoey Ripple, 21.

According to her LinkedIn profile, Ripple is a “Food and Beverage Intern Manager” at Columbine Country Club.

The incident happened at about 3:20 a.m. when the homeowners, a married couple, were awoken by what they first thought was a raccoon. Then, a woman’s figure appeared in their bedroom, holding a light.

“She walked into our bedroom and…we were screaming at her…but she kept coming in the bedroom and…we shot her,” the man’s wife told a police dispatcher in a frantic 911 call. “She’s in the house now. She awake. She’s fine, but she’s shot.”

The husband had shot Ripple in the hip with a Glock.

“Preliminary tests indicate that Ms. Ripple’s blood alcohol level was above .20 at the time of the incident,” the District Attorney’s Office said.

Boulder DA Stan Garnett says the shooting falls under Colorado’s “Make My Day” statute, which allows homeowners to use “deadly physical force against an intruder.”

Police are still considering possible charges against Ripple.
