Hello Need help with maine CCW

Hello everyone. I just joined and have a question regarding getting a maine ccw. I'm pretty confused with the section where it says ( "Do you have a mental disorder that causes you to be potentially dangerous to yourself or others?" ). Does this include past depression? Is it a mental disorder that is founded in court? Who is the person that defines you as having said mental disorder according to the laws?

I believe what they are looking for is if you have or are being treated for a mental disorder. When they do your background check they check with Riverview Psychiatric and Dorothea Dix Psychiatric Center to see if you had been at anytime committed. Note: If you answer yes on that question it is cause for refusal. I don't know if this helped or not but I figured I'd at least try to help a fellow Mainer.

I heard through the Grape Vine that The State Police also check with Your State's Narcotic Agency's to see if you have ever been prescribed any prescriptions.

I do not recommend lying on your application, but I would consider carefully how you answer that question especially these days with the Government so hell bent on controlling our weapons.

If your condition was ever documented by an hospital, Doctor's office etc.etc. You might have to answer yes. Also you might want to consider contacting an attorney who specializes in 2nd.Amendment issues, or CCW.

Taking advise from the internet is never a good idea especially when dealing with something as important as your right to Carry. Plus in the end talking to an Attorney may avoid you landing in trouble for not answering the question correctly.

While I agree with u usmeu25 that taking internet advice as 100% true is a bad idea, I just want to get a feel of what other people think about this question. A little background on myself. I have been treated for depression before by my doctor, and I was prescribed depression pills before in the past. I have never broken the law, never even a speeding ticket. I have a family, and work a good job. I pay my bills and taxes. I can own firearms 100% legally now. I have never been Committed involuntarily to any mental institution by a doctor or judge, I have never been Adjudicated mentally ill in a court of law. Having to say yes on this question and being dented would really be disappointing seeing as I feel their is no real reason for my dental. I won't lie on my forms but at the same time whats the point of applying for nothing. I'm not harmful to myself or others, but because I sought help for my problems and i'm fine now, i'm now unable to exercise my second Amendment rights?

I don't believe that to be true (narcotic history) and would constitute a HIPPA violation. The only mental health background checks are done through Dorithea Dix and Riverview and the applicant consents to the check in accordance with HIPPA. Any unauthorized medical background checks would be unlawful.

Yes it is an established diagnosis and I suspect that is how it is defined; have you been diagnosed and/or treated for depression.

Who knows what tools investigators really use. Do you honestly think they care wether they violate Hippa Laws???

I highly doubt it. They will use any means possible to gather the information they seek. Legal, or illegally.

That's why our Local, State & Federal Governments are what I call corporate Crooks.they are protected by Corporate by laws.

Giving them full, unrated control over all our rights. We don't have a choice.the one with the most money WINS.

It doesn't matter what you disclose on your application, if they don't want you to have a Permit to Carry, you won't get one.

believe me no-one more than I disagree with what the government does, but I'm just one person I can't change one single thing.

U know with all this talk in the news about mental health really scares me. Theirs not one person in america who dosent have a hard time sometimes. Most people just choose not to seek help for it because of the fear of loosing rights or being labeled.
I just see it becoming a way to single out a whole group of people under the confusing generalizing 1950's wording of the law. Laws could be passed that anyone in the future that has ever sought help for anything would be denied even firearm ownership. Group all the people that have sought help for any mental health issue into the denied bin.

While I think some people should not own firearms, I also think that people should not be afraid to get the help they need for it.
