Guy with no CWP drops gun, shoots bystander

This guy is a klutz and probably shouldn't be carrying.

Flossie Mae Bell, 70, told police she was waiting to cash out Friday afternoon at the Springfield Supperette, 1701 Pearl St., when the man in front of her dropped a leather pouch and she felt a pain in her legs. A store worker said he heard a loud pop like a firecracker.
Monlyn told police he got the .25 caliber derringer pistol for protection and had never carried it in public before. He said he didn't know he needed a permit, according to a police report.
He seems to lack a tremendous amount of common sense.

Many derringer-type guns that I've seen do not have a trigger guard. If the safety is not on, or there isn't a safety at all, then it requires very careful handling. Carrying one of these around hot in anything besides a holster is not very smart. It's a little scary to think there's geniuses out there walking around with this sort of ticking time bomb setup.
 

feel bad for the lady.. she is probably a gun hater now if she wasn't before.. all because some idiot had no common sense.

This should go some way in the "minimum effective caliber" discussion. If it doesn't drop a 70 year old woman, it will probably not have much effect on a fully enraged BG. :jester:
 
He's lucky that he did not kill her and end up with a manslaughter charge on his hands. If he does not end up losing his 2A rights, he needs to go back for a little training before handling any firearm ever again.
 
Guy with no CWP

In addition to the criminal charges for carrying a concealed weapon, He now is liable for a civil suit by the lady who was injured. She could own the guy for life. In Indianapolis, we had a special police officer once who was working a pacers game. He was carrying a .388 spl derringer-type handgun in an ammo pouch as "BUG." It fell out of the ammo pouch and discharged when it hit the floor and injured a basketball fan. He and his company were both sued and lost for an unspecified amount in civil court. Specil Policemen and deputies were forbidden from that point of from carrying anything other than the standard sidearm.

As with most other firearms, they're perfectly safe *if* people avoid pulling the trigger if they intend to shoot, and avoid dropping the gun itself, particularly when it doesn't have a trigger guard. Link Removed will retain the weapon and facilitate a clean draw.

No firearm should be carried in anything not meant to carry a firearm. Doing so is asking for trouble.
 
Our last district attorney here in Curry county dropped a pistol on the floor, when it went off it shot his secretary ( minor flesh wound in her leg ) Then two weeks later dropped it in court, in front of the grand jury. I believe that the law suite with the secretary is still ongoing. He is now in private practice!

...if this is in the springfield part of jville i'm surprised the old lady didn't shoot back. somebody carrying illegaly in that part of town, with a .25?
 
So can these Derringers go off if the hammer is smacked hard enough, or could this guy have possibly been carrying it cocked?
