Guns in limbo, Desperate in NY

I moved to New York a while ago and turned my pistols over to a dealer/store so they would be legal until I got my carry permit. I found out that the dealer lost his license so he turned them over to another dealer. This guy was an employee of the store my guns were turned over to. He was terminated and now doesn't have a permit so he can't turn them over to me until he gets his license reinstated. How the devil do I get my guns back? I am getting extremely nervous about this as there is a considerable amount of money tied up in these guns and i have a connection to a couple of them as they are of collector value. Am I being jerked around? Can I transfer my guns to someone else that has a permit before this guy gets his license reinstated? I haven't gotten my carry permit yet. I'm in a real pickle here and I don't want to get ripped off or have my guns confiscated and destroyed by the law here in New York. Any suggestions as to what I can do legally? Thanks in advance for any information you will provide.
 
Sounds like you are getting the run around. If you know someone else with a permit, they can be transferred. Or another NYS dealer can receive them. I am a NYS dealer and handle transactions like this every so often. Make sure you have proof that the guns are in fact yours just to cover yourself.
 
Pending on your location in New York I would find an FFL Dealer in your area, and make sure they have.been ib business for a while explain the situation to them. Im sure they can help you,

Also it would'nt hurt to contact the Pistol Permit office in your county.

Sounds to me like a scam. If the first dealer turned it over to another dealer, it would go on that dealers books. An employee of the dealer being terminated wouldn't have any standing on the status of the guns if they were on another dealers books. If they were turned over to an individual employee instead of another dealer you might have an idea of why he lost his dealers license. You may want to get the police involved in getting you guns back. The police can take possession of them until you have your license. Word of warning! You better be sure you permit is going to be approved as the police will only hold them for a set period of time before they destroy them.

Definitely get to the pistol permit office in your county. They should know how to handle the situation and have access to the dealer info. Next, even though you've applied for a CCW permit, maybe have them issue a "target/hunting" permit in the interim. That will give you the right to at least posess them and keep them at home. Although not ideal, at least they'll be in YOUR posession.
Next, if you suspect a scam, I would contact the State Police, as they would be very interested if someone obtained firearms in a less than legal manner.
As for documentation, I would hope you have original receipts or as in NY, the serial numbers are actually printed on your permit. If not, maybe you can get the FFL records from the original dealer showing the legal transfer to you.
 
I'm no longer in NY, but the law was always that if the gun was not listed on your permit then you could not posess it in any manner. My friends & I always made sure that we all had each others guns listed on our permits. This required going to the court together & having our permits amended. If you have a trusted friend who is licenced they can add your guns to their permit & legally posess them. Good Luck
 
I don't know the answer for you. Part of most of the answers is true. I suggest you contact BCI who is a member of this board. He seems to be the most knowledgeable member of the forum about NY state law.
 
You may be able to transfer the guns by filing an amendment form with the county of issue.

Yours is a complicated issue. I would confirm with any FFL holder based in NYS.
 
Yeah..... time to go to the permit office. If you explain the situation to them, they can get the pistols from this so-called dealer and take possession of them. I'd do it soon, so this guy doesn't have the chance to sell them out from under you. Sounds like a scam to me. The original FFL should have signed paperwork where he transferred your guns to the second guy, who should have them on his books. I'd let the police handle it. Good luck.

HELLO, anyone home??? If you didn't want to get ripped off or loose your firearms, why did you move to NYS in the 1st place. I lived, worked, hiked, camped, fished, hunted, homesteaded and raised my family (8 kids) in the Catskills/Adirondacks for over 45 years. I voted with my feet when I retired a few years back (as-well-as ALL my family and friends have done too)...NEVER EVER going back to that gulag...just wondering.

I hope you get 'em back, but I wouldn't hold my breath!
