Good Encounter After A Shooting

Well, 3 nights ago [Febuary 4 2011] around 2am I was laying in bed with the wife, I heard the dog barking, and some muffled, what I thought was music, just heard words, no beats, [kinda weird] after a minute, I didnt hear it any longer, then, it would start up again. I thought nothing of it, thought maybe the neighboors were having another party.
I jumped out of bed grabbed my gun and slid it into my waist band [I always do no matter where Im at] I went down stairs and was going to let the dog outside thinking maybe he had to pee.
Roughly 5 minutes after I went downstairs I heard 4-5 gun shots. It wasnt close, but I peered out the window, noone was in the street, although I did realize the "music" was infact arguing. I let the dog out and of course wanted to know what was going on. Ive only lived in the City of Flint [Michigan] for a little over two months, and knowing the city doesnt have the best reputation, I have always kept my weapon on me.
I continued to listen to the yelling, and walked to the front of my driveway only to observe 7-8 people running to their car. One of the guys had seen me at this point on my cell phone. He took off his shirt and started approaching me throwing his hands up like he wants to fight, yelling "you gonna call the cops on me boy, Ill beat yo ass" I ignored him and continued to relay the info to the police. They informed me they had officers on the way.
I then heard someone else say "Come on B Ive got the gun, we gotta go, we gotta go" inbetween that, they mentioned someone with them was "bleeding to death" and had to take him to the hospital.

Amongst all of this, the guy is still walking towards me, he stopped once he seen me putting my hand on something in the hip region. He ran back to his truck and they left. The dispatcher hung up with me and of course being a good person, I couldnt live with myself knowing a small gun fight broke out hearing that someone else had been shot, and thinking someone was laying in the snow bleeding out.
I got in my car and drove litterally two houses down onto the next street to observe and wait for LEOs.
State police showed up, I informed them I was the caller and wanted to make sure noone else was laying in the snow. I passed along the newly aquired info about somone being shot and told him what Id heard...City of Flint LEOs showed up, and they for what ever reason, assumed I was shot, or was shot at. The Flint LEO asked to see my ID. I told him I was a CPL holder and I was carrying concealed. He said that was fine and said as long as I didnt pull my weapon, he was OK with it.
He ran my ID for what ever reason, came back to me and asked me to show him my gun. I told him I wasnt going to draw my loaded weapon and asked him to do it to eliminate any confusion other officers may have. He pulled my gun off my hip then smelled the barrel. I informed him again, the safety was not on, and that it had a round in the chamber...He didnt care, he just asked if I shot at the people, I told him no. He put my weapon back.

One LEO even asked me why I didnt stop the people from driving off? -.- I told him I heard they had a gun, there was more than 1 person, and that, honestly it was none of my business to stop them, I wasnt looking for trouble, Im not an LEO nor is it my job to stop a shooter unless my life or someone elses life is in danger. He laughed and said, " well you heard shots, so technically someones was..." WTF?

Anyhow, good encounter, although I dont see why I was in a way for a moment a suspect. Overall I gave the City LEOs a 10/10 the Officer was very friendly, and in a way, kinda cool. Theres a little more to the story, but I kept the relivant stuff in here. Think I did the right thing?
Id like your guys take on this all.

I think the only thing I may have done differently is stay inside and observe. If I did have to go outside to observe, I would have remained out of site.

IMHO; there is no need to "expose" yourself needlessly. (To a BG or the police)

However, it sounded like a good LEO encounter under the circumstances.
BUT!!!!
It could have gone REAL BAD exposing yourself to the BGs!

BTW:
Did you find the person who was shot?

Did you render any aid?

Have they caught the shooters?

No, I should have included that in here, when I went out, All Id seen was markings in the snow very little blood, no persons. I never rendered any Aid, thank god.
As far as the shooters go, the Police told me noone ever showed up to Hurley Hospital, although I did tell them to check Mclaren Hospital, being it was closer. They had me wait over an hour for a detective incase they needed any info I had, although none had ever contacted me.
Im not sure if the shooters were ever found, I sure hope so, from what it sounded like, it was all due to overly drunk kids with guns and no disipline .

The last thing I would have done after hearing gun shots would have been let the dog out and gone out side myself. Are you somehow immune to gunfire?

You've also left yourself open to retaliation becuase the shooters now know exactly who called the cops.

Well, officers get a "shots-fired" call and no matter what everyone at the scene is going to be a suspect. Not sure why you'd be surprised about that.

In any case I applaud your restraint and cool head. Keeping your gun holstered and not trying to stop the BG. You didn't observe anyone in danger and you were not in danger yourself (enough to draw) and you kept your weapon holstered even when a suspected BG was approaching. Again good job keeping cool. It can be a fine line between you making a situation worse by drawing your weapon and making it better by drawing.

The only thing that I would have done differently is remained more discrete when trying to figure out what was going on. I have no need for people like that to know I was the one who called the cops.

Also, sounds like you did a good job with the LEOs. Did you tell the dispatcher you were armed or wait till the LEOs arrived on scene?

sounds like the leo did their job pretty well. as far as the leo seeing if your gun had been fired it sounds like he did not suspect you but by checking the gun he could report to his superior that your gun was not the one that had been fired. you showed great restraint with your gun and did well in my opinion. as far as remaining out of sight its hard to second guess anyone in the same situation. i think i would have remained out of sight. but do watch your back and be careful in case the bad guys and you meet again.

This is my first post on this forum. I can give you some advice since I grew up near Flint. The place is a dump. If you to live in a city setting move to Grand Blanc. If you want something slower move to Vernon, Bancroft, Durand, Gaines, Owosso. All small towns within a short commute to Flint. If you stay in Flint come up with plan on how to handle similar situations as it will happen again.

I'm not sure I would have been comfortable letting the police officer reach inside my clothing to remove a chambered pistol. Something about being shot in the dark place doesn't sit well with me. But it worked out. It's better than having someone think you're drawing on an officer. I can't think of a better option. IMHO, you handled the situation well and did the right thing given the circumstances.

I might have stayed inside like others have suggested, and peered through the blinds or whatever. I'm always doing that when there is no activity anyhow, just never know what you're gonna see out there. It seems you remained calm and I have to applaud you for making the call before getting involved in any way.

I am surprised to see the comment you quoted from the officer in response to you telling him it wasn't your place to get involved. It seems as if he wanted you to shoot them after all. It'd be your butt anyhow, and his "permission" wouldn't matter in court.

I think that you need to be extremely vigilant for a while now that you've been positively identified by the suspects.

Glad to know you didnt find much blood! I think its nice when LEOs act that way. What he said would be a HUGE mistake in FL, as you are not allowed to shoot in order to prevent a BG from escaping. Good luck to and your wife up there, I wish you safety!

You did the right thing but I would have stayed inside the house and call 911 from there instead. As for letting the dog out, don't you have a backyard to let him out instead of the front yard?

Smell the Barrel?

Everything seemed to go well in this story but I question the sanity of the LEO who, after being told the weapon was loaded, the safety off and a round in the chamber, would stick the muzzle up to his nose to see if it had been fired. Guess it takes all kinds!

OldGrunt, I couldnt agree with you more, all it would take is him to either accidently fumble with the weapon, and it to shoot him in the face, next thing you know youd see me defending myself in Court, thats if the cops on scene didnt blow me away, for "shooting" the cop. I wasnt comfortable with it either. Hope he doesnt do that for every person with a CPL...

While I have the same problem as the others with the method used to determine whether or not your gun was fired, I think any supervisor would want to see "The subject's gun had not been discharged" on a report rather than "The subject said he had not fired his gun".

Doesn't sound like you were a suspect as much as a "T that needed to be crossed".

You didn't ID your sidearm but I sure wouldn't have let the LEO remove my unfamiliar (to him) Condition 0 weapon (round in the chamber, hammer cocked, safety off) from an unfamiliar holster and then put it back in the same state. Damn good way to get yourself shot in the leg/foot by a friendly!

:biggrin:Its good to hear stories about how citizens and police can work together, and show each other respect, in a situation such as that. It sounds like you played your cards pretty well. I don't think I would have went outside though. Had a similar situation, about 18 years ago, when my wife and I lived in Naples, Florida. Won't get into it here, but I ended up calling Collier County on that one and they did show up en masse. I had stayed inside our trailer with my Mossberg 12 ga. and waited for the calvary to show up. If a BG would have tried to bust through my door though, it would have been curtins for him. Glad eveything worked out for you.

I would rather die on my feet than to live on my knees!

As a retired senior military officer, I spend quite a bit of time talking to vets with some horrific injuries in the local VA hospitals as well as at Walter Reed and the National Naval Medical Center. And not one of them has ever voiced a regret to me that absolutely everything possible was done to save their lives on the battlefield...even though some returned with unimaginable burns, limbs and eyes missing, unrecognizable facial features, massive internal injuries. Now granted, the vet suicide rate in that critical 12 - 24 months afterwards is certainly a lot higher than any of us would like but IMO it's the "system" that's failing to provide a suitable level of compassionate care which is driving them to an unfortunate solution...not that they'd rather have died on the battlefield...on their feet as you put it.

This relates to the topic at hand .... how?

Response to "I would rather die on my feet than to live on my knees!" and the topic of the thread I guess.

Seems pretty obvious to me. But not to you apparently, Treo.
