once of the first things anyone should do especially if you have a firearm is avoid confrontation which is something you should learn before you even make the choice to carry. your first reaction should have been to turn around and walk away or to walk in an opposite direction. others could also say that by you say " get the ******* away" might have been hostile and instigated the situation making you an aggressor. by appearing as an agressor you could also seem as if you were out looking for a reason to use your gun. one other thing is you should know if your state is a stand your ground state or not. here in new york we are not a stand your ground state which means we must retreat if possible in these situations before making the choice to pull a firearm, or even mention a firearm. to me it sounds like you should have been able to retreat and did not which is against the law in some states.

Treo this honestly happened . Next time I will act differently . I won't get my Ccw revoked . I don't go around telling people I carry or pull it out for fun. I do think I acted correctly just got nervous and used the wrong choice of words . This isn't a troll post I'm being honest 100 percent . There are a ton of people who are on bath salts and h where I live he had a hat on and dark sunglasses . on top of five bars in a five street span . If I walked up to you treo in that way I Told it . Was it legal? Likely not.

I live in Lakewood / Cleveland area . I was walking to the store with my daughter a minute ago . There was a older black male in sunglasses that approached me and told me to shake his hand because I look like someone he knows . I told him to get the eff away from me . He told his buddies something then started walking closer . I put my hand on my gun and told him I have a gun in my pocket leave me alone . ? Is that legal ? It made him leave me alone real quick . It just seemed odd .

Disclaimer - I am not a Lawyer, or Law Enforcement Officer, and the following is in my opinion based off of the original posting and of what I know of the US laws.

It would have been brandishing a firearm if no justification can be provided. In my State Assault and Battery are two separate charges. Assault could also be applied in my State.

"Federal law defines brandished as, “with reference to a dangerous weapon (including a firearm) means that all or part of the weapon was displayed, or the presence of the weapon was otherwise made known to another person, in order to intimidate that person, regardless of whether the weapon was directly visible to that person. Accordingly, although the dangerous weapon does not have to be directly visible, the weapon must be present.” (18 USCS Appx § 1B1.1)"

Others may or may not agree but this is my opinion.

In my experience and knowledge of Oklahoma laws if you were in my State the very mention of a firearm is equal to the use of a firearm in the sense that they are both a lethal force decision.

Was thinking the same thing. Its called "situation awareness" and it is just as important as your shooting skills and knowledge of the law while you are carrying.

When I take my family to the grocery store, I am always aware of what's going on around me. I don't take them across town to the ghetto (where I didn't choose to buy a house) to do grocery shopping. Sounds like better judgement could have been used, but I wasn't there to see it all play out so I will just have to take the OP at his word and give him the benefit of the doubt. I would tell OP that just because you have that little piece of insurance inside your waistband, you should be double aware.

The fact is that if your posts are any truthful indication of your character you are extremely immature and it appears to me that you carry a gun because “it’s kewel” .

In combination these two thing are an almost certain guarantee that you will, sooner or later, do something stupid and lose your carry privileges

We don't have a stand your ground law I looked it up today . I most deff was in fear with the manner that he handled himself . Might have not done it by the law book , but I would rather protect my little girl from some *******

It doesn't matter if you were "in fear". what matters is that you can convince a jury that any reasonable person in the same situation would also be in enough fear to resort to a fire arm.
