Georgia Expunged Felony

Hi,

When my wife was 17, she was caught with a knife on her person in her High School. She was given a deal, and she was told that it would be expunged. My questions are; Can she get her concealed permit? Does she need to check yes for felony on her application? I would think the answers are 'yes' and 'no' respectively, but I am concerned since it was a weapons charge. Despite being expunged and non-violent. Thank you for all of your help!

contact the issuing authority and check with the clerk of courts where she lived at the time to get the legal crap taken care of

You can do a records search on your own for records concerning yourself. Depending on what state it was in, and the charges filed, and the records kept... if they were at all. Sometimes there are no records that last more than 25 or 30 years, and if they weren't put on computer, very few people will take the time to do a ledger search.

First of all, she was 17 so any check she does on herself won't show it because juvenile records are sealed from public view.

Second, you will come to find out that just because she was given a "deal" and it was suppose to be expunged, doesn't mean it actually was. When they say that, it just means it's eligible to be expunged. She still has to petition the court, and go through a mess of paperwork to have it cut from her record.

Question. When you say she got a "deal", do you mean she accepted a plea bargain and plead guilty, or did she go through a juvenile diversion or deferral type program for first offenses? That can make a big difference.
