Full Repeal Bills Introduced in the Assembly and Senate – May 23rd
ACTION ALERT: We now have a FULL REPEAL bill in both the Assembly and Senate! Assemblyman Dave DiPietro’s bill is A6238 and Kathy Marchione has put forth companion bill S5591 in the Senate. This is a major victory and shows that the pressure that the grassroots put on the legislators to sponsor FULL not partial repeal bills really paid off!

Note that this bill will not come to a vote unless a Democratic assemblyman co-sponsors the bill. There were only 8 Democratic assemblymen to vote against the NY SAFE Act the first time: Brindisi, Gabryszak, Gunther, Kearns, Lupardo, Magee, Schimminger, and Skoufis. Call and email and ask them to co-sponsor A06238!

That's some good news, I guess. But I am torn. The Tresmond and NYSRPA suits have the strong probablility of winning a permanent injunction and even further a declaration from a higher court that the SAFE Act is unconstitutional. Repeal would make the suits moot. I think the successful suits would be much better for us. The repeal bill will hopefully be delayed until after the court decision on the suits and will only be needed if the state is successful in court (which is highly unlikely).

I agree with you, that would be the best scenario. I know someone on the Tresmond legal team and while he can't really tip their hand too far, it looks like the (un)SAFE Act is going down the toilet. In fact, Cuomo himself may very well be in some real hot water with regard to some other (un)SAFE Act related violations. It's going to take a little while, but it looks like gun owners in NYS are going to be very happy with the outcome.

I know the State of NY had to submit it's response to the Courts to 'explain' what the 'Emergency' was in passing the unconstitutional SAFE Act. That was some time ago now, but I have not heard whether the judge in the case ruled on it yet. Has anyone heard? I've been 'under a rock' as of late.

I believe that a new date to consider the case was set on or around July 17. It was delayed for undisclosed reasons but those in the know claim that the reasons are for some other actions favorable to us (gunowners).

he's a good guy but here is his response.


Thank you very much for your email - as you know, I was one of the very few Democrats who voted against the SAFE Act back in January for reasons we've discussed. Regarding repeal, I hate to be the bearer of bad news, but Speaker Sheldon Silver will never let a repeal bill come to the floor. I repeat: never. Instead, it is important that we work to make the bad law better because that is all we can reasonably expect to do.

Has anyone heard anything on whether NY State has responded to the court on the "emergency" passage of the SAFE ACT? Has there been any progress in the case?
