Every new years eve and on the forth of July we have and an idiot in our neighborhood that thinks that it is ok just to aim his fireworks any directions he wants. every time someone in the neighborhood calls the sheriffs dept. on him they tell them that there is nothing they can do about it unless they see it happening I have talked to the sheriffs dept. and told them that this year I and some other neighbors are going to take it as a threat on our homes and family and handle it accordingly what do you think?
 
Sounds premeditated to me..... Kinda hard to defend oneself in court for something they admitted publicly/online to planning before said event happened.....
 
I think you're going to end up in jail

Why don't you video tape him and turn that over to the Sheriff's Office?

Take a video of the activity and if the sheriff won't take action on the video itself then you can present the video to a judge for action. You can swear a complaint and the judge can order the sheriff to take action. Using a gun to defend yourself against bottle rockets and roman candles is a bit much. Maybe an army of garden hoses might be a better option.
 
A better bet would be to find out if there are any fireworks that are illegal in your state (a bunch here, don't know about FL), and then claim it looks like he's using those. Better a false claim than killing someone.

I like the garden hose idea, though!
 
Stupid people doing stupid things in stupid places at stupid times. Avoid stupid people, but also don't become one of those stupid people. Just because you are angry about something does not mean you have a legal claim or the right to use a firearm.

Evidence is key. Video such incident. Check for any burned fireworks that came down on your property and photograph it (with a picture background that identifies the location). Call the police if there is an actual danger, such as when you see fireworks landing on your property. Do NOT directly engage in an altercation with that idiot. You may inform him ahead of time about your view, such as via a letter.

Alternatively, you can also walk over to the idiots property when he is firing off the fireworks. You will be carrying your firearm as usual. You inform this person about your view. A number of profanities are exchanged. The idiot is apparently drunk. At some point fists are coming at you and you fire a shot hitting the idiot. Especially if it is the OP and some others acting together. Maybe they could all get the same attorney and split the cost.
 
I agree with video taping the incident from as many angles as possible, taking pictures of fallen debris and filling more complaints with the Sheriff's office. Do you have pets or kids? Do the fireworks frighten them? Do these fireworks cause any damage? That's important to report to the police. If the police refuse to act, get an attorney involved... maybe there's something they could do. I have a neighbor that does sorta the same thing, though it's usually not that many at a time and all us neighbors surrounding him don't really mind much. However, I'd be lying if I said that there aren't times that I interpret the fireworks as IDF and my heart races... I still can't attend fireworks shows. No matter what you do, play it cool and don't escalate a relatively calm situation.

have you ever heard of video recording?
many newer cell phones have this capability.
Just record the guy and present it to the responding deputy.
if they still refuse to cite the guy you need a new sheriff

If so, file an information report BEFORE he does it, just to get on record so the beat cops can be on the lookout for him. In fact, the chief might just place an unmarked cop out there in order to be able to stop it once and for all, if you report him early enough that the chief can plan ahead.

Wow. He already said that he told the cops that he and other neighbors were going to handle it as a threat that the one neighbor is engaging in presumably legal activity.

As such, if the cops decide to park an unmarked car anywhere, it ought to be right in front of Buster04's house to make sure he doesn't decide to go for a walk with other neighbors intending to confront the fireworks neighbor with guns just as soon as they light off a sparkler.

If fireworks are legal in your state, city or county, Buster04, and you can't prove damages of more significance than simply littering the remnants of the fireworks, you're stuck. Live with it, move, or sue the neighbors for the cost of the cleanup. Those are your only three choices.

If fireworks are illegal in your jurisdiction, then your problem is with the cop-shop, not your neighbor. Become an activist to clean up your cop-shop, or move.

Under no circumstances with the information you have provided, would you be justified in confronting your neighbors with deadly force, and if you try to come back and say that that isn't what you implied was your plan, then how do you think your Sheriff is going to interpret the statement, "I have talked to the sheriffs dept. and told them that this year I and some other neighbors are going to take it as a threat on our homes and family and handle it accordingly?" That right there is very clearly a threat made against your neighbor. You may have already broken the law by making such a threat. Good luck with that.

Only thing I have to add is file a complaint with your city/county counsel and or the Sheriffs office. Keep it well documented. Possibly go to code enforcement as well. Pyrotechnics generate a fire hazard. Surely there's a amenable solution as the community is at risk of potential fire hazard.
 
Where in my post did i say anything about using a gun we might stuff him down a sewer drain or something of that nature but I would never threaten him with a fire arm

Whatever you ended up doing to him would be considered pre-meditated. These forums are not safe places to expose your frustrations.
