Ferguson gun shops told to stop selling/remove all firearms as safety measure….

They are anticipating a full-on meltdown when the grand jury decision comes through - regardless of whether they choose to indict. This is unconfirmed at this time, but it appears that police have instructed all shops selling firearms to stop selling them and to remove all of their firearms inventory for safety ahead of the grand jury decision.

MO. REV. STAT § 21.750. Firearms legislation preemption by general assembly, exceptions


1. The general assembly hereby occupies and preempts the entire field of legislation touching in any way firearms, components, ammunition and supplies to the complete exclusion of any order, ordinance or regulation by any political subdivision of this state. Any existing or future orders, ordinances or regulations in this field are hereby and shall be null and void except as provided in subsection 3 of this section.

2. No county, city, town, village, municipality, or other political subdivision of this state shall adopt any order, ordinance or regulation concerning in any way the sale, purchase, purchase delay, transfer, ownership, use, keeping, possession, bearing, transportation, licensing, permit, registration, taxation other than sales and compensating use taxes or other controls on firearms, components, ammunition, and supplies except as provided in subsection 3 of this section.

3. Nothing contained in this section shall prohibit any ordinance of any political subdivision which conforms exactly with any of the provisions of sections 571.010 to 571.070, RSMo, with appropriate penalty provisions, or which regulates the open carrying of firearms readily capable of lethal use or the discharge of firearms within a jurisdiction. This section shall take effect on January 1, 1985.

My reply would be "Screw you. I'll stay open and defend my store with the guns and ammo in the store if I have to."

Where do they think a store owner should take 500 guns? Unbelievable. Perhaps they should put an officer in front of each gun store to ensure the locals don't loot it.

Exactly! Let them "Protect and Serve" An Officer of the Law in front of each gun store. How many could there be? Even if he needs company, then add as many cops in front of the store so that they "feel safe"! Or they could just encourage the store owners to defend their own property.

AS per the PD we have been told that it would behoove (don't ya love that word?) all gun store owners to remain on the property to protect it from looters. Furthermore as per the PD all gun store looters will be shot!:yes2:
Of course I am sure that no matter the outcome of the Grand Jury that all protests will be peaceful and orderly so that we can all understand clearly what the concerns of the protesters are.

In this situation above all others that I can think of, posting cops in front of your business would make it more of a target than just abandoning it. The department would never allow one, two or three cops to stand out separated from the main body(s) of their forces anyway, and those one, two or three cops would be fools to accept such a mission to boot.

There's been a bunch of reports featuring one main gun shop owner saying that his gun sales are up over 400% in recent days/weeks. Hopefully many of those buyers are business people taking responsibility for their own security and protection. The last people I'd want to be seen cooperating with in Ferguson right now would be cops.

Check and see what the MO laws are on state of emergencies. One was declared by the state so there may be laws like Florida has that say that gun stores have to not display or sell during those conditions. But the cops telling the store owners to remove them violates Federal Laws as FFLs are not allowed to move their stocks at the whim of the police. And the cops can't ask for ammo either in the case of Florida. Nothing prevents the store owners from guarding them in place though.
 
And a quick check of MO statutes finds that the Gov does have the powers to restrict sales during a Declared State of Emergency. It is covered in 44.100.1 (3) (d)
(d) Control, restrict and regulate by rationing, freezing, use of quotas, prohibitions on shipments, price fixing, allocation or other means the use, sale or distribution of food, feed, fuel, clothing and other commodities, materials, goods or services;
But then that runs completely counter to 44.101
Firearms and ammunition, state of emergency, no restrictions permitted.

44.101. The state, any political subdivision, or any person shall not prohibit or restrict the lawful possession, transfer, sale, transportation, storage, display, or use of firearms or ammunition during an emergency.
 
Arkansas has a "hands off" declared state of emergency clause if the governor declares one. Given the emergency and if feds become involved, it all would go out the window. I've done a lot of soul searching should the feds try a Katrina Konfiscation. I'd have a short time to say goodbye to family, I'm afraid. Jack-boot thugs breaking the law trying a Katrina Konfiscation on my property will not be well received (like Watchtower peddlers)...by many.

OK...I'm kidding about the Watchtower peddlers, if anyone wants to call-me-out. Sometimes injecting humor into a possibly lethal subject makes me feel better about it...for a short time.

That is why I said what I did about posting the Police. They would never do it. That is why I mentioned the "feel safe" idea. You know like the hoplophobes and their need to "feel" safe but not actually be safe.

Saw that there will be "No Charges" in Ferguson. Now there will be riots to so that the next time the race promoters, like Jackson, Sharpton and others, have another incident that they can get their hooks into they will be able to try and intimidate all involved.

I for one am glad that the Grand Jury came out with this decision. If they had been an indictment, there would be riots! Then there would be more riots perhaps before, during and after the trial. Mr Brown is an after thought now. He is being used as an excuse to advance an agenda!

Years ago during the riots in Watts (California), Korean merchants armed themselves and protected their businesses. That should be the permissible thing for all store owners to do. That would be a solution that even the dumbest knuckleheads would understand. Try to steal my stuff--get shot!

As there are fires, that means arson. Arson brings you into the forcible felony in Florida so you then are justified in the use of deadly force here. In the case of a gun shop, attempted theft of a firearm is a Federal felony.
 
Once again, we are the government, and we are nowhere to be found. But we can't let you protect yourself, either. I'm waiting to see if these pictures are going to emerge again.
