Federal carry laws

What exactly are the federal carry laws? Do they just encompass any federal building?

CO places off limits:

1. Any place prohibited by federal law
2. Any property of public school grades kindergarten through 12
3. Any public building that prohibits ALL weapons which posts guards and permanent metal detectors at all entrances and requires all entrants to surrender handguns to security personnel before entry

Tell me again how federal carry law and state law protected Columbine. That worked real good, cops: were out here and armed to the teeth, remain calm.

Here's a few:

The NPS carry law that was attached to the 2009 credit card act prohibits carry in a building "regularly" occupied by FEDERAL employees.

I'm too lazy to find the cite.

Not quite. The 2009 credit card act contained an amendment which said that the Secretary of the Interior was prohibited from creating any firearms restrictions in National Parks and other land under his/her control. It removed all restrictions in National Parks created by the Secretary of the Interior. So, in National Parks, the same laws (state and Federal) that apply outside the gate of the park, also apply inside the gate of the park with no difference between the two.

The occupied Federal facilities prohibition has already been posted and is 18 USC 930 which applies both inside and outside the National Park because it is a statute enacted by Congress, not a regulation created by the Secretary of the Interior.

I cannot locate the cite but a Federal facility is any building leased or owned by the General Services Administration

Operative word is BUILDING

§ 930. Possession of firearms and dangerous weapons in Federal facilities

(g) As used in this section:
(1) The term “Federal facility” means a building or part thereof owned or leased by the Federal Government, where Federal employees are regularly present for the purpose of performing their official duties.

Generally, it will be up to the administrator of the building in question whether or not they will allow firearms in the parking lot. On military bases, it is up to the base commander where and how they will allow firearms on the military base.

So you draw from this that the federal government only protects it's own people and our school children.... Bunch of chickenshits... You can't even carry in a police station... what are they afraid of, they all have guns.... Never mind that you can't forbid a LEO from entering your home with a firearm.... What kind of one sided government do we have here. Perhaps if our elected officials did their jobs and stopped filling their pockets with our money, stopped legislating our rights away, stopped legislating their own power and moral depravity, they wouldn't need to be afraid of armed citizens....Just a thought.

Exactly. These two misfits broke 18 or 19 state and federal laws. Does anyone think a 20th law would have mattered?

Same with Cho at VA Tech. He did not obtain his gun legally. He falsley answered the questions on a federal 4473 BATFE form. He checked "no" to the question about mental illness when it had been adjudicated by the court that he seek mental health treatment. That's offering a false instrument for filing. So he committed a federal felony to get the gun. He could just have easily rented a Ford Excursion at the local Avis and mowed down hundreds of kids between classes. On a campus with almost 29,000 students, there sure are a lot of people walking around. And we better start thinking about outlawing the Ford Excursion; it's too powerful a weapon.

Maybe someday, if we're all good like England, they'll let us have a "spork." With a license to posses of course.

You can forbid a LEO from entering your home without a warrant for search or arrest or while arriving at a call where there is obviously a serious crime being committed. You have a constitutional right against illegal search and seizure.

In NYS a CCW holder can enter a police station with a gun as long as there is no sign posted.

I beleive SCOTUS has allowed warrantless searches if exigent circumstances exist. Your 4th Amendment protection is not absolute.

No cite.

SCOTUS Okays Warrantless Search of Apartment that Smells of Dope - Law Blog - WSJ

All the police need now is probable cause established by two simple statements, "We smelled marijuana" followed by, "We heard scuffling behind the door when we knocked and announced ourselves." After that, no warrant is required. Which basically means a warrant is never required.

I have read the ruling and it appears that the ruling is limited to certain conditions. However I have no doubt that many in law enforcement will abuse this ruling. I would hope that other courts will uphold the spirit of the ruling and see through the stories that some leo may use to justify their forced entry without a warrant. It isnt often that I agree with Justice Ginsburg but this time I do. LT is right this leads to warrantless searches. Oh congratulations LT on your promotion. Do we still call you LT?
