FBI NICS denied my pistol

Yes, I see the code. It's not a criminal act (misdemeanor or felony) it's a code violation. Probably subject to a fine. Similar to littering. Can you tell me if Broome county regularly denies unrestricted carry permits without cause?
 
I was in a sporting goods store one day, about two years ago and a FWPD, in uniform mind you, was buying a Ruger 10/22 for his son's 16th birthday and he got denied by NICS! I was standing there talking to him when he got denied. He was like "what the hell, I'm a cop for crying out loud"! The guy was appologetic, but told him he had to wait 10 days and if nothing was heard back from NICS, then he could come and pick up his son's rifle. I could not believe that one!

In North Carolina, also, one must obtain the county sheriff's permission in order to purchase a handgun either via a dealer or privately. Bet you can't guess the "roots" of that law...

If you hold a NC concealed carry permit, you re exempt from that requirement. Your CC permit serves as a permit to purchase a handgun.
 
I just found out about the NC purchase permit requirement the other day. Luckily, having a carry permit is an alternative. But, yes, they need to get rid of this Jim Crow law.

A couple things wrong here. First, he could not have been denied, because a denial is a final decision until an appeal is submitted by the prospective recipient of the firearm and the appeal is approved by NICS. Second, it must have been a delay instead of a denial, and in the case of a NICS delay the FFL may transfer the firearm to the recipient after 3 working days, not 10, if they do not receive any further instructions from NICS.

That's correct. But NC is a "shall-issue" state. The sheriff is obligated to issue the carry permit, unless the applicant is disqualified for one a specific list reasons (felony conviction, recent DUI conviction, protective order issued, etc.) The sheriff really has very little discretion regarding denial of carry permits.

And since my county (Wilson) just elected a black sheriff, I doubt that there will be any racial discrimination in the issuance of carry permits.
 
Yes, the certificate of relief is your ticket back in. Good luck, hope you get this straightened out soon.

I looked this up and the law states the following for type A and type B Certificates of Relief from Disabilities (I have B):

"Restores the "full right" to possess all types of firearms in New York State and therefore also restores the right to possess firearms and ammunition under federal law to the individual"
 
Letter

Received a letter Friday from the FBI NICS and I will get their decision in 142 days, yes 142 days:mad:. Being that they just needed my cert paper, it should be much sooner, but who knows. I will be approved, thats the good news......

142 days ! That is nearly forever!!! :man_in_love:And then getting "their" decision doesn't really mean you will be approved either...:fie: I do not know whether I should be happy with that letter which you clearly misinterpreted or ... pray for you that you get your approval soon if it will indeed be an approval. I guess I will just opt for the latter.

They (FBI NICS) did not have my cert of release on file. I spoke with them personally about the matter. That is what is needed to be removed off the restricted list.
 
When you get your cert. make lots of copies. This will haunt you forever.

I have the original in the safe along with several other copies, one of which was received by the NICS last week. The FBI NICS had changed their policy with NY with regards to records and they were lost/not filed correctly. I had to be that one :(( Wish I could turn back the hands of time, but you can't. Life goes on.

That's just downright wrong of them. 142 days seems like punishment.

North Carolina has been looking to get away from that particular law. The argument being that with a NICS check, the permit to purchace is redundant. Of course this also eliminates the option for NC Sheriff's to deny the permits to black people, because as black people they don't need guns. :angry:

Are u saying u agree that blacks don't need guns?
 
Please ignore this troll. He enters threads pretending to participate, but soon gets to harping on the same bogus issue of all these racist sheriffs out there denying rights to blacks or some other group.
