Family attacked for being "In the wrong neighborhood."

A white family getting gas in Baton Rouge, La., was attacked by three scumbags who said the family was in the “wrong neighborhood,” police say.

The altercation occurred Sunday night at a Chevron gas station.

WAFB-TV provides the shocking details:

[Cpl. Tommy Stubbs, a spokesman for the Baton Rouge Police Department] said a man wearing a pink shirt was in line trying to pay for gas when Donald Dickerson, 41, started making fun of him, leading to an argument.

“The defendant (Dickerson) approached the white male victim,” the police report stated.

It went on to read, “the defendant told him he was in the wrong neighborhood and he was not going to make it out.” The victim said that’s when he “was punched and knocked to the ground.”



At this time, his wife got out of the car and ran to help her husband. The victim said, “he continued to struggle with the defendant and was eventually knocked unconscious, which later he awoke in the hospital.”

His wife told police, “after running to help her husband, she remembers falling to the ground and (being) knocked unconscious.“

According to a close family friend, that’s when the couple’s teenage daughter got out of the car to check on her parents and, “observed a female punch her mother in the face, when her mother then fell to the concrete, hitting her head on the surface.”

The daughter was also punched in the face.

“There were only three suspects but there were multiple people in the parking lot,” said Stubbs. [Emphasis added]

The couple’s teenaged daughter is only 14-years-old, according to WBRZ News.

WAFB-TV reports that while the father suffered “a broken eye socket, broken nose, and several lacerations to the face,” only Dickerson was arrested and charged with second-degree battery.

The two other alleged attackers — 24-year-old Devin Bessye and 22-year-old Ashley Simmons — received a summons for simple battery, but were never even taken to the police station.

All three have had prior run-ins with the law.

Reports indicate the attack has not yet been categorized as a hate crime, but it remains under investigation.

"I don't belong in this neighborhood & I'm not going to make it out you say?"
~Quickly draws out sidearm~ (Glock 27) ~Aims it at center mass of scumbag~ (Very prepared to pull the trigger)
"Let me tell you something mother ****'er,...."
a) Watches as scumbags run away like the scared rabbits they are.
~Or~
b) Scumbags foolishly decide to attack and immediatly end up full of bullet holes while bleeding out on the ground.
I then call 911 and report the situation as I try to calm my family down.
 
The instant someone tells you that "youre not going to make it out" that is a direct threat to your life. You have to do something. Your family's lives depend on you getting out safe. The good news is that more and more people are carrying and eventually stories like this will read: "When the police arrived on the scene the 3 atackers were found with multiple gunshot wounds. The victim and his family were unharmed" Don't ******* with a man's family, scumbags.

while you are correct that the comments made were a direct threat to someone's safety unless you can document the BG making the comments either via some witnesses or some kind recording device you can find yourself in deep legal problems if you shoot someone for just threatening you.
there are 2 cases in FLA regarding this type of incident and while one shooter will probably be found innocent there is another who will probably be getting jail time. YMMV

Let us also not forget that when seconds count, the cops are always too many minutes away.
We must be prepared/able/willing to protect ourselves 24/7.

I agree. Its my hope that the law abiding community sends criminals like this a message that we are not milk toast. But that was a threat to his life not just his safety. Honestly, I don't know how I would react in that situation unless I'm put in it personally. Too many variables like body language, emotion, intent, witnesses etc. The attacker decided that he was physically superior to the victim to threaten him like that and we do not know what was said in the argument. Doing something wouldn't necessarily include lethal force? Someone I work with found himself in a similar situation where he was in the wrong part of town and a small mob began surrounding him. He started to behave erratically and ultra agressive, yelling and making small lunging movements towards the people surrounding him giving them the impression that he was insane. It worked too. If I thought my life was in danger I would rather be judged by 12 than carried by 6. Its just a bad situation in general and there is no way the victim could have known the outcome. The overall lesson here is pay at the pump.
 
If the victim could have gotten away from the attacker and pull a gun I think a lot less attacking would have been done.
Or if the wife had a CCW permit and came in with a weapon drawn. These punks who go around threatening people and punching them around need to be stopped. I hope the attacker gets some jail and a fine and has to pay for hospital bills.

It's easy to sit at our keyboards and say what we would have or might have done but it sounds like the attacks were a surprise. The story reads that the first attacker in the gas station made that statement and then hit the guy so he likely had little or no time to react. Cowards like these guys never fight fair and never fight alone. So in this situation I doubt the guy would have had time to even draw a gun. I'm glad that the family is alive but these stories piss me off to no end. You all know good and well it won't be classified as a hate crime either. It's a double standard that isn't going anywhere.

Being old and out of shape is hardly a defense for shooting someone trying to fight you. Now, if there is several of them or weapons involved that is another situation.
 
@Austin; You my friend are very ignorant of the situation. When you become 73, and have lost half your upper body strength, I hope you have the opportunity to have a hand to hand combat with some scumbag, and he beats the living hell out of you. Only then will you have the feeling of being inadequate.

It can serve you well in a self defense situation imvho.

Disparity of Force is defined as a situation that any reasonable person would conclude places you at an overwhelming disadvantage in your effort to protect yourself against immediate and serious bodily injury.

Here are some examples of Disparity of Force:

•Large stronger man attacking small weaker man.
•Able bodied man attacking disabled man.
•Man attacking woman.
•Two or more men attacking one man.
•Two or more juveniles attacking one man or one woman.
•Man or woman known to have training in the martial arts/boxing attacking untrained man or woman.

Again, your adversaries (even in a disparity of force situation) must be demonstrating the ability, opportunity, and intent to inflict immediate and serious bodily injury to you or those around you in order to justify you shooting in self defense.

I am in the same boat as you are. I'm to old to fight but too young to die.
I've been recovering from 3 surgeries after being misdiagnosed. Now the hip that was the original injury is messed up but I'm too young for a hip replacement.
That and the fact that after 6 years of injections, surgery, phsyical therapy and stem cell treatment, I have put on about 37 extra pounds!
I have also increased my smoking to two packs a day as there isn't much I could do except sit around and smoke!
I am at last at the end of this journey and will be starting a work hardening program on Monday. So I can finally start to get a handle on things.

that sir is your opinion, however it is my opinion that if I can articulate the fact that I felt that my life or a loved ones life was endangered by a person acting in a bellicose manner it could argued that using deadly physical force could be justified.
That is my opinion, I am not a lawyer, nor do I pretend to be one. and YMMV
 
What, no hate crime...Oh, that's right...never mind. I wonder if Jesse is planning on calling this type of behavior out? Oh wait, that's right. Nevermind. As caucasions, they were in the wrong neighborhood as only they can be.
 
Pull your weapon point it center mass give him the opportunity to leave, threat to life, disparity of force well within the law to drop this scumbag. Have wife call police and tell them better get here quick.
 
As soon as I'm told I'm in the wrong neighborhood, my sidearm is drawn...Scumbags like that will scatter like roaches. This is the very reason all law abiding citizens should have a chl and carry in a way that you can draw fast!

Being old and out of shape is hardly a defense for shooting someone trying to fight you. Now, if there is several of them or weapons involved that is another situation.

You ignore disparity of force as part of the justification for using lethal force.
 
Wow, Im going to try and keep the anger under control for this one.....I understand our justice system is a bit broken due to over crowding, but I dont understand how 2 of the 3 family members are knocked unconscious, they only recieved a 2nd degree battery charge, especially when bones were broken, and obvious threats were made, if it were me, I would have drawn and fired the minute I was attacked, assuming I had enough time, although, I probably wouldnt have left the store without my weapon pointed at them, and would have had Police on the phone.
Hope the family recovers and some justice is served.

Very true thanks for posting this. We older men, who are disabled, have a right to not be beaten or have great bodily harm done to us! If threaten my hand goes to my weapon. If charged my weapon comes out and is fired. I don't think any court is going to find me guilty of protecting myself or my family from great bodily harm or death. I'm not able to fight because of my disability. My sidearm is the only way I have to defend myself. I will use it if threaten.
Disparity of force is what makes us able to defend ourselves, legally.

Not wishing to upset or belittle anyone but this would be a not brainer for the law if this was white attacking black regarding the hate crime aspect. It just seems to be the way the law looks at discriminatory actions.
