Duty to Retreat...

Just reading various states language about Duty to Retreat laws...Idaho's is my favorite so far:

Duty To Retreat

No duty to retreat exists inside or outside a dwelling in the exercise of
self-defense. A person may also pursue an attacker until he or the third party (being
protected) has been secured from danger. ICJI 1519.
 
NYS requires an attempt at retreat if one can do so safely. You cannot safely retreat with a child in tow, or with a disability, etc. There is no duty to retreat in the home or any dwelling.
 
texas is the best. lol, no duty to retreat, and im sure everyone has heard the guy on the phone with 911 while he loads his 12g and tells dispatch hes gonna shoot them and does, next words to 911 are better send a bus cause i got em. he was protecting his neighbors stuff, no one was hurt or anything except the bad guys. nothing happend to the shooter either.
 
Utah's is "a person does not have a duty to retreat from force or threatened force in a place where that person has lawfully entered or remained." Thats from memory so I may have missed a word but it is pretty clear.

And aj if your referring to Joe Horn, he was tried and aqcuitted and there was quite a bit of controversy surrounding the trial. So while he wasn't convicted, if it were me, I want my actions so clearly legal, that there is no trial.

This is one reason why I will call 911 and say exactly what is necessary and nothing more, there is no advantage to having some long drawn out conversation that WILL be played in a courtroom. Especially saying the things he was. While I agree that you should be able to protect yourself and your habitation, there is no point tempting the DA with that kind of stuff.

Idaho is a great place to live. You can own any type of guns that you want, and you have the right to protect your self here.
