Domestic Violence

I have been looking at Michigan CCW laws and it states if you have been convicted of a domestic within last 8 years you won't get approved. I cant get it expunged because I have another misdemeanor. Does this mean if the the conviction was 12 years ago I can get approved? I'm confused because I read federal law and it states with a domestic at anytime you are not eligible. Can anyone clear this up for me and is their anyone out there that has been approved with a domestic? {Clarify incident** me and x wife argued. I got pissed and threw a ice cream scooper (not intending on hitting her) it bounced off lamp shade and popped her in eye. Neighbor called police because of noise and on arrival saw her red eye.

Similar in Arizona. Some judges are reluctant to convict guys of DV offenses for that reason. Sadly, have worked crisis for about the last 15 years and firearms - usually handguns - are used all too often in DV situations. Not just couples fighting, brothers etc too. Pretty much zero tolerance for DV everywhere in the states. This is part of it.

Bummer,

Don't throw ice cream scoopers :p

Long time ago I dumped the wife and she filed a false EPO on me.

Judge was not too happy with her LOL

Most DV education comes AFTER the incident. In Arizona, and many states, DV includes "posturing" and yelling...and throwing things - even in the opposite direction or at the floor in frustration. Reason for zero tolerance is so many LEOs were killed at DV situations in the old days. I've served on the board of directors of a large DV service agency and worked on crisis teams for many years - DV is the big thing with crisis teams.

I continue to marvel how people who love each other can turn on each other over the silliest things. Far too often its irritability from alcohol withdrawal after a fun night of partying. Booze is involved in at least half of all DV situations. Not just drunk fighting but far too common the fights while grumpy the next day.

DV and firearms is a problem in this country. People killed by firearms in DV show a history of prior DV. Link Removed

Now let me understand this. Thread writer has some confusion over obtaining, I assume, a CCWP because he has an old domestic violence conviction and some other misdemeanor. Be angry at me---if it was up to me you would not be allowed to carry.

In Massachusetts, if you are convicted of domestic abuse or if you had a restraining order against you, you are banned from getting an LTC for LIFE.

When I was still active duty the Laughtenberg accord had guys being relased from duty left and right because they had a domestic violence misdemeanor. They were not even allowed to touch ammo. It was during the Clinton administration that misdemeanor domestic violence was treated as a felony offense and honestly I believe it is just one more way to take guns away from citizens. What comes next shoot someone a dirty look and go to prison?

Good lord. All I can say is, it's a good thing I wasn't on the receiving end of an ice cream scoop to the face.

I was told the only misdemeanor that will keep you from getting your CWP for life is DV.
and misdemeanor drug charges constitute a 3 year wait before buying a gun or obtaining a CWP

Hello? Is anyone gonna mention the sad sad situation in Kansas City? Shooting the woman you love then committing suicide with the same gun is almost textbook. While we may disagree with the law, its pretty easy to see why the lawgrinders thought it was needed. It is soooo sadly common in my area, on the rez, its called "The Navajo Way."

What we need is a DV ad campaign that says something like, "Kill yourself first - let your woman and children live."

Yes, yes, yes. You will never get reliable answers to legal matters in a gun forum. Always check with the proper authority in your state. Last I knew, there was no legal vehicle in AZ to expunge ANY misdemeanor from your record but they CAN expunge a felony. A real weakness in AZ law that few know about and no one seems to want to change. Of course, it may be changed now as it has been a couple of years since I checked on it.
