NEVER TALK WITHOUT A LAWYER!!!
I saw these on another gun forum, I started watching the 1st one and said...eh. Well i'm glad I spent the time to watch both. After this I can also say I will NEVER talk to the police If I'm involved in a shooting or ANY criminal matter no matter how stupid it is. NOT A WORD!!! The first video Is a lawyer going over many different situations, the second vid is of a cop confirming it all. Whats messed up is the lawyer says how juries only hear key items and WILL convict innocent people due to what they "added to the story" the lawyer tested them (and you watching the video) I can't sadly say I failed and did the same thing. There long....but watch them, you won't regret it.

I'm gonna go ahead and call it the same thing. If your lawyers present he won't let you incriminate yourself.....unless he sucks. In that particular situation I'd only hire an lawyer that typically deals with firearms cases.

There are a lot of sucky lawyers out there. You have the right to free speech, the right to keep and bear arms and the right to remain silent. Use them all.
 
These videos are EXCELLENT advice.

I read that on average, there are 6000 false felony convictions each year due to innocent people talking to police.

No point in having a lawyer if you are going to blab to law enforcement. The attorney is being paid by me so he can do whatever talking is needed.

The reason I make the distinction is because Dr. Duane specifically states that you shouldn't make any statement unless or until the case goes to trial.
 
I have seen the video and everyone on this site needs to see it. It is accurate and shows how police BULLY people. Get a good lawyer a shut the %%$* up. You cannot be charged for being silent. You have the right to remain silent, EXERCISE IT!
 
I've practiced criminal law on both sides for more than 35 years. Never speak to a government official without an attorney present.

But that doesn't mean you should never speak to the police. A lot depends on timing and circumstances.

For example, the case of Anthony Capozzi is a good example. He was they guy who was wrongfully convicted and spent 22 years in jail for 3 rapes he didn't commit while the real rapists kept raping and murdering women.

But the wrongful conviction didn't result from Capozzi speaking to the police, it resulted from the 3 eyewitness who swore he was the person that raped them.

20 years after Capozzi's conviction, the real rapists raped and murder what turned out to be his last victim because he was caught shortly thereafter. - BUT BEFORE THE POLICE FIGURED OUT WHO WAS THE REAL KILLER THEY WERE FOCUSING ON THE VICTIMS HUSBAND, NAMING HIM AS A PERSON OF INTEREST!

In other words, the police were focusing a second person who had nothing to do with the murders.

Wisely his attorney had him take the 5th. That left the police with a dead end as to current evidence. So a detective started looking at similar cases and discovered a pattern that lead him back to the Capozzi rapes, during which the cousin of the real rapists had been question because his car had been seen near one of the crime scenes. The detective went back to the cousin and got him to admit that he had lied 20 years earlier, that in fact his uncle (who turned out to be the real rapists) had borrowed the car back then.

Had that husband not shut up the police would have found something in whatever he did say and would have continued trying to prove he was the murder of his wife. Capozzi would have never been exonerated, another innocent person might have ended up convicted, and the real rapist and murder would still be on the loose.
 
I find it interesting that some of the same people who say, "Don't talk to police" are the same people that say, "Just give the officer your ID when he asks for it because you have nothing to hide."

Showing an ID to make a cop go away in the case of OCing around an audience to not further tarnish the image of gun owners is one thing as long as it doesn't turn into harassment (Ya I know, depending on where you are it might) Getting yourself convicted of a crime just because you opened your mouth is another.
 
What I have learned about how to deal with the police after a defensive situation you need to make sure the police know you are a victim by briefly explaining what happened, that you felt threatened, where the evidence is and any witnesses. Then you explain you will cooperate after you have consulted an attorney. If you don't talk to police they will mark you as a suspect. As with most people my age (55)I was taught at a young age that police are your friends. Also I used to watch many 'cop' shows and cheared when the cop got the bad guy to confess. Somehow the Constitution was put aside and if it came up anyone who chose to 'remain silent' or exercise any rights was cast in a negative light or accused of hiding something. It seemed that the tv shows were blaming the 4th and 5th amendments. Now we all know there are bad judges who misintrepret the Constution and that is another subject. But it still seems that even on the news anyone who exercises his rights is cast in a negative light. After attending the Post academy in California in the early 1980s I grew more cynical toward leo but still thought they stood for truth and justice. Before anyone thinks Im a cop hater Im not. But if a leo pulls me over how do I know if its a good or bad leo? For several years Ive lived in a small town in eastern Washington and about a year ago there was an incident that changed my way of thinking about cooperating with leo. On my last day of being vice-president of an orginazation one of the members wanted to remove some of his personal belongings from the building and informed me and the president according to the rules. He claimed his car was too small so I had him load his things in my truck which he then unloaded at his home. I was just trying to be helpful. A few hours later I recieved a call from the local police chief who sounded quite agitated. He said the treasurer of the orginazation claimed this stuff was stolen. I invited the chief to come to my house to straighten things out. He came by and had a big chip on his shoulder. He used such lines as "help me understand and just tell me what happened then it will be ok" and "You have nothing to fear" and "if you have nothing to hide just cooperate" and I believed him. As it turned out the treasurer who I strongly suspected of not being honest with the orginazations funds and involved with other shenanigans involving money around town.and a friend had complained to the police. In the spirit of cooperation I explained to the chief about the member removing his things and that the president of the orginazation had been notified according to the rules. The chief then turned 'bully' and threatened to "put the hooks on me and take me in" unless I returned the stuff. I again explained that the stuff was not at my house and since there was a problem contact the president(he never did) and contact the member(he never did) who it belonged to. The chief did not listen and said if I did not get the member to put back the stuff I WOULD BE ARRESTED! The treasurer claimed the stuff belonged to the orginazation. Terrified I managed to get hold of the member who agreed to put the stuff back and interestingly he had enough room for the stuff in his car unlike when he claimed he neeeded my truck to remove the stuff. Well the story made the paper and in 3 separate issues did 3 very biased stories about me. I also found out that the chief, the treasurer and her friend, the newspaperman were not only friends with each other but had a meeting with the member who wanted to remove the stuff. I know a long story. I contacted a out of state friend who was a lawyer who informed me that the chief was 'blowing smoke' and there was no grounds for any charges and that I was foolish to talk to a cop without a lawyer. In the end there was no charges and it retroactively became apparent to me that the chief was bullying, threatening, lying, trying to intimidate me and had no case whatsoever and was perhaps helping to cover up something else. He and the others are part of the 'good ol boys club' that run the town. Well a year later I have been excluded from almost every group and event I was involved with and every job Ive applied for Ive been turned down. The man who took the stuff and put it back got a city-wide award of the year and I found out he is a 'white sepratist' and admires Hitler. So here I am honest and with NO crimminal record(not even a parking ticket) being shunned by the town and with no job. My wife works at a fast food restraunt which is our sole income. A year later people still ask me if I was in jail(no I wasnt and not charged) and call me a thief. Yes I am moving as soon as I can sell my house. All this because I was honest and in a spirit of cooperation talked to the police. Some people believe we should cooperate with leo's. I did and look what happened. I have since educated myself and saw the videos that were refered to at the start of this thread almost a year ago. I agree100% with them. If confronted by an leo whether open carrying my pistol(I still have my guns) or for any other reason I will only do what I am legally required to and nothing else. I have a new appreciation for the 4th an 5th amendments to our great Constitution. Those amendments were designed to protect ALL of us from the immense power of the state and now I understand them much better. THOSE RIGHTS BELONG TO ALL OF US AND IF WE DO NOT USE THEM WE WILL LOSE THEM> . And please if you are a honest leo do not take it personal or as a sign of disrespect or think I must be guilty of something when I exercise my rights. I have had a bad experiance with a bad leo and I have no idea if you are good or bad. Police need to obey the law also. I honestly think there was some kind of conspiricy and wish the law could help me. Hey NavyLT if you or anyone else know a good lawyer in Washington State let me know. I need one badly.
 
My lawyer says the average citizen's best weapon is the ability to memorize and recite this poem.

"I refuse to consent to any search of my premises, the location of my arrest, my car or effects. I wish to exercise my rights under the Fourth, Fifth, and Sixth Amendments to remain silent and to have my attorney present during any questioning or lineup. If you ignore my exercise of the rights and attempt to procure a waiver, I wish to confer with my attorney prior to any conversation with the law enforcement agent on the subject of waiver."
 
Who me? Did not do it, you did not see me do it and my attorney said I did not do it. Most folks hate attorneys until they need one, let your attorney do the talking and shut up.

You do realize that saying you 'did not do it' is actually saying something. I think what the OP is trying to say is that you should not even say that much. How many celebrities have been convicted for lying in lieu of whatever actual crimes they committed.

Look at the baseball scandal, Mark McGwire faced no criminal charges specifically because he did not deny taking illegal steroids. Had he denied taking steroids, instead of pleading the 5th to refrain from incriminating himself, he would be in the same boat as Barry Bonds.

What about Martha Stewart, she was convicted for lying and obstruction of justice, but not for the insider trading charges that were the initial cause of her investigation. Had she taken her lawyers advice and plead the 5th instead of professing her innocence, she could have avoided prison entirely.
 
Carry a Business Card in Your Wallet

I carry my attorney's card in my wallet with his cell number on the back. Even as a sworn State Constable I will not discuss a confrontation without my attorney present. No exceptions! Any good PBA (FOP) attorney would give you the same advice. There are over zealous DAs everywhere. Some spend a great deal of time trying to get their names in the papers.
 
It appears from this ruling the officers were already on location with the presumption illegal activity was taking place, since no illegal activity takes place at my home the resonable response to a door being kicked in will be tactical in nature.
