CANTON
Police officer Daniel Harless, who threatened to kill a motorist during a June 2011 traffic stop, won't return to the police department.
The city reached a settlement with Harless Tuesday that resolves all legal disputes.
The city agrees to the following:
• Pay Harless $40,000 within 30 days.
• Not challenge Harless's participation in the state workers' compensation system. Harless suffers from post-traumatic stress disorder from a 2003 incident.
• Issue Harless a retired-officer ID upon his providing proof of regular or disability retirement through the Ohio Police and Fire Pension System.
• Provide a neutral recommendation for all future employment, providing only factual details of his employment. The settlement acknowledges that
Harless agrees to:
• Resign in writing effective from the termination date on January 2012.
• Drop all other legal claims and grievances against the city.
• Not seek future employment with the city.
• Not file any future claims against the city.
Harless became the center of controversy after video surfaced on the Internet of his conduct during a traffic stop in the early morning hours of June 2011. Harless is seen screaming at the driver, William Bartlett of Brewster, for failing to immediately notify him that he was carrying a concealed weapon.
The city fired Harless, a 15-year veteran of the police force, after discovering two similar incidents. Last year, an arbitrator ordered that Harless be returned to work pending medical clearance. In a rare move, the city appealed the arbitrator's binding decision, saying that it was flawed and did not set a limit to when Harless could return to work.
As part of the settlement, which was reached after months of ongoing discussions between the city and Harless's attorney, both sides agree that they will make no public comment.

In addition to being on administrative leave for how long, with pay but without working...he was given $40,000, but most beneficial...he gets to keep his full retirement AND he gets to keep all the special privileges afforded to retired police officers by the Law Enforcement Officer Safety Act which includes carrying a firearm in most places where the lower class citizens (you and I) cannot.

Sounds like the thing to do when you are eligible for retirement as a police officer is to threaten to kill someone because they followed part of the law that requires you to inform them of a CCW permit and firearm, claim that PTSD made you do it, and you end up with a sweeter deal in retirement than if you had just served honorably and had a spotless record.
 
A good deal is an understatement. Sounds like he should have been locked up and instead he's being treated like a hero. And I may have missed it, but I didn't see anywhere that he can't be a police officer in another town.

That's cause he can if wants too. Part of the deal was for the city to provide a "neutral recommendation" for future employment. However, it also says they can only share "factual information" about his employment and I don't see how forwarding a copy of the video with a note that says "this is why we fired his ass" could get any more factual. That video alone should keep him from getting employed in all but the most corrupt departments.
 
If they give that thug a retired LEO id he will be able to carry a firearm. One day that tightass will kill someone.
 
Dear so-called "good cops," this is why the American public trusts you less than ever before in our nation's history. If you don't learn how to police yourselves better than this case demonstrates, we have no choice but to label you all enemies of The People out of nothing but simple self-preservation.

The thought that that pig is going to get special privileges throughout the entire nation makes me sick to my f'n stomach. He should be unemployable for anything but the most menial work having nothing to do with working with other human beings for the rest of his life. Lord forgive me, but this freak needs to have his Express Pass punched to Hell at Your earliest possible convenience.

Regarding "good" cops.

There are AT LEAST three videos of Harless being a psychopath.

In NONE of them do ANY of his partners intervene in ANY way.

The odds are that NONE of them reported him after the fact.

The clear inference is that given the choice between protecting a citizen or protecting a cop committing a crime against a citizen, the "good" cops will protect the Harlesses, Abbates and Drew Petersons of the world.

Aren't unions and collective bargaining wonderful things to behold? Plus they're afraid of lawsuits courtesy of our out of control tort system. The city was a victim of Harless, just as Bill Bartlett was.

If you dig a little deeper, it's also blatantly obvious that the Canton PD has nothing worthy of being called a "disciplinary mechanism". Harless was allowed to offend over and over, and not only that, but the arbitration board found that other cops had committed WORSE offenses and not been punished AT ALL.

The Canton PD is like an irresponsible dog owner who lets his pit bull run free biting people. Harless may be a mad dog, but his owner is every bit as much to blame.

They should BOTH be punished. Unfortunately, it looks like NEITHER will.

The mad dog continues to run free, without an owner. His old owner continues to let his other dogs run free. It's only a matter of time before other people get bitten...

All that too. The city and Canton PD may have been victims of Harless and the situation that tied their hands, but you're correct that their own complacency and shortsightedness also helped them paint themselves into that corner they couldn't escape from without great expense. They aren't alone in that regard. A lot of cities and police departments don't consider such things.

I noticed that too. If he gets a retired LEO I.D. he can apply for, and get, a LEOSA CC permit enabling him to carry in all 50 states and D.C. Got mine after I honorably retired.

It disappoints me you used pit bull....but later you just say dog...unfortunate...I guess the media driven pit bull reputation is still strong and hasn't moved on to another breed yet ...

As I understand it, beagles bite more often than pit bulls.

Which KILLS or MAIMS more often?

It's a question of the potential for harm caused by the dog allowed to roam free biting people.

Let's say for argument's sake that city clerks have more negative interactions with citizens than cops.

Which has the greater capacity to do serious harm?

I'm more concerned if a cop threatens to murder me once than if the clerk at the DMV uses a racial slur against me every day.

I get you are saying a large dog versus a small dog...it just bothers me personally (I don't expect others to understand it) when pit bulls are needlessly singled out. German shepherd, chow chow, Doberman, Rottweiler, husky...it wouldn't be right to single out them either, but all have seen their share deaths and maiming.

I agree with your analogy when it comes to large dogs being capable of massive damage (cops) vs small dogs that might draw blood on a good bite (store clerk). I'm in 100% agreement. I would just use the terms I used: large dog, small dog, and bad owner.

Not to mention, it's insulting to compare them to how bad police are....:-D

After reading this and also watching lots of videos i can only say im shocked! While i have had little interaction with LEOs i have never had one go crazy on me. Most (some more than others) just have a job to do and must deal with the worst of people and take that job very serious. More than once i have been pulled over and let go with a warning and generally they are stern but understanding. I am getting my CCP next payday and wonder now what will happen if stopped.
