D.C. police won’t arrest David Gregory

Washington’s Metropolitan Police Department (MPD) has concluded its investigation into NBC anchor David Gregory without an arrest.

Police Chief Cathy L. Lanier’s spokesman Gwendolyn Crump emailed Wednesday morning: “Emily, MPD has completed the investigation into this matter, and the case has been presented to the OAG for a determination of the prosecutorial merit of the case.”

I've asked Ms. Crump several follow-up questions about the case, including why Mr. Gregory was not interviewed and why a search warrant was not issued for the subject's home and office.

Ted Gest, the spokesman for the District’s Office of the Attorney General (OAG), told the decision whether or not to prosecute Mr. Gregory will come "possibly this week."

Richard Gardiner, a firearms attorney, said that MPD referring the case to the OAG without arrest is not unexpected. “This is not unusual for high-profile cases. The police investigate the facts and give the results to the prosecutor to decide whether to bring charges,” he explained.

He added that, “It’s also routine in cases like this where the crime was not committed in police officers’ presence.” If the OAG decides to prosecute, a warrant for Mr. Gregory’s arrest will be requested.

I asked Mr. Gardiner if it was normal that the police would not interview the subject, Mr. Gregory, as part of their investigation. “I’m not surprised at all they didn't interview him,” he said. “The police usually only interview people who are not sophisticated and wealthy because the police figure they don’t have counsel and so don’t know that they can say, ‘no.’”

The police chief has led a inquiry for three and a half weeks into whether the “Meet the Press” anchor broke the firearms law on Dec. 23 when when he held up a 30-round rifle magazine on his D.C.-based show. Magazines over 10 rounds are considered “high capacity” by the District and banned. NBC called MPD in advance of the show for permission to break the law and was refused.

While Mr. Gregory got away without being arrested or going to jail, the police arrested 105 other people in 2012 on charges that included possession of “high capacity” feeding devices.

One of those cases was James Brinkley, an Army Veteran and federal employee, who was handcuffed, arrested and jailed for possessing two so-called high-capacity magazines and an unregistered firearm. The OAG refused to drop the charges, despite overwhelming evidence that he was legally transporting through Washington.

Mr. Brinkley refused to accept a guilty plea and went to the expense of taking the matter to court. At trial at D.C. Superior Court, Mr. Brinkley said of OAG’s Assistant Attorney General Rachel Bohlen: “I thought I was going to lose because the prosecutor was so rough. She was coming at me like I’d shot somebody.” Magistrate Judge Elizabeth Carroll Wingo acquitted Mr. Brinkley of all the charges.

So while the rich and powerful NBC anchor knowingly broke the firearm law, he was never subjected to the humiliation of being arrested by the police for breaking the same law as ordinary, law-abiding citizens like Mr. Brinkley did last year.

Justice can only prevail if the prosecutor's office at least offers Mr. Gregory a deal to plead guilty, pay a fine and be put on the Gun Offenders’ Registry, like so many others who have been caught up in the city’s inane firearms laws.

Liberals are held to a different standard. Just like in the book Animal Farm, some animals are more equal than others. Go figure.
 
I was stationed in Washington for 20 years. I retired to NC where there is superb barbecue, no traffic jams and reasonable gun laws (not the best, but far from the worst.) It is also a reasonable distance from the politics of DC where an honest citizen can't get a permit to own a gun (nevertheless a carry permit) but where the Mayor admits it is easier to get an illegal gun on any street corner than it is to find a good sandwich. What a bunch of politically correct fools.
 
105 others were arrested in 2012 for violating the tyrannical gun laws in DC, to include possession of high-capacity magazines. This yutz gets off Scott free.

Oh well, there is some good news in this story. Two pieces of good news, actually. No surprise here. Just another muckity-muck.

Ms. Miller has been responsible for at least some minor improvements in DC gun laws since she started her series of articles.
 
I cannot say that I am surprised. The elitist Left has always seen themselves as being "above the rabble" (y'know, the law-abiding American citizen) and see themselves as our 'rulers' and subject to no law that conflicts with their views and agenda. This is just another example of that, "Time out! I have a point to make that requires me to call 'time out' " mentality that so defines the Leftist mindset.

Oh the crime wasn't committed in police presence? Then what the hell is national TV even after being told not to do it by the police? Could someone murder someone on national TV in DC and not be prosecuted? Because that's what they're implying...no, explicitly stating.

I beg to differ on the barbecue. Though after living in NC, you will never lose the taste for vinegar on your barbecue.

Come to Memphis if you want real superb barbecue lol.
 
What about that "illustrious" left wing senator who held up an AK47 with a drum magazine? Think she'll ever be prosecuted?

I'm sure that was legal in some twisted way. You know the world of congress is better than us lowly Americans! :sarcastic:
 
He can't be prosecuted. He's one of the Liberal Elite. They are held to a different standard. The "DOUBLE" Standard.

Oh I also hold David Gregory to a second standard...instead of one middle finger as my SOP for a liberal like Gregory when "His Hairness" shows up on TV, he now receives both middle fingers aka "The Double Standard" which was until recently reserved for any time King Barack or Queen Michelle makes a TV appearance.
 
Actually, I have lived all over the U.S. - 30 different addresses - and I have never met a barbecue I did not like. I really like Corky's BBQ and I am pretty sure that my memory is correct that Corky's is in Memphis.

My immediate thought as well--how can a national media broadcast not be better evidence than being witnessed in place by police!?


Perhaps the powers that be see it as a mere "show and tell" something informative for the viewers and excuseable on those grounds? [:eye roll:]
 
Show and tell. Haha. "This is a high capacity magazine. I was explicitly ordered to NOT bring this here. I disregarded that order." Lock his ass up just to show the stupidity of the law. I don't want him to be labeled a felon but I want parity in application of the law. NBC is NOT above the law...well apparently it is, but shouldn't be.
