Criminologist, economist and author John Lott tells Newsmax that he has serious concerns about Supreme Court nominee Elena Kagan’s position on gun ownership under the Second Amendment.

He also says gun control actually increases the crime rate because widespread gun ownership discourages criminals from committing crimes.

Lott has a Ph.D. in economics from UCLA and is currently a senior research scientist at the University of Maryland. His latest work is a new edition of his book “More Guns, Less Crime.”

In an exclusive interview with Newsmax.TV, Lott was asked for his views on Kagan, whose confirmation hearings are set to begin on Monday.

“Both [Supreme Court Justice Sonia] Sotomayor and Kagan are pretty much cut from the same cloth,” he says.

“Last year when Sotomayor was testifying before the Senate Judiciary Committee for her confirmation, she claimed that there was no constitutional right to self-defense.

“Kagan has made numerous statements on the gun issue. While she was clerking for Justice Thurgood Marshall, she wrote a memo saying she was unsympathetic to the notion that there was an individual right in the Second Amendment.

“And she from 1995 to 1999, she spearheaded President Bill Clinton’s push on gun control. People remember the pushes on gun control at that time. Elena Kagan was the person who was directly responsible for a lot of that.”

It might be noted that around the time Kagan’s confirmation hearings are scheduled to begin on Monday, the Supreme Court is expected on Monday to hand down a decision on an important gun rights case. Petitioners in McDonald v. City of Chicago are challenging a local ban on handguns.

Lott also criticized Kagan’s position in the Citizens United case. As Solicitor General she argued against Citizens United before the Supreme Court and lost, as the Court said prohibiting corporations from contributing to political campaigns was a violation of free speech.

Asked to explain the title of his book “More Guns, Less Crime,” Lott tells Newsmax: “Guns can make it easy for bad things to happen, but they can also make it easier for people to protect themselves and prevent bad things from happening.

“The fact that would-be victims might be able to defend themselves can make it riskier for criminals to commit crimes and deter some of them from doing so.

“The question is, what do you advise someone to do when they have to confront a criminal by themselves. Simply telling them to behave passively actually turns out to be very bad advice. By far the safest course of action for someone to take when they’re confronted by a criminal by themselves is to have a gun.”

Criminals are more likely to target people they are confident are not armed and would be an easy mark, Lott explains.

“Criminals are like anybody else — if you make something more costly, they do less of it, and they tend to prefer easier jobs as opposed to harder jobs.”

Lott says he pored over mountains of county, city, and state data in his study of how crime rates change over time.

“What you find consistently is that as the percentage of the population with permitted concealed handguns, or the percentage of the population with gun ownership generally, rises, you see drops in violent crime.”

Lott takes issue with Mexican President Felipe Calderon’s call to the U.S. Congress for a renewal of the federal ban on assault weapons. He said in May that easy access to high-powered weapons is contributing to drug-related violence along the border, and claimed murder rates in Mexico and the U.S. rose after the ban was lifted in 2004. But Lott said the murder rate has actually gone down in the U.S. since that time, and the rate in Mexico dropped from 2004 to 2008 before increasing last year.

“It’s not clear what theory you might have for why murder rates would increase five years after the assault weapons ban,” he says.

Lott adds that much of the weaponry used by Mexican drug gangs comes from other countries around the world, and an assault weapons ban would do nothing to control these weapons.

On Thursday, Gun Owners of America had the important opportunity to testify concerning the Second Amendment views of Supreme Court nominee Elena Kagan.

William J. Olson, counsel of record on amicus briefs for GOA in both the Heller and McDonald Supreme Court cases, testified at the hearing that Kagan has demonstrated "visceral hostility" to the Second Amendment right to keep and bear arms.

Moreover, Olson demonstrated that Elena Kagan's view of rights is tied in directly to her view of Judicial Supremacy, that is, that our rights "are whatever a majority of the Supreme Court rules at a particular time in a particular case."

But under that philosophy, Olson said, "what the Court grants, the Court may take away."

So what's the bottom line? "f Ms. Kagan does not know whether our inalienable rights to defend ourselves from criminals and tyrants comes from God -- as the Declaration of Independence states -- or from government, she cannot be trusted to protect our God-given right to self-preservation," Olson concluded.

There are two things I would like to address yes All Americans should be educated on this woman and she should not be appointed.

Now if she is appointed and some how another second amendment issue is brought before the supereme court and she and others on the court strike down the second amendment, it does not matter every American should not comply with the ruling,

(RINO) Senator Lindsey Graham was one of nine (RINO) Republicans to vote to confirm Supreme Court Justice Sonia Sotomayor.

During the course of her confirmation hearings, Sotomayor told the Senate and all Americans that she would respect the Heller decision and the individual right to keep and bear arms.

The assurances made by Sotomayor, not surprisingly, were meaningless. Less than a year after her confirmation hearings, Sotomayor signed a dissenting opinion in the McDonald case that stated, "I can find nothing in the Second Amendment's text, history, or underlying rationale that could warrant characterizing it as 'fundamental' insofar as it seeks to protect the keeping and bearing of arms for private self-defense purposes."

Of course, this surprised no one, and GOA had warned all Senators that this type of decision could be expected from Sotomayor. But (RINO) Sen. Graham voted for her anyway.

Now the Senate is debating the confirmation of Supreme Court justice nominee Elena Kagan.

During her hearings last week, Kagan ducked and dodged questions about the Second Amendment, and she refused to declare whether she believes the Second Amendment protects an individual right.

While Kagan blathered on and on about precedent and "settled law" with regard to the Supreme Court decisions in Heller and McDonald, this in no way precludes her from ruling that almost any gun law -- including gun owner registration, purchasing limits, waiting periods, private sale background checks, and more -- are consistent with the Constitution.

As GOA attorney William J. Olson, who testified at the hearings, noted: "If [Kagan] were to go on the Court, with what we know about her now, she could be the most anti-gun justice on that Court." (Click Link Removed for video of that testimony.)

(RINO) Sen. Graham claims to support the Second Amendment. Well, if that's the case then there is NO WAY he can vote to confirm anti-gun radical Elena Kagan to the Supreme Court of the United States!

(RINO) Lindsey Graham got burned by Justice Sotomayor, but has he learned his lesson? It is imperative that gun owners contact (RINO) Sen. Graham right away and urge him to come out now against the confirmation of Elena Kagan.

The hearings on Elena Kagan to be a justice on the U.S. Supreme Court are over.

Senate Democrats slammed them through quickly, in the same way they did ObamaCare. And, like ObamaCare, they made sure that Senate Republicans would not have the material they needed to review Kagan's record -- withholding, for example, large amounts of Clinton administration legal advice on a claim of executive privilege.

While much has been concealed, what we do know about Kagan is not good, as her public service has clearly shown antagonism to the Constitution and the Separation of Powers.

For example, when it became clear that the Supreme Court might strike down parts of the Brady Act (which it eventually did in 1997), Kagan suggested that President Clinton "by executive order, [might] prohibit a FFL from selling a handgun" without a certification from local police.

In other words, Kagan believed that the President could circumvent the role of Congress and to act unilaterally, without any legal authority, to impose restrictions upon the private ownership of handguns.

Not only that, Kagan drafted a memo for President Clinton suggesting a whole list of guns that could be banned by executive fiat. The Los Angeles Times reported on May 27, 2010, that: "At the time of the [1997] import ban, Jose Cerda, who worked in the domestic policy shop run by Kagan and her boss, Bruce Reed, said, 'We are taking the law and bending it as far as it can to capture a whole new class of guns.'"

Combine all of this with the fact that in 1987 Elena Kagan told her boss, Justice Thurgood Marshall, that she was "not sympathetic" to the plight of an African-American man who wanted to own a gun for self-protection because he carried large sums of cash when depositing money for the laundromat where he worked in Washington, D.C.

Elena Kagan will follow philosophically in the footsteps of Sonia Sotomayor. During her confirmation hearings, Americans were promised that Sotomayor believed the Heller case in 2008 established "that the Second Amendment right is an individual right." But in the recent McDonald case, Sotomayor joined the minority in wanting to both overturn Heller and deny that the Second Amendment protects a "fundamental" right.

So, Justice Sonia Sotomayor lied her way onto the bench. And "cagey Kagan" is doing exactly the same thing. Please make sure you take action!

The Senate Judiciary Committee will probably be voting on the Elena Kagan nomination soon -- which means the proverbial ball is now rolling. So contact your Senators and urge them to oppose Kagan for the U.S. Supreme Court. And please urge your family and friends to do the same.

kagan has similar beliefs as does sotomayor. Here is an example of sotomayors beliefs:
sotomayor Senate testimony: "I understand the individual right fully that the Supreme Court recognized in Heller." And, "I understand how important the right to bear arms is to many, many Americans."

sotomayor dissent urged that Heller be overruled and declared, "In sum, the Framers did not write the Second Amendment in order to protect a private right of armed self defense."

Liberals like these 2 have no moral issues with saying 1 thing then doing the complete opposite.

ALERT: Lame Duck Sen. Arlen Specter past critic of Kagan who lost his primary bid says he will support the nomination of Kagan to the Supreme Court despite what he calls her "non-answers" to senators' questions during confirmation hearings.

Specter voted last year against confirming Kagan to her current post as solicitor general. He was then a Republican, and has said he opposed her because she wouldn't answer questions about how she'd approach cases. Ignoring

There has been much debate concerning Kagan's involvement in the Solicitor General's brief filed in the E-Verify case. Fourteen House Republicans wrote a letter to Senator Jeff Sessions (R-AL) saying "It has come to our attention that Supreme Court nominee Elena Kagan played a key role in authorizing the brief." The representatives also stated that the Administration had "no legal basis" for the filing and claimed that Kagan played a "key role" in the decision.

Kagan approved the filing of a brief before the Supreme Court asking that it strike down provisions of the Legal Arizona Worker's Act, which suspends or revokes business licenses of corporations which knowingly hire illegal immigrants, even though Federal law expressly prohibits such hiring. She did this even after the liberal 9th Circuit had upheld the law.

Senator Jon Kyl (R-AZ), questions Kagan's position on this issue involving his home state, "I'm deeply troubled by her decision as Solicitor General to urge the Supreme Court to review and strike down an Arizona law designed to prevent employers from hiring illegal aliens. The Ninth Circuit unanimously upheld the law because federal immigration law explicitly allows states to sanction employers through their business licensing regimes. I think there are legitimate questions about whether the brief authorized by Ms. Kagan - which flies in the face of the plain language of the law and urges the Supreme Court to strike these enforcement provisions down-was motivated by political influence at the White House and within the Department of Justice."
Kyl also asked Ms. Kagan why the feds supported review when there was no conflict among the lower courts. Kagan responded that the federal government felt the issue was important because it was arising in a number of places around the country.

We must not confirm Kagan, yet another under-qualified and inexperienced liberal to get on-the-job training. We do not need an inexperienced and unqualified Supreme Court Justice to be "serving" like Obama, whose ineptitude is wrecking the country. His chaotic prosecution of the war in Afghanistan, our intensifying border crisis with Mexico, and his paralysis and failure to react and lead in the Gulf Oil Spill that has destroyed vast areas of coastal marshes and the lives of people who have lived there for generations -- all demonstrate the terrible costs of putting an unqualified ideologue in a position of great power and authority. America cannot afford to do so with a lifetime SCOTUS appointment!

Sen. Jon Kyl, R-AZ known for speaking the truth said Kagan's record is full of "warning signs" that she may be what he called a "results-oriented" justice -- Citing her liberal record as clerk for Justice Marshall, Kyl said many of her memos then "appeared to be based largely on her own liberal political views."

"This kind of naked political judgment appears frequently throughout Kagan's work as a Supreme Court clerk," Kyl said.



The direction of immigration enforcement may be decided by a Supreme Court that Kagan will rule on. Kagan has issued opinions on two separate cases which shed some light on how she has approached the immigration issue. Kagan’s approach to immigration cases appears to hold that illegal aliens — regardless of their status — are fully protected with citizens' rights by the U.S. Constitution.

Stop Kagan - Vote Expected TODAY July 20th


ALERT: Lame Duck Sen. Arlen Specter past critic of Kagan who lost his primary bid says he will support the nomination of Kagan to the Supreme Court despite what he calls her "non-answers" to senators' questions during confirmation hearings.

Specter voted last year against confirming Kagan to her current post as solicitor general. He was then a Republican, and has said he opposed her because she wouldn't answer questions about how she'd approach cases. Ignoring

Dems continue to push to confirm Kagan while admitting that Kagan is an inexperienced academic ideologue on an extreme liberal quest to promote her liberal beliefs. Feinstein, D-CA said: "Frankly, I find this (lack of experience) refreshing." Telling Kagan, "I believe you are eminently confirmable."

There has been much debate concerning Kagan's involvement in the Solicitor General's brief filed in the E-Verify case. Fourteen House Republicans wrote a letter to Senator Jeff Sessions (R-AL) saying "It has come to our attention that Supreme Court nominee Elena Kagan played a key role in authorizing the brief." The representatives also stated that the Administration had "no legal basis" for the filing and claimed that Kagan played a "key role" in the decision.

Kagan approved the filing of a brief before the Supreme Court asking that it strike down provisions of the Legal Arizona Worker's Act, which suspends or revokes business licenses of corporations which knowingly hire illegal immigrants, even though Federal law expressly prohibits such hiring. She did this even after the liberal 9th Circuit had upheld the law.

Senator Jon Kyl (R-AZ), questions Kagan's position on this issue involving his home state, "I'm deeply troubled by her decision as Solicitor General to urge the Supreme Court to review and strike down an Arizona law designed to prevent employers from hiring illegal aliens. The Ninth Circuit unanimously upheld the law because federal immigration law explicitly allows states to sanction employers through their business licensing regimes. I think there are legitimate questions about whether the brief authorized by Ms. Kagan - which flies in the face of the plain language of the law and urges the Supreme Court to strike these enforcement provisions down-was motivated by political influence at the White House and within the Department of Justice."
Kyl also asked Ms. Kagan why the feds supported review when there was no conflict among the lower courts. Kagan responded that the federal government felt the issue was important because it was arising in a number of places around the country.

We must not confirm Kagan, yet another under-qualified and inexperienced liberal to get on-the-job training. We do not need an inexperienced and unqualified Supreme Court Justice to be "serving" like Obama, whose ineptitude is wrecking the country. His chaotic prosecution of the war in Afghanistan, our intensifying border crisis with Mexico, and his paralysis and failure to react and lead in the Gulf Oil Spill that has destroyed vast areas of coastal marshes and the lives of people who have lived there for generations -- all demonstrate the terrible costs of putting an unqualified ideologue in a position of great power and authority. America cannot afford to do so with a lifetime SCOTUS appointment!

Sen. Jon Kyl, R-AZ known for speaking the truth said Kagan's record is full of "warning signs" that she may be what he called a "results-oriented" justice -- Citing her liberal record as clerk for Justice Marshall, Kyl said many of her memos then "appeared to be based largely on her own liberal political views."

"This kind of naked political judgment appears frequently throughout Kagan's work as a Supreme Court clerk," Kyl said.



The direction of immigration enforcement may be decided by a Supreme Court that Kagan will rule on. Kagan has issued opinions on two separate cases which shed some light on how she has approached the immigration issue. Kagan’s approach to immigration cases appears to hold that illegal aliens — regardless of their status — are fully protected with citizens' rights by the U.S. Constitution.

The vote was 13-6, with RINO Senator Lindsey Graham (R-S.C.) joining the majority Democrats.

This is crunch time.

The U.S. Senate will be voting on the Elena Kagan nomination by the end of the week, and in doing so, could replace an aging John Paul Stevens with a much younger -- and very radical -- anti-gun Justice.

It would be better for the Supreme Court to begin its 2010-2011 session with only eight Justices, than for this radical nominee to be confirmed. You will remember that in the McDonald decision, respect for our Second Amendment rights was left hanging by just a thread, on a 5-4 vote.

A vote to confirm Elena Kagan could put her on the Court for the next 30 years or more. As we have stated in the past, Kagan's record is abysmal:

* While serving in the Clinton administration, Kagan drafted an executive order to ban certain semi-automatic firearms;

* She suggested that the President could issue another executive order -- again, bypassing Congress -- to ban gun purchases without a police background check;

* As a law clerk, she advised against the Supreme Court considering Sandidge v. United States in a case that questioned the constitutionality of the D.C. gun ban, writing that she was "not sympathetic" to the gun owner's Second Amendment claims; and

* Kagan was also part of the Clinton team that pushed the firearms industry to include gun locks with all gun purchases and was in the Clinton administration when the President pushed legislation that would close down gun shows.

Be encouraged. We are standing with the American people in opposition to Elena Kagan. Senators who disregard our voice will pay a tremendous price in November.

She is a radical who is WAY OUT OF THE AMERICAN MAINSTREAM. A CBS news poll reported on July 13 that only 21% of the American public thinks the Senate should confirm Elena Kagan.

Another poll indicates that as many as one out every two voters would be "less likely" to vote for their incumbent Senator if he or she were to support Kagan.

Please be assured that voters will remember this vote in November.

ON THE FLOOR OF THE SENATE TODAY

Senator Thune quoted GOA accurately. Elena Kagan is going to be a disaster on the Supreme Court.

Our gun rights are hanging by a thread. Prior to the vote in the U.S. Senate today, Senator Jeff Sessions of Alabama sounded the alarm: "Most Americans are totally unaware [that] the Second Amendment hangs by a mere thread [by] two 5-4 decisions recently...."

He was referring, of course, to the two gun-related decisions over the past couple of years where the Supreme Court narrowly ruled in favor of gun rights.

With this in mind, several Senators spent almost an hour today talking exclusively about the Second Amendment, its importance to all Americans across the country, and the danger that President Obama's most recent pick to the U.S. Supreme Court poses to our gun rights.

Sadly, the Senate today voted 63-37 to confirm Elena Kagan to the U.S. Supreme Court. While this is disappointing, you need to realize that we got more votes against Kagan than we have ever gotten against a Supreme Court Justice that we've opposed -- more than we garnered against Justices Sotomayor or Ginsburg. (Imagine, Justice Gingsburg only received three negative votes!)

Today, we gained tremendous ground. There were Senators who voted against Kagan today who had NEVER before voted against a Supreme Court Justice. And come this November, we plan to gain even more ground when a new batch of candidates take their seats in the U.S. Senate... when we will probably be able to filibuster (and defeat) any future U.S. Supreme Court Justice that President Obama nominates.

So thank you for all your help in fighting this nominee. Now, it is time for us to shift into high gear and hold the turncoats in Congress accountable. But more on that -- and on today's vote -- below.

While today's loss on the Kagan nomination was disappointing, don't forget that we won a VERY KEY battle last week against legislation to squelch our voice 60 days prior to a general election -- legislation known as the DISCLOSE Act.

This victory means that we will be able to hold accountable those Senators who stabbed gun owners in the back and voted for Elena Kagan today -- and we'll be able to hold them accountable all the way up to Election Day.

So gun owners need to stay engaged in the battle to retain and reclaim our rights. Even though Congress will be out of session this month, you can help us INCREASE our voice in Congress -- and INCREASE our ability to reach more gun owners -- by renewing your membership with GOA and encouraging others to do the same.

Many of you have Senators who pride themselves as being independent thinkers. They claim they are "Blue Dog" Democrats who support the Second Amendment.

Senators Harry Reid of Nevada, Jim Webb of Virginia, Max Baucus and John Tester of Montana, and many more... all the Blue Dogs voted for Elena Kagan, with the exception of Ben Nelson of Nebraska.

You need to realize: These so-called Blue Dogs can't claim they didn't know Kagan's record on gun control. Nor can Lindsay Graham of South Carolina and the other four Republicans who voted for Kagan. They can't claim that Kagan's record is silent on the gun issue. They can't claim she might support gun owner rights in the future.

Senator after Senator sounded the alarm on the floor of the Senate. Just take a look at what a dozen Senators had to say about Elena Kagan's views on Second Amendment rights:

* Sen. Jeff Sessions (R-AL): "Ms. Kagan's record regarding the Second Amendment leaves little doubt that she will be hostile to the rights of law-abiding citizens to own and possess firearms."

* Sen. Chuck Grassley (R-IA): "Solicitor General Kagan's record clearly shows she is a supporter of restrictive gun laws and has worked on numerous initiatives to undercut Second Amendment fundamental rights."

* Sen. Richard Shelby (R-AL): "Ms. Kagan has spent her career implementing antigun initiatives and evidence of her antagonistic attitude towards the Second Amendment can be found from the beginning of her legal career."

* Sen. Orrin Hatch (R-UT): "Ms. Kagan also worked in the Clinton administration to weaken and limit other individual rights such as the Second Amendment right to keep and bear arms. In her hearing, Ms. Kagan refused to acknowledge any real limits on the Federal Government's power, which the Supreme Court has already expanded far beyond anything America's Founders intended, to regulate everything imaginable in the name of interstate commerce."

* Sen. Saxby Chambliss (R-GA): "Documents made available from the Clinton Library show she was a key player in that administration's gun control efforts. She was a key advocate for multiple gun control proposals and even authored multiple Executive Orders that placed restrictions on gun owner rights."

* Sen. Thad Cochran (R-MS): "General Kagan's prior work suggests that she would not protect an individual's constitutional right to bear arms. As a policy advisor to President Clinton, Kagan promoted several gun control proposals, including background checks for all gun purchases in the secondary market, a gun tracing initiative, and giving law enforcement the ability to retain background check information from lawful gun sales. She also drafted executive orders to restrict the importation of semiautomatic rifles and to require all Federal law enforcement officers to install locks on their weapons."

* Sen. John Cornyn (R-TX): "I was also troubled by her testimony with regard to the Second Amendment -- the right to keep and bear arms. She did say the recent decisions in Heller and McDonald are 'settled law,' but I worry that her interpretation of settled law means until there are five new Justices who take a look at that settled law and just decide to change it.... Last year, [Justice Sonia Sotomayor] testified that Heller was settled law. But last month, she joined in a dissenting opinion in McDonald urging it be overturned, saying she did not believe the Second Amendment conferred a fundamental individual right to keep and bear arms."

* Sen. George LeMieux (R-FL): "I am also concerned about Solicitor General Kagan's views on the right to bear arms enumerated in the Second Amendment. I think she has too little regard for some of our Constitution's most fundamental protections. As a law clerk, she was dismissive of the Second Amendment, saying she was not sympathetic to the amendment."

* Sen. Mike Crapo (R-ID): "I am convinced [Kagan] does not believe the Second Amendment reserves to all Americans a strong and broad right to bear arms.... Countless law-abiding Americans were denied their constitutional rights to keep and bear arms for way too long. It is imperative that the next Supreme Court Justice fully understand and accept and support these rights. I am not convinced that Ms. Kagan does, and that causes me great concern."

* Sen. Kay Bailey Hutchison (R-TX): "[I have] serious concerns about her Second Amendment views and her correlating judicial record on the Second Circuit Court."

* Sen. John Ensign (R-NV): "When I had the opportunity to ask Ms. Kagan about her views on the Founders' intent of the Second Amendment, she informed me that although she had read much analysis regarding the Second Amendment, she had never studied its history or origin. Certainly, this statement was surprising to me, especially given her documented history of hostility toward the Second Amendment."

* Sen. Lisa Murkowski (R-AK): "The conclusion I draw from all this is that Ms. Kagan is, at best, uninterested in the Second Amendment at this point in her career. At worst, she is unsympathetic to the millions of Americans who, similar to this Senator, believe the Second Amendment is one of the most important of our constitutional liberties."

These statements are just the tip of the iceberg.

Senators who voted for Elena Kagan cannot claim ignorance. They voted anti-gun, and we need to let them know that we, the American people, are coming to take back our government on Election Day.

They need to hear over and over again that "we will remember in November."
