Constitutional Carry for Wisconsin

I seriously hope the legislators in Wisconsin can see that the path of least resistance here in Wisconsin is to Repeal 941.23 and make CCW legal. Then they must move on to remove the vehicle restrictions and the GFSZ restrictions.
All of the Republicans that were elected this year all ran on the new Republican platform which supports non-permitted carry. We need to hold them all accountable for that. Permits, fees and mandated training only create bigger government and that is the last thing we need.

Yup and yup. Perhaps they will be able to take care of several with one act of legislation. Several are kind of intertwined anyway so it would make it easier to interpret and practice the new mode of operation. Say they repeal concealed without vehicle carry, or the concealed restriction without GFSZ. We would then have several steps to work through and probably many court cases to help determine legislative intent.

Repeal of all the onerous and subject to interpretation laws is required to achieve Constitutional Carry!

Time for a change !

Being a life long Wisconsin resident it is hard for me to imagine any legislature that any elected official would have the balls to support.
I have lived under this oppressive CCW law for my adult life.

I have however exercised my rights under WI. 941.23
there is NO limit on the length of a knife specified only that it must not be hidden. I wear a 7 inch custom made "Fighter" knife in my hip EDC in public.:biggrin:
I wear as may different knives as I have from 10 inch "Choppers" to 3 inch "Capers" With impunity due to their description of the law is and how it reads. There are a few execptions.
But to date there are only 4 Municipalities that have added a 3" blade clause to the law.

This is my way of getting people used to Carry. Most comments have always been ...How pretty, or WOW that is a fine knife. Always positive,and my attitude and posture represent it so.

To Uptown Flea Markets and wherever I go. In my town I have never even been challenged by a LEO. Never.
Now with a new governor in place and fresh blood in the State THIS is the time to move on CCW laws.

Write to your local State Representative,your Governor,your State Senator. Express your request for change.

Now or never Cheeseheads unite! Let's win the fight this time and enable CCW in Wisconsin!

Dont wait for someone to do it for you!

This past summer I made it a point to open carry many nights. I live in the north woods, and I have several carnivorous creatures sharing my neighborhood with me. But I have made the choice to openly carry on a daily basis. Not just on my property while I am doing yard work, but almost all of the time.

You see, I am a fairly new father, and an adopted uncle to most of the neighborhood kids, and I keep track of the number of sex offenders in my area (within 5 miles). Recently I decided to take a good long hard look at what some of these people were convicted of. As it turns out, many of them are first and second degree sexual assault of a child. Some even have child enticement in their past. Now I live in a somewhat remote area, and the police take a minimum of about 10 minutes to respond to a call. Anyone who has been in the north woods knows that in 10 minutes you can make it a real long way away, and if someone has taken a child, that means they can disappear with that child.

Now I know that up here there is no need to take a gun grocery shopping in the middle of winter, but that does not mean that there is no need to stand for those that can not stand for themselves.

I don't think that just anyone should be allowed to open carry either. Then again, there are some people who just should not own a gun. I would think that someone who wants to be armed would hold themselves to at least the same training standard as a police officer. Not that we should go out and spend thousands on classes (I even teach a free open carry course), but at least make sure that you know the dynamics of open carry, the laws involved, the social responsibility, and live by those things when you have a firearm.

There has been no significant history of the responsible citizens carrying firearms here in Wisconsin, and things like CCW are going to be more difficult to push through unless our citizens stand up and create a positive track record with the freedoms we do have to open carry.

Just take a look to the east, Michigan has hundreds of folks lawfully carrying openly. Hardly any problems. Have your legislators look at our stats and that should help them make up their minds...good track record here, just sayin'. springerdave.

That is my point exactly, it takes more than just talking about doing it, and the occasional picnic to make our legislators realize that we are not only capable of handling this responsability, but that it will ultimately reduce crime. But again, it has to be done in a way that takes the "Scardies" into account so that there is not constant conflict with law enforcement.

Even if the Wisconsin legislature repeals the Wisconsin GFSZA, you still wont be able to legally carry inside a "school-zone" due to the Federal Gun Free School Zones Act of 1995.

The Law Says

If Wisconsin did issue a CCW permit, the federal gun free school zone laws would no longer apply. Simply because residents here would be lawfully carrying according to the requirements set forth in this code. It is a sticky situation, but one that is clearly dealt with in this

Title 18 U.S.C Part 1 Chapter 44 Section 922(q)

This would still forbid the carrying of a firearm onto school property for anything other than an imminent threat, and yes, the discharge of a firearm would still get you into some hot water, but would be easily defensible with

WI SS 939.48 Self Defense and Defense of Others
(This would have to be used in conjunction with a Wisconsin issued CCW permit, by a Wisconsin resident)

That clearly states that a person can not use force or threat of force that they reasonably believe will cause great bodily harm and/or death unless that person reasonably believes that use of said force or threat of said force is necessary to prevent such interference.

Basically, that means that a person can use the minimum force that they believe (Being reasonable of course) is necessary to stop someone from hurting someone else or themselves.

I am not trying to be a jail house lawyer here, but the situations that apply according to said law would no longer apply if a person was legally carrying a weapon according to applicable laws in Wisconsin. States are not allowed to make laws that are more or less restrictive than federal laws. That is the way government is set up.

You are partly correct. If Wisconsin issued a CCW permit, people who had it would be exempt from the Fed GFSZA95 possession restrictions while they are in Wisconsin. However, they would not be exempt from the discharge restrictions, as a permit does not provide a discharge exemption. Nor would they be able to legally carry in school zones outside of Wisconsin as the Fed GFSZA95 does not recognize reciprocity.


Also, this post is about "constitutional carry coming to Wisconsin." If someone has to have a permit to legally drive across town... they don't actually have "constitutional carry."

Dont give up!

If you told me 11 or 12 years ago that Michigan would be shall issue and as open carry friendly as it has become,I would still be laughing.

Anything is possible if Michigan can change.

Hell,one of the main reasons I left Michigan in 1999.
