Concealed Carry

I am still a little confused about the Concealed Carry. I drove trucks for 20 years and keep my 9mm in a holster hanging on the dash and was never questioned about it. Why do I need a concealed carry permit.

I congratulate you on your excellent driving. Clearly you were not pulled over very often. If you get a bit sloppy in your adherence to traffic regulations you will want to first get a concealed carry permit IF you want to carry a loaded gun where you can access it. Otherwise just know you are have the potential to be a news story on CNN.

I did know a few OTR truckers over the years who did the same thing. Never had any issues.
 
Ok, so I asked a question and just get called names, no answers. In the US it is legal to carry a gun as long as it is in plain sight. Is there anyone on here that can tell me why I need a Conceal Carry Licence? I was thinking about getting the license, but now I am unsure.

There are at least three state police/highway patrols that will disagree with you: New York, California, and Texas. Yes, Texas.

I am assuming you are confusing a Constitutional Right with being legal. Not all Constitutional Rights are legal to exercise in all states.

Because, in some cases, the Conceal Carry License is the difference between carrying a firearm legally, and carrying a firearm in volation of the law which could result in your arrest and conviction for illegally carrying a firearm.

I can't speak about other states, but in NY you need a permit to "possess" any handgun...period. Technically, if you're with a friend who has a permit and he hands you his unloaded handgun to just look at, you are in 'illegal possession' of a handgun. There is no such thing as having a handgun on your home, glovebox...or anywhere else without a permit in NY.

I think the fact that OTR truckers may have handguns in their cabs traveling through NY without being discovered is just a matter of luck...of not being pulled over.... but if you are and the gun is discovered...enjoy your stay in the tin cup hotel!

my friend you are very misinformed in many states it is NOT legal to carry a firearm period and some states do not allow you to possess an unregistered firearm. maybe you've been extremely lucky over the years but if you were ever stopped in NJ you could be facing 5 years in jail

As others have pointed out, your understanding of what's legal "in the US" is erroneous. Some people jump to conclusions about newcomers being trolls etc. It happens, but the way you asked the question, and your statement that you've been carrying in your rig with a gun "hanging" on the dash, displays a lack of understanding of at least some laws in at least some states.

In AL for instance, your weapon hanging on your dash would not be a lawful way to carry, with or without a concealed carry permit. Without a CCP from any of the states that issue them, the only way to legally transport a weapon in this state is unloaded and locked in either the trunk or a lockable box (or pistol safe) in an SUV or pickup or any other vehicle that doesn't have a trunk. You may not openly carry in a vehicle in this state under any circumstances. If you have a permit though, you can carry concealed just like you can while outside the vehicle. Also with a permit, you can have the weapon accessible and loaded in a glove-box or center console (you don't have to have it locked away in other words).

Now, even if you get a permit in your own state (which I don't think you've told us which state that is), most states are not like AL in that their reciprocity is limited to only states with which they have agreements. AL was one of those states until just two days ago. Now any permit is honored here, whereas, only 22 states that we had reciprocity agreements with were honored before August 1st. Our permits are only honored in those same 22 states still.

In short, you need a permit in order to be lawful in carrying concealed in your own jurisdiction, and to take advantage of the full width and breadth of carry laws in other states that honor your jurisdiction's permit.

Yes. Well, actually NO. The US Constitution does not grant any rights. It declares what rights pre-existed before the government was established.

Can individual states revoke that right?

No.

What the states and the Federal government can do is make it illegal to exercise that right and put you in jail for exercising that right. That is the reality of the situation. The people with the greater firepower ultimately make the rules and this isn't 1776 anymore. The citizens no longer have firepower equal to that of the government to fight back like the founding fathers did.

Are you willing to ride the 2nd Amendment all the way into a jail cell or grave after being killed by the government is what we are trying to tell you.
